    • Today as the registered keeper of the vehicle photographed, I received a Parking Charge Notice, for a private land car park. I have looked at streetview and I dont think the signs are noticable, they were not placed on entry to the parking area, but on lamposts around the plot. It's not ANPR monitored but must've had someone on foot as they had photo of the vehicle parked in a bay. Is this one worth contesting or will it have to be paid?   1 Date of the infringement 28/5/24   2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 4/6/24   [scan up BOTH SIDES as ONE PDF- follow the upload guide] please LEAVE IN LOCATION AND ALL DATES/TIMES/£'s   3 Date received 10/6/24   4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] Yes   5 Is there any photographic evidence of the event? Yes   6 Have you appealed? [Y/N?] post up your appeal] No   Have you had a response? [Y/N?] post it up N/A   7 Who is the parking company? Parking&Property Management LTD   8. Where exactly [carpark name and town] 34-39 Magnolia House & 1-83 Cedar House Spelthorne Grove, Sunbury - on - Thames, Middlesex, TW16 7.   For either option, does it say which appeals body they operate under. It doesnt seem to. It states they operate in accordance with the International Parking Community's Code of Practice (IPC). On the back it says "Contesting this parking Charge" and under this heading it states that "all letters contesting a parking charge are carefully considered and replied to within 28 days. Charges are put on hold until an appeals decision has been reached. If we reject the appeal, you will be provided with the contact details of the Independent Appeals Service."   There are two official bodies, the BPA and the IAS.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thank you all for posting the recent messages because the reason I don't generally subscribe to new threads, or even reply to others, is because I'm fed up with people being asses! :mad2:

 

My mail box keeps clogging up with simple things that are easily found here, and even one or two posts previously. I admit I was a little overawed, but pointed in the right direction with encouragement and a good kick up the ass. I realised that most of it's all here with a helping hand and a shove in the right direction :)

 

I have a life, granted, not the best, but I do other things and help as many people as I can within the remit I state in my signature.

 

Now I feel like Scrooge :(

I'm certain that the lack of activity here, all over the forums, is because people have other worries and the 'die hard' amongst us sometimes get put off. This is a problem that the site admin. can address surely? I for one would gladly help with threads regarding certain issues. Perhaps the admin./site team may consider such a 'referral' approach. This might be a quicker way to help users because the site team could have a list of people who have had dealings with certain company s. An approach with no worries and for the member to say yes or no whether they can help/support at the start of an issue...

I do think that there are people who don't want to or can't spend the time researching for themselves. It is meant to be a self-help site after all.

 

Sometimes all people need is pointing to a few threads that will give them many answers they need, without others having to spend the time re-inventing the wheel. If they have questions then for clarification it's less annoying than having to give chapter and verse of what's already been posted many times before. They should put the work in for themselves though, because at the end of the day it's them who have to deal with their situation, especially if it comes to standing up in front of a judge - and the opposition.

Ah... Bailiffs... Nawty people...

 

Had a run in with some about five years ago for an account (two parking tickets and a speeding offence that was thrown out by the mag.) that had already been paid to the court via my disability benefits two years previously. They fancied my puma and scared the living S*** out of me at 8am with a tow truck. Had to ring my ex hubby 'cos I knew it was wrong.

 

Thier offices didn't open 'til 8.30am so me and ex hubby sat in my sitting room with the bailff's paperwork and them holding £250 in cash outside in their truck. I refused to give them the keys for the car and called the police who were able top verify that there were no outstanding fines...

 

As soon as the bailiffs were 'called off' by their office they threw the money at us and grabbed the paperwork thus not enabling us to get the b'tards...

 

They were a company based in Merthyr, South Wales. Very nice gentlemen with a lot of 'thug' in the mix :!::-x

yep I was right............they still recon I owe them the princley sum of £32.09...but at least they have re-issued it from being £64.18 the donkeys.................BUT IT HAS BEEN PAID a bliddy month or more ago...makes me want to swear ooops :madgrin:
