    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?
    • The neighbour's house is built right on the boundary so the side of their house is effectively the 'wall' in our garden separating the two properties. It's a three storey house and so the mortar poses a potential danger to us. Because of the danger, we have put up an interior fence in our garden to ensure we don't risk mortar dropping on us. That reduces the garden by 25% which is not only an inconvenience, but it's the part of the garden where we had lined up contractors to install a patio and gazebo which we will use for our wedding reception in less than 2 months. We have spoken to the neighbour's caretaker who is on the case, has spoken with a roofer and possibly a scaffolding company, but there are several issues. They don't seem to understand the urgency. As long as there is a risk of falling mortar, we can't carry out any work in the garden, and unless they hurry up, we're looking at cancelling our wedding as it's not viable to book a venue because we can't use our own garden! Also, they want to put the scaffolding up in our garden which would be ok with us if it was a matter of a few days and they hurried up, but there is a tree (most likely protected by the conservation area), so most likely they can only reach part of the roof with the scaffolding if they put it up in our garden. We suggested a roofer with a cherry picker but they seem to want to use a company they've used before. Any and all comments, suggestions, advice is more than welcome.  PS. does it make any difference that the neighbour is a business (ltd) and not a private dwelling?

    • Apologies all for the late reply and info, i have been away with the Army. They have paid I accepted the offer on the 5th of May, and they paid on the 17th of May.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi has anyone got a conclusive answer on the speeding ticket from Spain question.I too received one on the 18th of November from a holiday I had in Menorca in August.Once again the speed quoted was 70km in a 50km limit.However the photo is inconclusive as to whether the car was moving or not , but the rear of the speeding notice looks like a bad photocopy of a legal notice.However the date and time shown for the offence on the front of the notice could easily be right.

The website seems genuine but can only be used by Spanish nationals or residents of Spain - so it seems to me that if the speeding notice were real there would be an option for non residents of Spain to pay.

Any conclusive info would be helpful as I'm going back to Menorca next year. Thanks

I live in Spain for at least 6 month each year so I'm reasaonably familair with events there. Spanish authorities take a different view to speeding drivers compared to the UK. Generally speed cameras are very few and far between in Spain and you will definately be forewarned when in operation. From memory only the larger cities have a few cameras installed on motorways, not the Islands.

 

My immediate view is that it's probably another [problem] by East Europeans who love target the Brits and French. Secondly, it definately can't be enforceable as the Spanish authorities have no juristiction here in the UK.

 

My considered opinion is to bin the ticket.

I had a ticket (I'm a previous poster at the start of the thread), so I contacted my friends who live on the island of Mallorca.

 

They paid the ticket for me, using their individual Spanish ID number, and I sent them the money via wire transfer.

 

As they are residents on the island, I'm sure they would've said if it was a hoax.

We should know all about parking/speeding scams as this forum is full of PPCs, fraudulent Councils by the 100's and a Government that has a clash with reality when they get caught stealing money from thier expenses.

Most people in the UK don't know about the PPC [problem], so why do you think someone living in Mallorca would know about a [problem] being perportrated against UK residents?

just clicked the link to the DGT site, i dont know spanish but managed to dig through to the 'contact us' page and funnily enough you cant! gives some rubbish about no one being available... no email address, no phone number nothing.

Hi guys,

 

It has now been 6 months since my holiday to Menorca, and I have received a second 'speeding ticket'. Again it came recorded delivery and looks very similar to the first one. However, this time, it had an official looking pink slip of paper stuck to the back of the envelope and a much larger copy of the photograph of the hire car printed on the back of the letter. It doesn't seem to have a postmark though, which I'm not sure whether it should have, being a foreign letter?

 

Again, it states that I was doing 70.2km/h in a 50km/h zone and they want either 70 or 100 Euros, I'm not sure which (as I don't speak flipping Spanish!).

 

Interestingly, the photograph doesn't seem to show anyone inside the car, although I have to admit it is a poor copy. As there were 4 of us at all times, I find it difficult to believe that not one head can be seen through the back window, which leads me to wonder whether it is a picture of the car parked up, cleverly pasted into the Spanish background scene! Also, there is only one photograph and no markings on the road, so how do they confirm that the vehicle was exceeding the speed limit using the old 'speed = distance / time'? Or is it a different method of calculation over there?

