    • Hi I was caught shoplifting 4 items £20 worth, I’m petrified the Police will come to my house now please can you help. What can I do I worried about my job. 
    • I heard nothing more from J&P but have now had an email from the bank saying they have instructed IDR to act on their behalf?  so are they just passing it back? Selling it on again? I don’t know if this is a good or bad thing 
    • I posted a couple of years ago about our debt situation and have been trying to pay off our debt as best we can. It is a possibility I maybe made redundant in a few months time, so I am trying to find out everything I can about what happens in today’s world when you can’t pay. I keep finding conflicting advice on various sites so I wanted to post this quote to get thoughts. It claims basically that the dca will likely get enforceable documents these days and therefore it’s likely you will have to pay dca at some point during the 6 year process.    on here I read a lot of comments assuming the exact opposite of this. A lot of the threads on here state the beginning of the process but I never see conclusive stuff about what happened from start to finish to get insight into whether debts post 2015 have been enforced etc. I hear a lot here not to pay dca companies but most my debts are post 2015 debts I am all up to date on our debts but if I lose my job it is likely I’ll end up where I tried to avoid in the first place. Which is destroying our files and dealing with DCA. I’ll post it below so you can see what I mean.   It is likely that any debts incurred after 2007 will end up with all the documentation being provided and being enforceable. Therefore you should use the time while awaiting responses going through your Income & Expenditure and considering any possiblity of making a full and final settlement. It can take a number of months to reach the stage of a hearing date and exchange of witness statements and normally you would be able to settle or come to an arrangement to pay before the court hearing, once documents have been provided, although this isn’t guaranteed.
    • depends who said sols state their client is. IDRWW vis~IDR(worldWide) are a debt collector regulated & registered in the UK & USA    they are not solicitors. they use various 'for hire' - here use our letterhead paper tiger solicitors. its just a case of who's stupid enough to join their folly. IDR law used to be their fav but they lost do much money, they broke ties after almost being struck off and now do Will/Probate disputes only. IDR Legal are their sols wing. moriarty law Judge and priestly Taheel - a foreign DCA that use absolutely any trick in the book to extort money even pretending to be any of the above inc being the bank themselves in phone calls.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ah you had my hopes up..

I am out of work so its a non event for me.. but take heart I still get up at the same time I used to do when I was working.. and I have worked all my working life for 35 years before being made redundant thanks to the financial problems caused.. by the Banks!!!

Its no good throwing a letter together that Barclays will ignore or does not spell out what targets are needed.I am consulting with other site team members with the view of putting a prelim letter together which will fit the bill.

The Easter break is almost upon us which gives us a couple of days before Tuesday to get up to speed with anything further we need and also be clear as to who is in need of what-given the different issues people have to deal with.

I too am interested into what CAG can provide, best bet it seems at the moment is to hold tight and to let those who know what there doing just do it. Thanks for all the help and effort people have put in, i for one very much appreciate it!It is good to know not everyone out there just wants to make money and look out for themselves.

There looks to be 2 or 3 different scenarios.

So its either a case of doing different ones to cover specific needs,or else one which will cover all but will need tweaking/editing to fit individual circumstances.

Hi wasabi me again but i'd not rush into anything at the min I've not contacted CT or BPF yet. The CAG team are willing to help us so I'll hang on a bit and I'm sure Martin will post a letter or however he will do this if you want to be involved Martin says click his red triangle

I really can't afford Lawyers as I'm not sure what it all entails maybe a lot of letters.

Hi all, has anyone else recieved their sodding EMail from Computeach?? I really dont want this nw as been messed about too much by them & im going backin the Army, so wnt have the time anyway... Also i notice in my Email they keep expressing the fact that they are there to help me for the rest of my CONTRACT time which iv heard to them that is 2yrs, well i was told by advent i had 5yrs, well if they r sayin 2 then i am screwed as that gives me 10mths to complete the WHOLE MCSE course:?, cos advent only sent me one book in the whole time an just kept fobbing me off, also i notice that Computeach dont do free re-sits, well i bloody paid as much as i did for my course cos advent did unlimited re-sits, also you have to go to classes in dudley before your exams, well again i was told that i could do my exams locally to me in the Southwest.. One last thing the part where Barclays are gonna pay for 3 extra months as a good will gesture, thats Bol#@cks if u ask me, they can stick it, goodwill for me would be if they just kept the money id paid, tear up my contract and let me get on with my life.. sorry for long post

Yeah a couple differen't letters are probably going to be necessary. I for one am not paying by DD as i paid what i owed in full after the first year so's to avoid the obscene interest.

 

Also people are on different courses, computeach may provide for one and not so well for another.

Well i couldnt do exams that soon as i had no IT experience at all, so i contacted thm to explain that i was struggling a little and as a result i just kept being fobbed off and told to keep trying, but when u dnt knw wot ur doing at the time its a bit hard to keep trying... i can now completely take apart and rebuild, and build Rigs from nothing and a hell of a lot more but that is completely my own teaching.. I have also found outthat they should never have enrolled me on the MCSE when i dont have any experience, they told me that i didnt need to know a thing as i would learn it all from the books

Hi – this is my first post on here. I’ve read the entire 102 pages (phew!!) and the information they contain is absolutely brilliant. My thanks to everyone who has contributed.

