    • It’s all unsecured loans and credit cards. Mainly loans now though as most credit cards are paid off.   so 95% unsecured loans.   I just don’t know my situation job wise it’s almost impossible to say whether it’s likely or not just don’t want to be caught out by it. My mental health trying to pay this off has taken a huge hit also if I’m being honest. I feel like mentally I need some kind of respite and the credit file cost is something I can accept also. 
    • Depends on whether part of the roof needs to be replaced and whether it is a standard roof type,  but the works should only take a day or two. Someone I know had a whole semi-detached roof replaced in about 12 hours. Suggest you put it in writing to the business about the issues you mention in your post.  Also as business premises, you could also apply pressure by contacting local Council if necessary. 
    • Thank goodness it's not your roof and you get to foot the bill! How big are these bits of mortar? How often are they falling into your garden? Hourly, daily? Just go ahead with your plans, of course, they're not going to be worried by your time pressures and the urgency of the situation, so simply carry on as you would have done and I'm sure everything will go fine. Unless there is a danger to life and serious structural issues which mean you cannot venture into your garden, then IMHO there is little more you can do less for what you have done so already and made them aware of the issue.
    • Hi all!   Thank you in advance for any help you can give me!!    I parked up (at 18:08) in a rush, entered my Reg and paid for an hour of parking. At 18:20 I got a ticket for not paying for parking.    I've just looked at my receipt and noticed why ... I put "22" instead of "21"  when i put in my Reg. yes... what a stupid mistake.    I seem to remember there being a court case or a rule change about entering the wrong reg but the company wasn't at a loss because i had paid for the parking just technically for the wrong car. Am i making that up?    Any advice would be gratefully received, even some key points i have to hit when doing the appeal      
    • You haven't returned to the thread to give us your views, but a couple of other things strike me which you should consider: 1. You say that at no time was your father's licence revoked by the DVLA. It didn't have to be revoked. It expired in September and his "entitlement to drive" (of which the licence provides proof) expired along with it. He could only continue driving whilst his application was being processed by virtue of s88, and it seems clear to me (based on what you have said) that he was not able to take advantage of the benefits provided by that section. 2. The letter he received threatening to revoke his licence was probably a template letter sent when any medical issues are brought to the attention of the DVLA. But it is clear that beyond September until it was eventually renewed, your father had no valid licence to be revoked. I believe a "not guilty" plea in court will fail. The basic facts are that your father's licence expired in September, it was not renewed until February because the DVLA were looking into his medical declaration and he could not take advantage of s88. So in December he had no licence and no entitlement to drive under s88. The facts that he believed he was fit to drive and that his licence was eventually renewed may mitigate the offence but they do not provide a defence. I also asked whether he had received a summons (very unusual these days) or whether he had received a "Single Justice Procedure Notice". The way to proceed from here differs slightly depending on what he has received so if you let me know, I'll advise further.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi legal,

 

Both letters have been sent Special delivery, The post office now won't guarantee them getting there on Monday but they will do there best.

 

I have spell checked everything and a colleuge at work took a look and advised on some grammer. So hopefully now we have a perfect letter.

Firstly, when you change letters, please let us know how you've changed them so that we can comment. Sometimes by changing the grammar the meaning is changed. And I'm only human so if the changing of the grammar is correct, then let me learn as well.

 

Secondly, please try and spell write when you post up here. It's one of the things that really get's me frustrated.

 

Thirdly, excellent. Check with the link I gave you on Monday afternoon and let us know when it's confirmed by Royal Snail that it's there!

I'm going to prepare for the Sabbath. It come in at 5:40pm today and goes out tomorrow evening at 6:43pm, so I'm unavailable now till tomorrow night.

If you want to prepare over the weekend, seeing as you've got one spare copy of all the documents printed already, you can print another 3 in preparation for the court claim [as you're suing 2 defendants, you need 4 copies of everything - 1 the court keeps, 1 is stamped & given to you & 1 for each of the defendants]. Also print 4 copies of each of the letters - on your letterhead - but don't print the quotes yet, and no need to print the Argos stuff, as you'll have a receipt from Argos - copy that 4 times.

 

I'll be back Saturday night or Sunday to tell you what needs doing next.

