    • I am sorry about getting your status mixed up.  I have noticed one thing in your excellent WS. On their claim they are only pursuing you as the keeper-I think it is  in their Point C that  states along the lines of -the driver did not pay , so the keeper is liable. So on your No keeper Liability section  You may prefer  to alter 13 to    . It is trite Law that the driver and the keeper cannot be regarded  as the same person and the claimant has failed to offer any proof who was driving.  BY  only pursuing the keeper  when the PCN does not comply with PoFA must mean that their claim fails. See what the Site team thinks as it should  stop the Judge from looking at who was driving as your statement preempts them from even thinking about it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

write a letter of complaint to your local authority, (i would suggest something along the lines of) -

 

Dear sirs

 

Offical Complaint

 

I am in the process of applying for ES, however at the moment my sole income is DLA. I have been advised that you have refused my claim for Housing Benefit.

 

I request that you immediately assess my benefit entitlement based upon my sole income being DLA.

 

If you refuse to do so, please provide me with a detailed explanation as to why I am not entitled to benefit, including the relevant regulations and caselaw upon which your decision is being made.

 

Please note that if you fail to make a decision upon my benefit entitlement or provide the explanation requested, I intend to pursue such failure through the Local Government Ombudsman.

housing benefit and council tax benefit are income based benefits, they are NOT dependent upon your medical

 

if you are not receiving esa, they should assess you award based upon your other income

 

if you are subsequently awarded esa, and the award is backdated, you benefit should be reassesed to include the esa from the date your award is backdated to (in some instances, this may result in an overpayment, which the council will usually seek to recover)

my complaint is that they cancelled it and wasted time when the upcoming new appointment could be for someone else to have there hearing earlier

 

if there had been enough evidence to allow your appeal, they would have

 

the fact that they have decided to rearrange it so you can attend indicates that they require more information from you, so are giving you chance to provide it

 

would you rather they had just rejected your appeal

Questions i have is :

 

  1. What do they mean that the decion is set aside on the 14/9/2012 ?
  2. what does "First Tier" mean ?
  3. will my money be backdated ?
  4. because it doesnt say anything on the letter ?
  5. can the DWP get out of not paying me ?
  6. like making me attend any medical before giving out payment ?
  7. and if they do backdate how long does it take ?

 

 

  1. The tribunal is stating that the DWP decision which was made on 14/09/12 is being overturned
  2. There are 2 different levels of appeal tribunal that deal with social security. When you appeal against a DWP decision, the appeal is heard by a first tier tribunal. If you appeal against a first tier tribunal is goes to the next stage which is an upper tribunal.

If you get Housing Benefit, he may count as a non-dependent on your claim, but since he's under 25 and on JSA that probably won't be an issue. He must reclaim JSA as soon as possible if he moves in. He will simply need to use your address as his for the duration of his stay.

 

As you are getting care component of DLA, there would be no deduction applied to your HB for him, you may even get extra HB if an extra bedroom is allowed for him.