 

I'm still not convinced whether it's genuine or not. But seeing as though they can't be bothered to write to me in English, I cannot possibly be subjected to a fair trial as I cannot appeal to their courts, and they have not provided a simple method of payment; I am certainly not going to pay up.

 

My only real concern is that I visit Menorca every year and if it is genuine, I really do not want to get arrested or given an inflated on-the-spot fine when I land next time. Thinking about it though, how would they know upon presenting my passport at passport control; that I am the person from the hire car last year? Sure they have my address, but that's not printed on my passport...

 

I have tried my utmost to ascertain whether the thing is genuine, conducting research on the net, posting on here, contacting the hire car company (who had no idea about it) and even the AA (who didn't bother to reply) but no-one can say for definite.

 

If anyone could shed any light as to whether these Spanish fine thingys hold a power of arrest for non-payment, I would be grateful to find out.

Ok, with the help of a scanner, some free character recognition software and a language translator (nice one Google), I have sort of managed to translate the bulk of the document. I have no idea what half of it means, but it doesn't seem to say what the sanctions are if you fail to pay. There is certainly no mention of arrest! Likewise, Google allows you to translate the www.dgt.es website, but again, there is nothing that I can find on there which says what happens if you don't pay. So I'm lost!

I cannot possibly be subjected to a fair trial as I cannot appeal to their courts,

 

Under Eurozone Law you can be taken to court in a member state / country and have damages awarded against you. The proceedings either in writing or verbal will be in the language of that country so if you are not fluent there is little chance to defend yourself thanks to our beloved government signing most of our rights away

 

Fortunately to proceed with a claim against you as a UK national who is resident in the UK it would then have to be transferred to the UK legal system and at that point you would then be given the opportunity to deny / defend it and present any supporting evidence.

 

A problem could however arise if you owned property in the country in question assuming of course that this is not a [problem].

 

I have had this happen via my business so it it is fact.

 

Having been flashed in France on several occasions with no follow up here in the UK I have to wonder if this is not an elaborate [problem].

It most certainly IS a [problem].

The reason the car looks like its been copy/pasted, is that is has been copy/pasted, and the reason you cant see anyone in the car on the photo is that you were not driving the car in the photo!

Have a look at 'The Real Hustle' Season 4 episode 12.

 

Have you tried contacting the Spanish Embassy about this, or even the company you originally hired the car from?

I received my 2nd copy of the ticket on Saturday , my postman says he has delivered quite a few over the last couple of years and he has to scan in the signature on the flysheet as proof of receipt.The ticket itself shows a much bigger picture of the car on the road , on a stretch of road I remember well , with the time and date of the offence given being the time when we would be travelling that stretch of road.When you go to the website to pay there are now a number of new options to choose from rather than Spanish national or resident. The list now includes passport suggesting non residents of Spain can use it!

On other websites I've viewed a number of people have given their tickets to friends living in Spain who have paid the fines at the local post office on their behalf - so still confused as to whether it is real or [problem].The only reason I am still concerned about it is that I go to Menorca each year and if the ticket is genuine then my passport details would have been provided by the car hire company and if (big if!!) passport control scan in the passport on arrival I could be hit with an even bigger on the spot fine etc.

Ive Googled it after watching the Tv programme, and its well know. Even if they had your passport, how do they know who was driving???

 

If friends in Spain pay these fines for people theres no wonder they keep sending them out!!!

Please yourself if you want to pay it, but personally, I wouldnt be worried.

 

Contact the Spanish embassy and see what they say......

If one might have been speeding and might have been caught would it be detrimental to one's case to contact the Spanish embassy in London to find out if the ticket is legit? If it's a [problem] and enough people pester the embassy maybe the embassy staff will get fed up enough to have a word with their colleges back home

OK, I mentioned earlier that I belive this is a [problem].

To your posting of yesterday at 22.39, from your translation three things do not stack up, first the Automated complaints address of Leon which is in Northern Spain and nowhere near the Balerics, second, the telephone number stated is a Madrid number and not a Leon or Minorca number and thirdly, local provinces collect their own fines, they are not handled centrally.

The more I read your posting the more I'm convinced it's another con.

With regards being worried about your next visit, the authorities are far too busy monitoring foreign visitors for for terrorism at the moment, I'm very sure parking fines will be way down on their list of priorities.

Honestly, just throw it away.
