I COULDN’T SEE A WAY FORWARD I FELT STREESSED AND UNDER PRESSURE SO WROTE THAT I WOULD NOT BE CORRESPONDING WITH THEM ANYMORE.    What was the date of your last payment? NOVEMBER / DECEMBER 2018   Was there a dispute with the original creditor that remains unresolved? NO   Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? I COMMUNICATED MY FINANCIAL PROBLEMS WITH THE CREDIT CARD COMPANY, WE MADE A MONTHLY PAYMENT AGREEMENT WHICH WAS KEPT FOR SEVERAL YEARS UNTIL DEBT WAS SOLD.

    • Thank you JK2054 and BankFodder for your replies. The information requested is as follows:   My wife and I are sole traders supplying bespoke, handmade wedding trays and other items through our website. We do not sell on ebay. We had an order for two trays (invoice value £370) that were shipped on Monday 25th March. We used P2G as the broker and Evri as the shipper. We declared the value but did not take out insurance. As the trays were a present for a wedding on Saturday 30th March we checked the progress of delivery on the Thursday to see that there had been an attempt to deliver on the 27th but the driver failed to deliver as the customer’s gate was shut (customer informs us that the gates are open between 7am-7pm. We contacted the customer who informed us she had been waiting in all week and there had been no attempt of a delivery. Evri allege they attempted to deliver on the 28th & 29th. On the P2G web site on the 4th April at 14.17 it stated that the customer refused delivery. At 14.28 it updated to say there was a problem with the address and at 14.32 updated to say the customer had refused delivery. At 14.35 updated again to say it was being returned. Last entry was on the 7th April that it was being processed at the depot. We never received it. I have had six web chats with P2G between the 4th-30th April. On the 26th April, I had an offer of £20 plus cost of delivery (£6.72) from P2G which I rejected. During this time, I also contacted Evri that resulted in an email from Evri Customer Services (20th April) stating that they had lost the parcel. I replied requesting details of the attempted delivery but received no reply. After emailing Evri again on the 23rd asking again for the information I received a phone call from someone called Haleemah on the 25th who apologised and promised to send an email with a link to submit a claim form. I subsequently received an email with the link which only took me to a page that stated “Page not found”. After informing Evri customer services of the problem (to which no reply was forthcoming) a couple of days later I retried the link but it only took me to the Evri website. I believe that I have a good case against both companies but would appreciate guidance on which path to go down. I have read most of the information on this site, which has been very helpful and much appreciated, particularly the various court transcripts. I appreciate that this process is a marathon and not a sprint and am fully aware that I need to get everything in the correct order before starting on the legal road. I am sure this covers the current position but if further info is needed please let me know.  
    • Everything at small claims revolves around informality and common sense, there are no "special" ways to have to do things. The site manager's WS will be like yours and the one I linked to - just much shorter.  There need to be the introductory hearings about the case, the parties, etc., and the concluding Statement of Truth. In the middle just a couple of paragraphs where they say who they are, how they know you, and about permission being given by the landowner to use the car park. Superb.  I've added another section about the signage to the suggested WS sections three posts above. Yes, it's perfectly possible.  It'd be a good idea to phone the court on the 18th to see if they have paid.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No, they're not taking posts down. It's that J2's page (which doesn't have that many comments) seems to have a bigger ratio of company employees leaving comments than most.

 

I notice RMA seems particularly sensitive to criticism also. Always the sign of a desperate company when it cannot tolerate any kind of dissenting opinion.

Looks like they let the crazies at MacKenzie Hall out over today again at the MH whocallsme boards.

 

Shame they're not as persistent at trying to create a halfway lawful company. You'd think they'd have enough problems at the minute.

Now, on the 10 Downing Street petition thread currently running, which DCAs have a reputation for running credit searches or issuing their own defaults?

 

I ask as I'm going to be advertising that petition on the whocallsme entries for these agencies.

 

I expect that a good number of people who use whocallsme as a reference point have also had wrongful adverse information logged against them.

 

If nothing else, it'll get a few more signatures on the petition.

 

Lowell's whocallsme thread has details of that petition on now.

