Well I guess my positive spin on events will have to be consigned to landfill and I am just going to have to go with the general consensus  landslide of opinion and pay it then. Fiddlesticks. Another little piece of soul given to an organisation I find anathema to me - that’s what hurts the most [starts sobbing].     • Hello, welcome to CAG. It would be a good idea for you to read other shoplifting threads here to get an idea of how this works. The police won't get involved now, so no chance of arrest. You need to avoid that branch of John Lewis for a while though. Basically, John Lewis's security people will give your details to either a firm like Retail Loss prevention or DWF solicitors who will then write to you with scary-sounding letters to frighten you into paying them some kind of penalty. They have no legal power and can't take you to court, only John Lewis can. Last time we saw a retailer in court against shoplifters, it went very badly for them and we haven't seen a case like that since - over 10 years ago. But you need to figure out why you did this. If you need support, talk to your GP and aske them. They will have heard it all before and won't judge you. Best, HB

There is a lot of information about suing as an entitled third-party. Take a couple of days – and by Monday you will be much more confident. More in control and you will have fewer questions to ask but the questions that you do think up will probably be more relevant and more interesting to your case. Do the reading. This is always an essential first step   Additionally please can you give us more details. What was the item, was it correctly declared, was the value correctly declared, what was the value that was declared? Very importantly what date did you send it?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

the monster family next door who's washer drier came on at about 5.40 am and the noise reverberates through the wall strait into my bedroom....................I think they have removed part of the jack 'party wall' to get it to slide back...need to send them a warning letter and I agree with mould ....there's plenty of the B's about and I happen to live next door to a family of them

Had seizure this morning and another smaller one later on. Son came home from college to me saying someone had chopped off my legs, where that came from I have no clue apart from my leg muscles feel as if ran a marathon right now. At least did not bite my tongue and apart from small headache are okay sat in bed on my computer.

 

Feel shook like a rag doll. Probably got of lightly today.

Message to Youtube. I suggest you could put all resources into ensuring the removal of vile uploads asap to ensure you stop this incessent need for people with twisted egos to upload crimes. I was equally abhorred by a newspaper who felt the need to print the upload. I just read the headline quickly turned the page just as quick. I didn't read the article as I was so upset, so if i'm wrong that it was Youtube please correct me.

 

My reason for not reading the article is my personal stand against the culprit who wishes to push his control onto people.

Spooked. Son comes home and goes on how we need an extra fire alarm for front room due to next door being over loaded with lights on the window near their nets etc.... I tell him dont be silly, then mins later wooh wooh fire engine turns up, but for house across road, poor families xmas tree caught fire.

 

Think I will get the alarm OTT or not and put it above the tree :wink:

 

Sofa being damped down etc....

 

Lets hope they are all okay xx

This article on Paydayloans in Credit Today, put a comment on that the FOS isn't the body to complain to, and that the OFT possibly has at least a thousand complaints on these firms - comment waiting approval by a moderator - wonder why?

The local young thugs, less than aged ten it looks like.

1. Just smashed a bottle in the middle of the road for fun and ran off, I suspect punctures there !!

2. I want to play with a ball mummy, fair acceptable, but no I prefer and iron barr, I have now just past toddler stage after all:-( !!!!

3. Dont worry if the iron barr is taken off us we can always go back to throwing stones at houses.

 

Nice eh?

 

Hope santa puts them on the naughty list:wink:

we have simular class A a-holes up here and just befor xmas 2 years ago there were over 18 yobs outside my home aged between 12 and 17 'so the cops told me later' I went out after them due to one tried to pee through my letter box...I warned them as they ran up the road that there will be stasistics....it will be or them ....they came back later and threw some empty lager bottle at my home and classic car in the drive and when I called the cops and told them...the cops threatened to arrest ME for the warning i'd issued to the yobs....................DO YOUR F.......job then grrrrrrrrrrrrrr

Dad got a phone call from RSPCA earlier - asking him to donate more money to them. Cheeky so and so's!

 

If I was getting the call after reading that story about poor horse 'hope' in the daily mail two days ago that thankfully was saved by a carring vet, with the rspca well useless, then I would say, well let me see, I now am cancelling my entire donation, bye

 

They are money grabbers and there are many decent smaller charities out there who really care and well actually help animals.

 

RSPCA are alienating themselves.........

Someone from work had this too. He was annoyed as doing what he can already and thought this was a cheek.

It seems I'm going to have to embrace the 'evil' that is android...Phone not able to get boosted signal here and Orange have finally accepted that. They needed to ask their's and T - mobile's engineers...So, in light of this, my contract is being terminated tomorrow as long as I enter in to a new one with a compatible phone. The favourites in the running are 'wildfire' and 'desire'. Any comments before I sell my soul to Orange? 'Tis not that I'm a technophobe but that I really hate getting hammered if I don't actually need something.
