    • Just a little something for consideration When a card is compromised, the replacements can be set up to automatically allow or manually re-add, old recurring transactions. The card issuer may ask you to confirm legitimate transactions which they would effectively 'migrate' to the new card Some do - some don't. Some staff on some cards seem to be entirely unaware/uncaring about this. Some card issuers expect you to sort it all out manually.   BUT if the leak is an ongoing lyca leakas it seems - as soon as you or your CC supplier give it to lyca/the leak source - compromised again     A note on security DONT use the same email or phone number for your banking as you do for sims etc. Although a bank eg santander leak would compromise this Infp seems to suggest that single/compromised multi factor authentication customers are priority targets, with more robustly secure cards being hit by 0.00 tests first Consider that the email address is one of the OTP recieving options AND one of the OTP security checks prior to sending the OTP - with the phone number being another So if they've got your card and email (same email for banking and end contact) - and you aren't forcing a phone OTP - you are compromised.  
    • Thanks for posting up the back of the NTK. The good news s that as it does not comply with the Protection of Freedoms Act, it means that you are not liable for the charge as the keeper as I explained in a previous post.  The PC fails for two reasons. The first is that it does not specify the period of parking. All it does is list the arrival and departure times of your car. Obviously that does not include the time taken to drive to the car parking space, manoeuvre the car into the space and later drive from the space to the exit. Nor does their times include things like getting kids disabled people out of and into the car as well as things like returning the trolley whilst still being parked. All of which can add a fair bit of time to the parking period which can then be subtracted from their ANPR times and makes your actual parking time a lot shorter than 118 minutes they seem to think it is. The second reason is that they failed to ask the keeper to pay Schedule 4 Section 9 [2][e]  (e)state that the creditor does not know both the name of the driver and a current address for service for the driver and invite the keeper— (i)to pay the unpaid parking charges You as keeper are now in the clear which is a good reason for you to contact Sainsbury  stating that you are being pursued as the keeper when you are not liable under the Act as well as the oher things I suggested in my previous post. If you don't get it cancelled with Sainsbury this could drag on for months with endless letters unlawfully pushing the price up to scare you into paying.  
    • Brilliant! That's great to hear and honestly pleased I'm wrong, my advice was out of concern. I checked some of your previous posts last night and you've been giving great advice to others at times. Bringing a claim can be serious (counter-claims etc) and it didn't appear you were knowledgeable based on posts so far. Far from an expert myself, just interested and will try to help. I'll sit on the sidelines, best of luck with the claim!
    • Thank you so much for the advice  I will try and up my savings to £500 for the next 6 months. Although I do still have an uphill battle, I feel more able to deal with it.  I hope my experience with the cifas marker helps someone else who finds themselves in that quite horrible situation. It is a huge weight off my shoulders getting it removed.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hey all been catching up on whats happening. I have had a reply to my dispute letter and this is what it says

Dear

I refer to your recent letter

 

I am not yet in a position to provide you with a full response because I am still investigating the issues you have raised. When I recieve the information I need, I will write to you again. This should be no later than 01 June 2010.

Then it just says I can ask the fo to review my complaint.

hi guys..

advice pls.. sorry if im repeating what has been said-

so far i have sent 3 letters

1. the one saying they have breached there contract etc..

2. stating why computeach arnt like for like etc..

3. the dispute letter.

 

I have had no reply to any of them and have only received the generic we have found you computeach letters..

 

my payment was due out on the 15th.. i didnt pay.. today i receive a text saying my account is over due.. perhpas it was an oversight and to call them to make a payment.

 

Im due to contact the fos-going to phone tomorow and see what i need to do etc....

 

the no win no fee adviced we dont contact bpf unless to tell them we are seeking legal advice ... but should i phone and explin that i will not be making payment as they have not acknowledged any of my letters.. as far as im concerned my account has not been sorted out ( sent my letters recorded so ni know they arrived) and that i am not receiving any training from computeach so why should i pay.

 

im really nevous about this .. debt collectors court... the idea of being threatened with that scares me..

 

 

did you record delivery? i sent my dispute letter to the local post office,and instead of putting into a letter,they stuck the letter in a parcel,so they had to sign for it before they could take it.

What was the legislation regarding calls / letters demanding money when your account is in disputelink3.gif?

Im sure it was mentioned earlier in this thread but I cant find it lol.

I have now had "Final Response" from Barclays confirming Computeach will:

 

Pay for exam re-sits

Supply Vouchers for exams in your area.

Honour the length of contract you signed up for (mine is until 2012)

Supply the course I signed up for (MCSE+CCNA)

 

This has also been confirmed in an email from Computeach.

 

As I have lost all confidence in distance learning and Computeach have such a bad reputation I don't want to continue with a provider I didn't sign up with.

 

It looks like there is no argument left, I am due to pay in three days.

 

Any suggestions?

Where are the course locations? have they changed? or have you completed the courses and just doing exams?

seems like they're clutching at straws now so desperate to keep you on. I still wouldn't have any of it! LIke you said, it's all irrelevant really as this is not the company you signed up for!

What are you due to pay? your loan? Might be worth paying it as usual, complaning to FOS anyway and hope for a refund. If you don't pay the loan, complain to FOS and they go in Barclays favour (worst case scenario) at least your credit file won't be effected.

