I have 3 payday loan accounts from Ablemalre & Bond with Chantry Collections. I pay £5 per month on each which they debit to my other debit card (not account which has income coming in), thats the minmum tehy say they can accpet & they wont take payment by standing order. I'm on JSA and have missed & had to rearrange the payment dates on several occasions, and am concerne dthey could try to represent the £900 cheques, which would bouncebut woukld incur me a £10 per returned item bank charge (ie £90) or try taking the varied amounts of outsanding debt overnight on my debit card, which a debt collection agency did for my Money Shop account last year. If i phone them & say I cannot pay by debit card now they will ask why.

Any sugesstions please?

If you are on JSA, pay them a max of £1 a month. If they try to take you to court, a judge would tell you to only repay that anyway. Maybe even less.

 

Also, never EVER phone them. Recorded delivery letter or email only.

Hi, I wonder if anyone can give me some advice? I am quite hardered when dealing with Creditors/Debt Collectors/Bailiffs, however I had a very upsetting situation last week.

I had a loan with Speed-E-Loans which I admit I hadn't paid for over a month, I then recieved a call at my owrk asking to speak to me, I said i couldn't talk as I'm at work, and finished the call, but they rang again, and i was blunt and cancelled the call. They then proceeded to keep on calling, and would not stop calling until i answered, they even used my works second line. They told me that unless I spoke to them their automated calling system would keep on calling my work number. I felt under pressure and finally agreed to pay them £60.00, which i could not afford, they even said they could send someone to my work to collect the money that day, which I talked them out of!

 

I need to know what action I can take to stop this happening again.

Send the telephone harassment letter from the site library then fole a formal complaint with thr pdl oft and trading standards.

 

Phoning your work is a big no-no.

OFT has the address on their site. Trading standards, you can either send it to your local one who will forward it, or you can look up the trading standards office nearest to the PDL's offices.

tip - log online onto your speed e loans account and change the work number to a random one!

 

Yes, sent them a letter of complaint, and also letters to Trading Standards & Office of Fair Trading. They are investgating it. Speed-E-Loans didn't reply to my first letter, so I sent another one by Special Delivery. I have not heard from them yet.

 

I am now working with the OFT about Payday Loan Companies as I have had a lot of experiance with most of them.

 

My advice is not to use them, but I also know this is easy to say, especially when you can't borrow from 'normal' places. What really annoys me is that I got a couple of CCJ's and Deafults from when I was made redundant about 5 years ago. I went from earning £400.00 a week to taking home £50.00 a week. I have been working since 2007, and have a good job with a decent salary, but due to my credit history no one will lend to me apart from Provident and these Payday Loan Companies. My bank, LloydsTSB, which I have banked with for nearly 3 years, and run a good account won't even upgrade my account to a 'normal' account, let alone lend to me.

 

I have to borrow at 250%+ APR, which just causes more problems, than if my bank would be so kind as to lend to me at about 20% APR!!!

I took the loans out at the beginning of the year and every month I am just paying the interest (basically throwing money away).

 

I am currently in the process of opening an account with Nationwide so that I can close down my Lloyds TSB account but I am worried what will happen.

 

Every month when I phone to put a deferral on my account I ask about setting up a payment plan and the answer to that is no. They will try and take the full amount out of my account before anything can be set up.

 

I am getting really stressed out with all this and I know that I did take the loans and signed my agreement forms ect but the APR is killing me.

 

Can you please help me????

Hi, I'm sorry to hear about your problem. Ok, first thing first, any cards that you have which any of your payday loan companies have, get them cancelled! Contact you bank and say you have lost your card, you should get a new one fairly quickly!

Secondly, check that no Direct Debits have been added to your account without your knowledge!

 

If you have opened a new account, make sure you get any money paid in to this account. DO NOT GIVE THE DEBIT CARD (if you have one) TO THIS NEW ACCOUNT TO ANYONE!!!

 

Once you have done this, contact your Payday Lenders, get the name of the person you are speaking to, and take rough notes of what they say to you (remember, they record their calls!) and tell them that you are in serious financial difficulty and that the most you can afford is £xxx. they will do their best to get you to raise the amount, or even refuse it, DO NOT BUDGE, DO NOT INCREASE IT! Tell them this is the most you can afford. If they refuse, or say they are going to still try and get money from your account, inform them that you will be phoning the Office of Fair Trading, Trading Standards and the FSA. I would recommend that you do actually do this. Do not accept any threats from them, and if they tell any lies, write it down and report it.

I have applied for an account with Nationwide and they said they will send the info out within 10 days however I get paid on the 28/08/12 so I wont have time to do anything.

 

If I tell Lloyds that my card has been stolen/lost can the loan companies still get money from my account.

I did have a DD set up for Wageday Advance but I did cancel it.

 

The amount of money that I have paid for just the interest would have cleared my loans if it wasnt so high.

 

I dont really know what to do in regards to Trading Standards ect.

Can the loan companies take me to court?

No, make sure you get your card cancelled, and get them to confirm it, and check that no direct debits are set-up! You are protected by the direct debit guarantee anyway. They should not be able to get hold of any money then.

Yes, they could take you to court, but in most cases they don't! I'm not sure what your financial situation is, but all they really want is their money back, which is fair enough. I would therefore offer them an amount, lets say you borrowed £200.00, off them £300.00 and you'll repay it over x amount of time. If they refuse, which they will, then tell them you won't pay anything! You have to be tough with them, and show you won't take any s**t!

