    • new thread created for this claimform please post here now for anything to do with it now . pop up on the bulk court website detailed on the claimform. [if it is not working return after the w/end or the next day if week time] . When you select ‘Register’, you will be taken to a screen titled ‘Sign in using Government Gateway’. Choose ‘Create sign in details’ to register for the first time. You will be asked to provide your name, email address, set a password and a memorable recovery word. You will be emailed your Government Gateway 12-digit User ID. You should make a note of your memorable word, or password as these are not included in the email.  then log in to the bulk court Website .  select respond to a claim and select the start AOS box. .  then using the details required from the claimform . defend all leave jurisdiction unticked  you DO NOT file a defence at this time [BUT you MUST file a defence regardless by day 33 ] click thru to the end confirm and exit the website .. get a CCA Request running to the claimant . https://www.consumeractiongroup.co.uk/topic/332502-cca-request-consumer-credit-act-1974-updated-january-2015/ .. Have you changed your address since the time at which the debt referred to in the claim was allegedly incurred? No Do you recall how you entered into the agreement...On line /In branch/By post ? Online but it was for a smaller amount they kept on increasing this with me asking Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. It was assigned to a debt collection agency  Were you aware the account had been assigned – did you receive a Notice of Assignment? yes  Did you receive a Default Notice from the original creditor? Yes I also made offers to pay original creditor a smaller amount but was not replied to Have you been receiving statutory notices headed “Notice of Sums in Arrears”  or " Notice of Arrears "– at least once a year ? No Why did you cease payments? I was made redundant and got a less paid job I also spent some time on furlough during covid and spent some 3 months on ssp off work. What was the date of your last payment? May 2021 Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? Yes at the time I communicated with all my creditor's that I was running out of funds to pay the original agreements once my redundancy money ran out that was when my accounts defaulted. I then wrote to all my creditor's with pro rata offers of payments but debt collectors took over the accounts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My little Godson who's very sick at the moment with leukemia, and is on steroids made me smile today - his big Sister made him a sausage sandwich for his breakfast, and he wanted some of last nights leftover chilli beef in it too :lol:

I was on high dose steroids for years from a very young age. My poor mum had to cope with me asking for spag bol or mash and gravy for my breakfast on a fairly regular basis:) I never did understand why it wasn't a reasonable request for brekkie :lol:

Thank you Lexis! Yep, that's why he wanted the chilli beef too! He wakes up in the night as well wanting noodles :-D He's been taking regular steroid courses with each bout of chemo, but he's on a particularly high does this time as he's just started a new bout of several intense chemos - one in his Hickman line (which he calls his "wiggly" lol!), one oral, two intramuscular - and one in his spine too! So I'm posting him some treats off this week, as he's being soooo brave!

 

What made me smile today was Sodem's two posts on here! They had me lmaoooo! :lol:

Oh poor little soul. Kids are so resilient aren't they? I was in and out of Great Ormand Street for over 10 years and some of the things you see there just make you want to cry, but the kids all cope far better than their poor parents and carers. I didn't, I was a whingy git, but generally speaking kids cope better :D

 

I'll be crossing everything that the chemo does what it's meant to for him x

Kids are and ok my boys didnt have any real illness in their younger years but they had a lot to cope with when their mum died when they were only just 6 and 9 they had their own personal traumas to deal with along with me and mine.............if only magic wands were real

Can't imagine dealing with that burly (and the rubbish you mentioned they had at school too afterwards) - losing grandparents was hard enough for my two.

something has been making me smile and also cringe and thats whatching Cameron with Obama....he's such a doinkie pillock....so far out of his depth and akward ....he needs a solid boot in his upperclass-arse....I'd wear a size 12 to do it and gladly

he is though and god knows what one is BUT had to come up with a new description of him after seeing the praaaaaaaaaaan on tv yesterday I felt embarrassed sitting watching him he was so out of step there just like the dill is here.........I also invented a nice new word last spring in a flash of inspiration when chatting to someone..................FUNSHINE what a lovely word dont you agree LG x

BurlyB, I don't watch much of the governments brainwashing propaganda at all on the news - but I have to say I did see Cameron with Obama! I was roflmaoooo!!! I said to my Husband - even though they were both dressed almost identical, it was like looking at "Sean Bean" and "Mr Bean".....I think you can guess who was Mr bean huh? Lol!

 

What made me smile today, was the sheer sizes of some of the sheds my Husbands been looking at - now I know we have big gardens, but It's a shed he's supposed to be buying, not a garage lmao! :lol:

I have actually custom built sheds and timber garages in the past for much less than they charge at shed shops with their custom skinney wood.....most of the wood they use is matchwood in thickness....bliddy con merchants