Once you've copied everything, the next thing for you to do is this.

 

You should start drafting the Particulars of Claim ("PoC"). Do not put in any of the reference details, or mention MBNA. Just - using the letter I drafted - in numbered points describe what happened.

 

Do not describe why you think they're liable, or suchlike, only state what happened.

 

Don't just copy and paste from my LBA to Virgin, lay it out correctly, in the right order, in short numbered points, each one not more than 5 lines at most, but preferably not more than 3 lines.

 

Don't take the initiative to type up any legal jargon, let me do that. All I'm asking you to do is draft the bulk of the PoC that relates to what happened. Let me deal with the MBNA bit and legal jargon.

im going to post what i have done so far, Please tell me if im doing it correct and its whats needed. For Bahamas can i list each problem individually or do you just want a short line indidicating all the problems.

Im doing it in word, its not displayed properly here bu when its finished i will attach the word document.

 

1. Before we left England I received 2 letters from Virgin Weddings and both times they had addressed them to “Donna & Derek”. I called Virgin and informed them that my husband to be name was in fact Darren, not Derek. Upon arriving in Orlando there was 2 more letters from yourselves addressed to Donna & Derek.

 

2. We received our flight tickets 7 days before departure, the tickets clearly display a price of £444.60. We were charged £530 each, I consulted Virgin regarding this prior to travelling and I was told the price we paid was correct.

 

3. Upon arriving in Orlando airport and collecting our luggage, we noticed in the suitcase that contained my wedding dress a hole and a crack. This made me very upset, distraught and annoyed because this case was clearly marked with a fragile label.

 

4. On the 2nd morning of our stay at Disney Coronado Springs resort their was major renovation works in the room 3 doors from ours. Outside our room on the landing there were lots of tools including drills, planers, saws and various other electrical equipment. There was also an electrical lead running along the floor which we had to walk over.

 

5. Upon arriving in Orlando airport to check in for our flight to The Bahamas. The flight tickets issued from Virgin Holidays contained the incorrect airline company and flight number. The Airport staff told us we were on a code share and were flying with Bahamas Air.

 

6. When we boarded the Aircraft for our flight to The Bahamas, we noticed some loose wires to the left of out feet. The aircraft was 27 years old and the cabin was very dirty, the aircraft also seemed to be going from left to right.

 

7. We checked into our hotel in The Bahamas and immediately found numerous problems.

Detail the problems in their own numbers.

 

Start from when you bought the tickets and how you paid for them & how much, and what they were for.

Either way we gave them 21 days [which starts today, because they should receive the letters today]. I deliberately asked you to do it early, so that I am not pressured the day before you issue.

Hi,

 

I can confirm Virgin recieved there letter on the 24/10, 2 days before they were suppose to. Which is Great !!

 

I have also had a reply to do the previous letter i sent. This time there is another mistake with the final offer.

 

£319.85 + £85.85 = £491.55

 

My calculation is= £405.70

 

The more the better, But i will not be accepting this offer.

I can never guarantee success but I disagree with their decision, and therefore recommend you sue. I think £1k is nothing compared with how much you should get. At the end of the day you spent more than £5,500 with them, and they offer you a measly £800 for botching up everything?! To me that's unreasonable and unfair!

 

It's called the odds game. How many people out of all the people who write a letter are actually going to sue? Of those how many will keep going?

 

In response to your question "will they try and slate me" I've never heard that terminology. It's impossible to know what they will do and how they will behave. My guess is that they'd offer a bit more when you issue, you refuse, they defend, you respond, they offer a bit more and MAYBE a month before the hearing they settle at more like 70%.

 

I have a policy of NEVER sinking below 70% + court fees when I issue, unless I am doing it to see what happens (which I wouldn't recommend for anybody, especially somebody who isn't knowledgeable in court procedure).

 

Don't worry. I think you've got a good case. But as I said, as a disclaimer, nobody can guarantee anything.

 

You can't issue till either both MBNA & Virgin Holidays have responded or the 3 weeks have gone by. So we wait.

 

I'll go through your draft PoC one of these days, but I'm mad busy at the moment. I'm in the middle of pickling as I write this.
