    • Hi All. A family friends car was having issues when she was on a trip visiting family up north at the begining of January.  She ended up leaving it at my friends garage in the same location, who parked it on his forecourt to investigate the issue, howver he said most likely it is beyond economical repair as its a serious gearbox fault. In the meantime i replaced her car with one of my spare cars. The insurance on the car then expired in at the end of January.  When the insurance expired, I sent a paper V890 paper as i didnt have her V5 Reference number in hand to do it online (i have a copy of this).  She didnt mention she hadnt recieved any confirmation as she didnt know if she would get one.  She then cancelled her road tax at the end of March (i think) as she was paying by DD. She then was travelling up north so didnt get her ,ail until last week. She recievd a letter dated 09/04/2024 stating she had failed to insure the vehcile and there was a £100 fine which could be reduced to £50 if she respons by 11/05/2024.  As soon as we noticed, i got her to dig  out the V5 and SORN'd the vehicle.   My friend has been a bit slow in checking the fault, however i suspect it will still be scrapped and is still on his forecourt. Is this possible to appeal?
    • worthy to not forget Just to let you know this bunch Kensington have been fined £1.225m by the financial regulator for treating borrowers who were in arrears unfairly. Claim those charges back plus the interest and tell them not to add any more to the account.     • Hi All. I went to visit a family friend in Rochdale on a new housing estate opposite a old row of houses. The location is Royle Road, Postcode OL11 3PE. I was originally parked in parking bays outside the old houses, then moved the car, when I noticed my tyre was flat, so parked on what looked like double yellows to use his air pump to check and inflate the tyres before we left the house.   In the time i went inside to sort the pump and power supply i got a PCN.  The tyre then got changed (has a puncture) and we left. PCN Number:         RE######## Date:             04/05/2024 Time:             20:36 Observation:         20:34 to 20:36 Reported location:     Royle Park Road Reason:        Parked in a restricted street during prescribed hours (Code: 01) I believe this PCN is not correct and has grounds to appeal: 1. My friend who moved into the property around 6 months ago, swears that even though it has old double yellows marked, they are not current or council marked.   He said the property development company had said they had marked them for ease of access during development. 2. The road i was parked on was Royle Road.  The PCN was issued for Royle Park Road, which is about 400 yards up the road. 3. There are no sign posts or marking showing parking  restriction hours in the entire area (there maybe on Royle park Road). I have attached a map of the Location where i parked as a red dot. I have 2 questions: a.  Is there a way to check where double yellow lines are marked on some register to check if they are current? b.     • you made it very confusing, though i doubt any of it was ever read by the delivery franchise for DPD. your saving grace might well be you didn't select your own address (though if you are all the same postcode..??) and neither mentioned a safe space other than another neighbour. but with the actual delivery address on the parcel, it appears the driver had a choice of 3 addresses, all under the same post code with differing house numbers. so chose the label one but left it on your doorstep. play it carefully and along with the photo and the retailers requirement you should be ok.   dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I bought some nails yesterday, £3.28 on the shelf, I got charged £3.88. I have been caught several times like this, and not just cheap items.

 

The lady at the counter told me that this has been happening a lot recently, and that prices generally are higher than shown on the shelf.

 

Buyer beware.

Once caught, twice shy. We always check our receipts beffroe leaving the store and I would say that over the past year, accummalated must add up to about £25 - £30.

Besides the one above which is for example marking goods up at £0.65 on the shelf but when it scans through is £0.75 as per your issue. This frequently happens in supermarkets.

The other trick is the two or three for one. Sometimes you pay the normal price for all three!

You can add Tesco, M&S, Somerfield and Waitrose to this. Fummy thugh, I've only ever found an item priced less than the shelf tag (thanks Asda!). One of the reasons why self-checkout is sooo useful!

seriously though, the times that has happened to the wife @ sainsbury's , she just goes to the CS desk and in her loud voice she asks "you stealing from me again" :eek: it does attract attention from other customers, but she always gets a refund :D

I must admit the opposite has been my experience in B&Q - OH bought a set of mini screwdrivers recently which were marked up at £7.98 and he was only charged £5.98. Also years ago we bought 3 of those very sturdy wicker drawer type baskets to go in a kitchen unit which were £15 each, along with a whole trolley load of building materials etc. When we got home and checked the receipt we were not only charged for two baskets not three, but they had only charged £12 each - we hadn't noticed when we were checked out as the bill was for about £200 which seemed right ;)

We got 6 bottles of wine from asda for about £4.50 - God knows how she didn't click...

 

The offer was 3 for £10. We wanted 6 so the cost would be £20. We decided to buy 6 of the same so picked up a box (6) from the shelf for convenience.

 

Went to the checkout and obviously nobody had ever done this before as the box wouldn't scan. I said to the lady, "you may want to get a bottle out", thinking she would scan it and put it as 6.

 

Nope. "£4.50 please".

Actually, that's an interesting question:

 

You get overcharged, you do the legwork, if you don't spot the mistake, you're pence, maybe pounds out.

 

What if you get undercharged? Do you have a moral/legal duty to bring it up to their attention? I am talking of the big companies here, not your local newsagent.