My partner is now out of work and my wage has to do the both of us until he gets a job. I owe roughly £400 to each company.

Interest for WDA is just over the £100 mark and the interest for PDUK is £81.00. Thats £200 roughly thrown away. :(

I am not refusing to pay the money back, I just wish they would be more helpful in difficult circumstances.

I will cancel my card tomorrow and get written confirmation from Lloyds as they really are not reliable.

This is my problem, I'm not the up front kind of person but I will do my best to be strong towards them.

Actually, they very VERY rarely record the calls. They dont want any traceable evidence of what they have said.

 

The best thing to do is send the telephone harassment letter from the CAG library, and only ever deal with them in writing. Doing what you advised is good in theory but simply will not work in practice.

Aup - I know excatly how you feel.Back in May 2011 I had got myself into a right old state - owing substantial money to 6 payday loan companies (completely ludicrous - but when you continue burying your head in the sand like I did, and have several other personal and family issues to deal with at the same time the situation snowballs).Anyway..............................I decided to thoroughly sort myself out.I contacted each payday loan creditor in writing via recorded mail stating that I was experiencing financial difficulty and I wished to put forward a repayment plan offer in order to pay of my outstanding loan/s at a realistcally afforable rate over a six/twelve month period.Subsequently each payday lender agreed to my proposal. Some agreed straight away, others made it very difficult but reluctatntly agreed as I was bloody persistant. It is important to repeatedly stress to them your level of financial hardship and that you fully intend to repay what you owe - if you do this whilst putting forward a realistic repayment plan, the lender will find it very hard to resist.Wage Day Advance happened to be one of my creditors and dragged their feet in terms of agreeing to a plan. However after provided them with a full and accurate income and expenditure sheet (something which you are not legally oblidged to do - but if you really are struggling, what have you got to lose by doing it?) they eventually agreed to a repayment plan over the six month period for my loan which totalled £287.50.Make sure that you stress that any payment schedule is paid via standing order!!! I'm sure that it has been mentioned numerous times on other threads but DO NOT agree to continue paying a payday lender on your debit card via a continous payment authority. In all likelihood they will then chose to ignore your payment schedule and simply empty your account for the entire balance (I actually changed my bank account entirely in order to 'ring-fence' my salary following an unsavoury incident described below).Uncle Buck did this to me after we had 'mutually agreed' a repayment plan in writing, they then went on to disregard this plan and took the full balance out of my account (£325.00), which at the time left me penniless for over half a month. 15 months later and following several complaints and an OFT review into payday lending practices, I received an offer of recompense from Uncle Buck and a small paragraph in a three page letter in which they acknowledged wrongdoing - however if you can avoid this situation from coming to pass then do so - pay via standing order from a new bank account!!!To summarise:Do not panic.Contact each lender with a repayment offer. Be honest and realistic with what you can afford. Be persistant - they will attempt to bully you (especially over the telephone).Stay focused and keep to any agreed plan.Good luck!!

Hi ya Grizza what does CCA stand for. Plus do u know how I can stop these people calling me or texting OFFERING me further loans...........Have tried time and time again to be taken off data lists.....any ideas you can throw my way

Sending a CCA request effectively puts the account into dispute, during which time the creditor may not take any further collection action. Without a valid agreement, the debt is unenforcable without a court order.

 

However, it is important to reaslise that lack of response to a CCA request may render a debt unenforcable, it does not cease to exist. This process can not, and should not, be used to evade debts.

 

When to send a CCA request

 

 

You should send a CCA request when you require more information about your account, or when you genuinely dispute a creditor’s right to collect an alleged debt. The process should not be used for the purpose of debt avoidance.

 

Please be aware that there are certain types of debt which will not be covered by the advice here, such as utility bills, bank overdrafts, CCJs and court fines.

Feel i really need to add to this forum as I to got caught in the Pay day loan cycle!! I had loans with Swift sterling, Wonga and PDUK. I had read many nightmare stories about companies taking money out whenever and nuisance phonecalls so here`s my experience. Last May after months of rolling over my loans and therefore incurring loads of interest i decided I could no longer continue with the endless worry so i Phoned my bank and reported my card as lost. This stopped any payments going out straight way! Then i contacted Step to change ( formerly CCCS) and set up a payment plan with them. I had a couple of emails/phone calls from the companies but once I explained I had gone with STC they were ALL fine and just asked for my STC ref no: Since then I have had no problems what so ever. The interest has been frozen and STC deal with all correspondence with these companies. I pay them a monthly amount ( which has about a year to run) and it has taken all the stress away. I just wish I had done it months earlier. So PLEASE anyone in this situation contact Step to Change or any other debt charity and get your life back. Really hope this helps people:))

Hi ali. Can i ask if Stepchange contested any unlawful charges/fee's on the loans? PDL's are very well known for adding them on. All a DMP would do is get them to stop interest etc and form an arrangement to pay. Very rarely would they contest the fee's, unless the lender was on a list of Known "issues".

Hi. The arrangement I have includes the interest I had incurred on the loans.I had not defaulted before this and the only company who added a default fee on were Swift sterling. TBH I was just glad that the interest had stopped mounting up and instead of me constantly rolling over my loans I am finally reducing them and eventually getting them paid off. It has been a very hard lesson for me to learn, but i will never go near a PD loan again. Just glad to have the stress taken away:)