Indeed. I wouldn't like to guess how many numbers are on mine.

 

Furthermore, I still say a comprehensive list of phone numbers - every known DCA and bailiff company number - should be published on this site.

 

I think it's an excellent idea for two reasons :-

 

1) We can leave comments on what these companies are like on whocallsme, and other companies.

 

2) Any CAG member with a Truecall system can zap and/or record every single case where such a company tries to contact them.

 

Think about it - if you want to really hit them in their pockets, this is an excellent - and entirely legal - way of doing it.

This is an excellent idea. It's surprising how many people are posting on there who don't realise help is at hand!:)

I agree FredB. Also it would be a good idea to get the numbers posted as a sticky and updated with any new ones. Also any sites like "who calls me" listed too, so we can all take turns in updating them with any new numbers. Also with sites like "who calls me" not many people go down more than a couple of pages, so we need to post cag address on each every 2 weeks so it stays at the top.

 

My other plan is to ask your employer if you can put up a poster for CAG at work. Mine has agreed, as they know peeps who are worried sick with debt probs aren't going to be delivering 100% in their jobs. I've also put forward proposals for a in house version of CAB. Where employees with problems can get proper help. Most large companies realise these days that employees with debt probs cost them money, so to spend a bit in the short term, helps the company in the long term by proving they care about the people who work there. What is best, losing a good worker because they're stressed and getting DCA hassle, or employ someone unknown and new and has to have money spent training them?

 

A small start, but if you don't try, you don't get. That is where us Brits have gone wrong. "It's crap, moan about it in the pub, and hope it will get better." Get together and united we can make a difference.

I've seen quite a few threads on here where people have been searching online when they've had DCA calls and ended up on CAG via who calls me. Usually when you search for a DCA by name a CAG thread pops up before the DCA's own website.

Obviously, this 'antagonise the collection agency staff' technique is clearly working. Someone doesn't like the CAG templates idea.

 

Sadly, with the last two, it seems that it's the same person - albeit a very touchy, bordering-on-schizophrenia one at that, who keeps veering between support for CAG and then slating it afterwards.

 

I appear to be annoying him/her/it somewhat by pasting links into CAG. So, I'm duty-bound to do some more.

 

I've said it before on boards - the self-importance and over-inflated sense of self-worth of collection agency staff never ceases to amaze me.

 

Most workers wouldn't be bothered either way if they overheard the company they work for being slagged off - ah, but not DCA staff!

I've been trying to persuade the person to take his issues to this site if he's a user as he claims, and up to this point, that's not happened.

I suspect that's because most workers actually do a useful and worthwhile job, and as a result feel that they are valued members of society. Whereas DCAs know, deep down inside, that what they do is utterly immoral, and they have very little self-respect. I think their strident defence of the indefensible is their desperate attempt at trying to gain a little self worth :rolleyes:

After searching out a fair few DCA groups on facebook, (I posted a load of them on the cheekiness thread about 3 weeks ago) most of their employees slag them off as much as we do on here, but for different reasons. I have a feeling the "who calls me" peeps are the ones higher up on better wages with more to lose when their company goes tits up due to being no longer profitable.

In regard to the facebook thing, I wonder if 1st Credit ever took action over that employee's profile page.

 

I'd be surprised if they didn't, because such companies - not just the staff - seem to take a hyper-sensitively dim view of anyone who gives them negative criticism.

The postings by someone using the name *** ******* were soon removed. I suppose references to the Consumer Credit Act didnt go down too well with the threat monkeys. Still Im sure he will return;)

I love it, it rattles them to the core,8-) its great what you are doing others should also help, getting people here and informed is what upsets DCA the most.

 

They ply there evil little trade on ignorance and when this is dispelled they are cream crackered.

 

Having said that folk find CAG just by simply googling in some cases a CAG posts features above the DCA website which always amuses me.

 

Well done.

 

When everyone who is in debt knows the score things will definately change lets work towards informing folk by what ever means possible

I don't think they care or want to know how stupid they keep making themselves look.

 

It's almost insulting that this is the level of intelligence shown by the 'credit' industry (as if there's anything to 'credit'!) and that this is what we're up against.
