I'm so glad for you Pixie, one thing less to worry about for a little while. Some local authorities don't suspend until a person has failed to respond to at least one request, but the legislation allows them to suspend pending the first request so others do just that. It'd be far nicer if all chose to only suspend after a failed response, wouldn't it? Particularly at this time of the year when mail deliveries are all to pot.

My advice is based on my opinion, my experience and my education. I do not profess to be an expert in any given field. Following all the great advice I've had here - including a case study, and getting my son to write a statement. and painstakingly answering the local council's pointless questions "When your son comes home for the weekend does he stay for the whole weekend or just part of it?". Answer "he arrives on the Friday, Saturday or Sunday in either the morning, afternoon or evening and leaves on the Sunday in either the morning, afternoon or evening"...

 

I have had a letter from the council:

 

"Please be advised that based on the information you provided on the 04/01/2011 and 06/01/2011, I have made the decision that your son will remain on your claim, which means that your Housing Benefit entitlement will remain being assessed on the Local Housing Allowance three bedroom rate."

 

Woo hoo!!! I can't believe they've backed down already, I had an appointment to see Shelter this week who were going to take the case on for me which I have just cancelled and I can't quite believe it myself either! Thank you all so so much for all the help and support, I thought you'd like to join in my victory dance!!! I will be sticking around though, maybe I can help someone else!