Yeah don't pay, there are numerous reason other then not being like for like. The main one being that the section 75 legislation also gives us the right to refuse the new provider and barclays box ticking doe's not constitute us being provided with the same service. Not to mention us being mis-sold the course in the first place and the length of time Barclays took to find a replacement.

The course location is the same (Dudley).

I expected to travel for workshops when I signed up (I live on the Isle of Man).

But I was saving travel costs by taking the exams here on the Island.

I was due to pay the whole sum in February but have had my account frozen.

I received a text message yesterday telling me to pay up.

I have written to FOS and signed up with Fuzzbutt's law firm but nothing seems to be progressing.

I don't want to go down the monthly fee route as that works out to over £11,000.

I see still no mention of not charging you £1200.00 at the end of every year, and job prospects [CT that is]....

And you are still dealing with a company [CT] that have a history of lies and financial devastation [ only being propped up with the offer of money from BPF at the moment] Its been mentioned [ in public domain] that they will be lucky to last the year out...then what, another Advent situation?

I would still go down the road of FOS or the class action.These things take time.

 

I have asked on two occasions for them [CT] to put this in writing.

4 weeks later - nothing!

Trust them at your peril - just look at all the law stuff going on at the moment with their own students.

 

BPF should just do the right thing and release you from the contract [if you can call it that]

 

The pair of them are just con artists - trust them at you own peril.

But then again it is your shout.

 

One other very major point - you did not choose CT in the first place,

This bunch of clowns have been chosen for you...WRONG!

They are nothing more than a sunday morning park football team trying to play in the premier league.

 

They way it looks to me is BPF have not handed any money over to you or CT at this point in time.There is something more sinister behind this, like they proped up Advent with cash, and want you to pay for it.Remember the Advent course cost nearly five grand, CT course cost twelve hundred quid.No brainer really.

Its all very simple corporate business.

BPF invested in an IT company [Advent] that went tits up.

And they do not want to pay the price.

They want YOU to do that.

Nothing to do with contracts and doing the right thing by you.

I was in the same boat, I paid the money in full a couple of weeks ago, to avoid the high interest loan, as to pay that off later on down the line was gonna cost me another 3k in early redemption charges.

I was advised by my solicior to pay the money, then fight for a refund. At least you haven't got the worry hanging over your head then that you may not win this case and you owe £11k instead of whatever it is at the moment. I am confident I will get the money back via FOS, but there is always that doubt you might not, so I just paid it.

I think you do have an argument left, as do we all.

 

I'm assuming that you were sold the course as an open-ended arrangement, like most of us. In which case honoring the end date is not a concession, but an obligation.

 

I am also certain that we can't be forced to go with a company that we may have already made a genuine decision not to use, due to extremely bad press.

 

In fact hopefully none of BPF's case can hold up. But we'll have to wait and see.

 

No-one can advise you whether to make the payments other than specialist legal peeps, however this is my plan of action, for what it's worth.

 

I am choosing to make my payments "under protest", I figure if I am successful in getting this business overturned, BPF will have to pay me back, and if it's not successful then I'll have a choice between paying anyway (and not doing the course because I really can't be bothered), or going bankrupt. I haven't decided either way on this yet.

 

But the debts would be cleared at roughly the same timescale as repairing my credit.

I had it pointed out to me today that...

My course cost £4.950.00 [Advent]

CT cost £1,200.00.

So where is the offer from BPF of the balance?

Thats my next complaint to BPF, and to FOS when i finally get the response from BPF that they have acknowledged or received my dispute letter and have declined the dispute.

 

I have also not got a start and end date on my BPF/Advent agreement.

None of this can possibly stand up in a court of law.:confused:

 

Its like dealing with the bank at Trumpton.

 

I asked BPF that exact question about where the remainder of our money goes. I've asked them on the phone and in writing 3 times and have never got a response!

Good profit for them though!!! £3750!!!

 

Bluedo...that sounds like the exact same letter!!!

Hey all

 

Ive recieved my final response today from barclays. Basically it says that my account is no longer on hold. It says that barclays have exhausted their complaints procedure and that they find their findings fair and reasonable. If I remain dissatisfied then I go to the FO.

 

There is one thing they must put a lot of thought into their replies cos they have mentioned that computeach has an obligation to fulfil the terms and conditions of of my agreement with "access to trade" Im sure it was Advent I was on a course with. Very strange

If you have signed up with the class action assault on BPF.

You should send that to the legal team....

It just goes to prove BPF are just busking it.

Anyone managed to ascertain what actually counts as Barclayslink3.gif final response?? jus got all my stuff sent back from foslink3.gif sayin gotta wait 8 weeks as none of my latters count as final response although they seem pretty final 'you got computeach blah dee blah' stalling tactics!! cant be overly confident :rolleyes:

 

They do, (eventually), issue a letter that says final response down towards the bottom of the 1st page

I have also had my final response letter. I am also over due paying BPF and i have cancelled my DD. I know some of you have said best to pay and try and claim it back but I don't have the money to pay in the first place as I do not have the better paid job I should have had by now. I'm not worried about my credit rating but someone also said that the FO will side with barclays if we don't pay, does that mean they won't fight my case for me now?