 

Come on, you lot, what would/do you do? ;-)

Actually maybe I should answer first, lol.

 

I have to say that I have no moral streak whatsoever when it comes to the big guys. If they screw up in my favour, that's their problem as far a I am concerned, they have the resources, the technology so there is no excuse for them mucking up.

 

Argos/Homebase had the Lay-Z-Spa on offer at the last bank holiday, advertised at £300 1/2 price. Argos out of stock everywhere, Homebase too, except finally found one miles away, so we ask the local store to get them to keep it for us and we zoom down there.

 

We get there, no-one knows what we're on about, cut long story short, it took the, I kid you not, 45 mns to sort it out. I plonk a couple a dirt cheap DVDs, whip out ye ol' Argos card, do not check the amount ( a really bad habit of mine, I'm afraid to say), pack the lot and off on our merry way home, still grumbling at the incompetence of the staff, and we are talking McDonald' reject level here.

 

It's only home (miles away) that I checked the receipt, and the total bill is for less than £150!!! :shock: Why, I still don't know, but there it is.

 

Did I phone them to apprise them of their error and volunteer to return the goods at my time and expense so they could charge me the correct over double the price? Like f*** I did.

 

So there you have it, morally corrupt that's me. And I admit to not feeling a single twinge of guilt. :razz:

It all depends on the store if it was the local newsagent for which we have a very good one here who could not do enough for you so in that case I would own up.

 

As for the big companies well sod them they fleece us enough as it is with there offers that are not at all.

 

Yup the big companies are very deceiving with there pricing take asda for instance they had a so called bacon offer of 2 for £3 but the individual price was £1 a pack.

 

So you see it works both ways if I was under charged by them its tough

well Mrs Kip does when we have been undercharged starts something like " this bill is wrong , you have charged me the wrong price"

 

of course they take it she is saying they overcharged her, so they go on the defence, with , things like, I never make mistakes, the prices are right the till never gets it wrong, and a few others, she is very polite and tells them again its WRONG, :roll:

 

so she will say "ok as long as your sure its correct and then pays them"

 

that way she has covered herself, plastic security guards or any one else that has the guts to challenge her when she leaves the store LOOKOUT, she would give them the option to examine the floor close up, :rolleyes:

 

now when she is overcharged thats another matter :shock:

 

the times she has given the odd pence on something like £5.02 etc tendered a £10 + the odd pence and they give her £15 change or similar, she questions the change, and of course its another the does till not make mistakes :D

 

she dont do it on prupose , she just dos'nt like loads of small change in her purse

..

I always go back if I have been overcharged. I even went back to the bank last week when I paid in £400 and the woman mistyped £1400.

 

Its tempting to walk away, but I never can.

 

I do make one exception though, those shops who say "check your change, mistakes cannot be rectified after", thats fair game to me.

Are corner shop newsagent is very good he will go out of his way to get the stuff others do not stock.

 

Last week I asked him if those black jacks and fruit salads are still on the market.

 

Today I went in there and yup he had a box of each and those chocolate bananas lol

 

Only problem I've got a black tongue now hehe.

quoted this term once to a product that was nearly a pound higher than on the shelf got told that seen as i hadnt already paid the higher price they would only reduce the cost on the till to the correct price... gits

Actually I'm not sure if still their policy but always check your Tesco recipts because they give you the item for FREE if they over charge you. This has happened on several occasions in Tesco. The first time I only went in for a s/wich but saw a microphone for cheap so I bought it. If I'd bought loads of stuff I wouldn't have realised but on the way out the door I noticed I was charged £2 more. Custoemr service refunded me the whole amount. Another time I bought a washing line and the price was well over what it should have been. The lady at the desk didn't even check and took our word for it and gave us the £25 line for free.

This was last year so they may have changed their policy due to econmic climate perhaps?

Nothing to do with CPUT, Martin, Tesco's themselves changed the policy a lot longer before that because it was costing them a fortune. :rolleyes:

 

The old policy used to be: if they made a mistake, they'd refund you what you'd paid AND let you have the goods free. This cost them dear a couple of years back, when they screwed up on Xbox 360s if memory serves. I hink that's after that one they changed the policy actually.

 

Now, they refund you the difference of twice the difference, and often argue over it too, for the sake of pennies sometimes. :rolleyes:

I havent personally experienced them arguing-I have had a few of these refunds.Theres deff somethings in CPUT on a similar vein-I remember reading it-it even gives a supermarket as an example.

 

I tried the free cream with the strawberries trick again a couple of weeks ago-with some reduced price strawberries-but when I went to try to get the cream-noticed they had took the offer off......ah well...cant win em all.:rolleyes:

Yes.

They also often put things that were previously buy one get one free at their full price-a few pence in reduced cabinet.

 

But be on the lookout for anything thats marked on the packaging as buy one get one free-thats been reduced.

They will still scan as a BOGOF.

 

Last week I saw some scottish kipper fillets in Tesco-price marked £1.50-noticed they said buy on get one free on packaging.

They had been reduced to 75p.

I bought all 10 packs -so equates to 37.5p a pack :D

They are now in freezer.
