Hi everyone,

I wonder isf someone can help I foolishly took out a loan with pounds till Payday and due to some fiancial problems I was unable to repay the direct debit so I cancelled it becuse I didn't want to get charged by my bank. They placed interest on it which I can understand but the problem I am having is with one of their 'so called' customer service people called Eionne Dunne who has called me at my place of work and my home and mobile demanding the moeny in full. I asked him not to phone at work which he said he would not and then he leaves messages. He called today and demanded a 'token payment' of £75.00 as he said he will not be able to hold it until the end of the month. I told if he has to send it to debt collection then do it. He wasn't a happy bunny when I said I didn't have any moeny to give him. Then he said he will call again next week just to see if the situation has changed I told him it wouldn't but I am worried that he might call my place of work again.Any help would be great as he was not very nice on the phone .:Cry::-o

Lots about these on this forum. They are notorious for hassling and probably little you can do other than refuse to talk to them. The good new is that the debt gets passed to clarity after about 4 weeks and they are generally OK to negotiate monthly installements with.

 

I would make no payments to PTP but make sure they don't reinstate the direct debit.

If he calls again simply report them to OFCOM, you have requested that they do not call you at work, and calling at work is very much against the OFT guidelines so report them there as well. Tell the OFT you have been through their internal complaints and they still call... (they actually haven't got an internal complaints department, if they had it would be swamped!).

 

Trading Standards aren't much help here but you could try to see if your local police force has an Economic Crime Unit or some such name which covers this type of loan shark....

The trouble is by the time you get a complaint going with anyone they have passed to Clarity. During that 4-6 weeks it is very difficult to stop them calling. The calls tend to die down when they get no repsonse.

 

However if we all took your advice perhaps something would be done about them. I was also guilty of letting matters rest when it went to Clarity. Wish I had compalined about them.:)

i have problems with them 2, they have rung my employer an told her who they are, depressed doesnt describe how how i feel, humiliated, an suicidal does, i only had the job 3 months, and she has taken petty cash tin away from me!! in case i am tempted she saidx

Not posted for a while but PTP are a bit of a nuisance with calls maybe you could try quoting something like below to them - I did and the calls more or less stopped. I defaulted on my payments with them at end of Feb and have just today received an email and letter from Clarity (who are rumoured to be easier to deal with) my only gripe is they seem to be requesting about £300 more than I believe I actually owe, I did ask by email as soon as I defaulted that PTP froze all interest and charges. Has anyone else had this issue with Clarity? I have emailed asking for a full breakdown of charges anyway.

 

Dear PTP

Account Number ****

 

I refer to your recent telephone calls to myself and I am writing this email in response and would now ask you to correspond with me in writing / email over this debt and not by telephone. Please remove ALL telephone numbers from your files.

 

It is my right to request this and failure to do so means that you will be breach of The Communications Act 2003 and The Administration of Justice Act 2003. Failure to comply means you will without hesitation be reported to OFCOM, Trading Standards and The Office of Fair Trading – meaning your company will be liable to substantial fines.

 

I am not ignoring this debt, contact by email and my previous email proves this.

 

(then detail your offer of payment below and request all charges and any interest is frozen with immediate effect)

Note: PTP will not respond or negotiate to payment offers or you may get a return email asking to ring their collections, don't ring just reiterate your ground and the matter will be passed to Clarity. (usually within 4-6 weeks maximum) At least then if you have made a payment offer you can't be seen as been unreasonable if they did in worse case scenario issue court proceedings as they threaten which is very unlikely due to the amount of interest they charge in the first instance. Judges take a very dim view on these high interest rates in court plus if you have already made an offer...keep all emails and correspondence.

Poppyshakespeare: You poor thing, what a nightmare they have been to you. :evil: Don't quote me on it but I'm sure there is a clause in the Data protection act about discussing financial matters with anything other than account holders unless they have permission (from you) to do so. PTP contacting your employers is completely unacceptable they are in breach of the Data Protection as they are obliged to go through security questions (ie: date of birth etc) before they discuss any information. Double check hun by you maybe able to report then to the FSA or you could try the Financial Services Ombudsman for not following procedure.

Pounds Till Payday cannot disclose any information regarding a file to anyone other than the customer, as this would be breach of DPA. PTP will be looking to speak to yourself directly to discuss your file. It is ideal that you keep the channel of communication open so that we may get a better picture of your financial situation. What part of EMAILS ONLY don't the PTP Customer Services people understand - the reason for keeping everything in Email is because you can reply to an email from anywhere, the contents can be printed out and kept for reference - phone calls are very difficult sometimes.

 

Another example of an 'automated' Customer Services department!!!!!!
