    • There are example threads where AOS is done but defences are submitted late, it happens, sometimes because MCOL is broken! As the claimant you will be able to reference a late filing and request it be struck out for not following Court Directions, for example if the defendant arrived at court with it on the day without submitting... but I believe there is some (slight) wriggle room for defendants (reasons depending) on late defence. I believe you just need to continue your claim, no defence and not following court directions will almost certainly strengthen your case

    • Thanks for that information. I seem to think they have similar names and similar addresses and I thought it was Aldi that was offering the great deal that attracted you to that car park. So we are still stuck with Nexus. Please do not call DCBL about a settlement figure.The first reason is that they have your telephone number which is not something you want to give to those vultures as you rightly call them. They will then harass you on the phone and try and send you last minute details the day before the case -which they shouldn't do. And second they are already charging you £60 to £70 more than they should lawfully, to that they will then add the Court costs that they haven't yet paid or incurred and then say that they will give you this great offer of £150 to avoid going to court.Big deal-not. Were it around £50 that would be a better deal but they would not accept that.   
    • Hugo, how are you getting on? the deadlines can creep up on you. It's useful to have a week or two in drafting a defence, so you can understand it for yourself before submitting. Read other like threads for examples and tailor to suit you. Get one drafted and posted (without personal info) and let us take a look
    • OK thx jk2054 I'll go that route, does anybody have any positive reviews of NWNF law firms they've had experience with? I did consider InjuryLawyers4u, but apparently they're more of a broker, & who you end up dealing with can be hit & miss.  Would rather try & get a sharp firm that are on-top of things if possible.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Oh Nystagmite, I'm delighted for you! JTR's are cracking little dogs! We had our old boy till he was 19, we miss him so much :(

 

Although you need tons of energy, and constantly keep their energy focused on positive things huh? Lol!

 

Which is why if we get another, we're looking at getting something a little calmer :lol: And were thinking of a Bichon Frise, as I'm very allergic to animal hair, and Bischons tend not to molt much!

MIL's problem neighbours made me smile

 

last friday they went on holliday (or at least thats what they said)

yesterday there was a report of robbery and police spoke to MIL who went around with them confirmed that there was a broken back door, but a large ammount of electronics remained unknown what was missing (by large ammount of electronics several Flatpanels still in box etc

 

today the councils boarded up not only the door but all the windows including upstairs, still all the electronics inside, although police were looking at serial numbers and said they may be back...

 

thing is scrap collector lives accross the road from MIL and he was eyeing up the boards that went up, got a feeling the familys done a runner and good riddance

My Husbands face when his Truck sack trolley was delivered! He was like a dog with two tails! :lol:

 

It's one of those ones that lay flat as well as upright with four wheels - I could almost picture him being 5yrs old pulling a cart along full of crab apples :lol:

Oh I know Termi, it poured down here non stop last night, and has been a fair bit cooler but sunny today, so my herbs are blooming!!

 

The deal I got on a gorgeous new shed made me smile! Heavy duty, all tongue and groove, tongue and groove floor too, fully pressure treated so a 10yr guarantee, a lock with an alarm and fully fitted - for only £229!!!

 

The same ones all over the internet are around £400 +, so an absolute bargain - their reviews are second to none too!

 

We were looking for so long, and all we kept seeing were those "billyoh" ones that had terrible reviews, so unless we wanted to pay in excess of £400, we were going to end up with a flimsy box!

 

It's being delivered and fitted on the 5th Ausust, and it can't come quick enough :-D

I was told last night that once I get up to a certain standard, I can be registered as a T12 (or maybe 13) athlete. For those who don't know, it's the same as the criteria for the paralympics. T12 and 13 is sight impairment; which is mild to moderate.

 

My coach was asked last night if our groups wants to run with (I've forgotten his name) the paralympian whose doing the 40 marathons in 40 days thing.

What made me smile was after being chauffeured by DD to a nice restaurant for a meal with OH to celebrate 30 years of marriage, finding a bottle of champagne provided by DS. How lucky are we to have such great kids. Lots of FB messages from friends and family too :-)

passed my CPC training and tests, both theory and practical 47 out of 50 on the theory and 100% on the practical

 

also drove the lorry for the first time yesterday more lessons for the next week or so then test on that

well done labrat, I have a CPC and ADR licence, been job hunting for over 18 months now, did have some HGV lessons with my last firm but the instructor kept messing them around so they got rid of him so never got to go any further and I can not afford to go for HGV to expensive. I can drive up to and including 7.5tonne, wish you lots of success