I signed up for the CDS course in February last year, so my 12 months deferred payments would have started in mid-February this year. I had the account frozen as soon as I received the email from Advent in my junk mail folder.

Much of what follows has probably already been stated by many of you, but I will repeat to help explain where I’m coming from.

If you have an Advent Enrolment Form like mine, you will have a section 10 in the terms and conditions on the back (mine has not been signed by an Advent representative, but gave the start date as 15/2/09 and the end date as 14/2/10 – 12 months: a bit optimistic, I think considering I’m not yet currently employed in the IT industry):

“10 TERMINATION

10.1 The Contract will terminate immediately on notice from us to you:

10.1.1 In the event that we make any voluntary arrangement with our creditors or become subject to an administration order or go into liquidation (except for the purposes of amalgamation or reconstruction and in such manner that the company resulting there from effectively agrees to be bound by or assume the obligations imposed on that other party under this agreement);”

It seems to me that Advent terminated my contract at the end of January this year.

In the last few months, like many of you, I’ve had time to consider my options. I will be continuing my IT studies, but not through a BPF-financed training provider. I’m making my own arrangements.

It seems to me there are three possible options here. So we do have a choice:

First, go along with BPF’s “suggestion” of their sourced alternative training provider;

Second, request a cancellation of the BPF contract and a full refund of any monies already paid; or third, request a cancellation of the BPF contract and offer a settlement figure based on time elapsed since course start (which appears to be about £1200 per year according to some of the posts regarding Computeach’s fees - suggested only because BPF have allianced with Computeach) or amount of course completed (a bit like what Hitachi appears to be offering their customers).

So, what to do?

  • I will not be accepting the offer of Computeach as a training provider.
  • I think that we should all get behind CAG and try for option 2 above, but settle for a variant of option 3 if necessary

If BPF have an issue with options 2 and 3 then they can just take it up with Advent Consulting Limited – oh dear – haven’t they gone bust? What a shame….

Advent appears to have released us all from our contracts at the end of January – so now we have a choice. BPF are trying to deny us that choice. In this day and age this is completely unacceptable. Gone are the days when banks seem to operate from a sense of fair play – now they operate from a sense of greed, hence the lack of transparency in what options we have from them.

No matter what our current circumstances or our future goals, one thing is certain: we must not bend or give in to BPF’s will. WE HAVE A CHOICE AND IT IS OUR GIVEN RIGHT TO EXERCISE THIS CHOICE.

If your contract had already expired at Feb 17th 2010 then you are able to continue your training with Computeach but this will require further financial outlay this was in the email under advent student FAQ's When i signed up with advent the sales rep told me that there was no time scale and the contract ended when we pass the course he made me belive that i had all the time in the world anyone else promised this defo not like for like in my case.

I am now wondering if the linked loan contract a lot of us have with BPF is now no longer enforceable....

 

.....and perhaps BPF know that - hence their "bully boy" tactics.

so what does this mean if the contact is ended.. its with Advent that its ended.. how does it affect our relationship with Barclays?

According to my contract with Advent, the action Advent have taken constitutes a termination of my contract with Advent. I am suggesting that since Advent provided the BPF loan to me (a linked loan) then the termination of the Advent contract may render the BPF loan contract unenforceable due to them both being linked. There have been so many conflicting opinions given to contributors of this thread by different organisations that it is hard to be absolutely sure. Personally, I would be happy for BPF to try to enforce their contract with me through the courts.

 

Of course, BPF do have an alternative - they could take up the issue with Advent :-D ...

i was told by consumer direct that as its a linked loan both advent and barclays are liable... which is why bpf they gave us computeach..... apparently they are now no longer in breach as they found us a provider.

 

i cant see how thats right or fair

Hello all, I have been following this thread since that fateful email dropped into my inbox!

Firstly let me pay tribute to those who have put in so much time and effort to help others try and bring about a satifactory conclusion to this situation.

About me:

I signed up with Advent (July '07) in order to complete MCSE track. I have almost completed the course have received about 90% of the training offered.

I know I have been far luckier than some:

 

  • I signed an open ended contract with Advent
  • I have never had an issue with Advent customer service
  • I took out a loan with Clydesdale (later taken over by Barclays), and paid it off before silly interest kicked in
  • I reckon I am at most £500 out of pocket
  • When I have needed help from "Mentor" at Advent, I always received prompt and effective support.
  • In short I had absolutely no complaints about Advent whatsoever!!!

This got me thinking:

As I have have received the best possible support from Advent, passed all my exams first time (in some cases barely), my expectations of what is "equivalent or better" standards might be higher than others! ;-)

 

I have contacted CT as directed by BPF, one of their consultants is going to contact me, we will discover whether I will receive equivalent or better service!

you must be one of the lucky ones because when i asked for help on something i was not sure of the mentor e-mailed me back and told me to look it up on wikipedia.that was a great help and not only on one occassion but several. i think a few more students on hear have had the same.

i spoke to barlcays they said i was the first customer to complain about advent today , yeah right. if they manage to find another provider we all need to say No, this seems like a good [problem] that advent ran i dont want to sign up to another [problem] and be shafted for £4500.

 

When i was interviewed by the radio station the cant belive that we was just emailed by advent,

 

please your put locations lets see how far advent spred over the uk
