Hi, can you be more specific about what and who and when you last paid?

 

You say you have been paying over a year now, but then go on to say the debt has not been paid for 8 yrs.

 

To be statute barred a payment must not have been made within 6 yrs. If one payment has been made during that time, even yesterday, the 6 yr clock goes back and starts all over again.

If of course 8 yrs had went by with no payments being made and then for whatever reason you start paying again this does not reset the clock and you can stop paying and use the Statute Barred Defence as the debt was already Statute Barred when you recommenced payments. This concept may of course be too simple for a DCA to grasp so you may need to explain it to them.

Thats it exactly, 8 yrs passed with no payment then i started about 1 yr ago paying 25 pounds a month which they tried to put up and threatened me with court.I said on you go we will go to court, so i heard nothing for about 5 months now they are at it again.I have since moved homes so i am just going to cancel the payments on monday and they can sing for it.

Yep the alleged debt is well and truly Statute Barred. Let them whistle for the money.

Hello first post so hi to everyone. I received a phone call from mac hall in Nov 07 (DONT KNOW HOW THEY GOT MY NUMBER). They said it was reguarding a debt from a northern rock loan for 3,500 in Jan 01. I told them i had no idea about the loan adid not acknowledge it, they said i would receive a letter explaining everythink.

3weeks later i got a letter but after reading about they on this site i just ignorned them, also keep getting messages on the phone. The last letter was a direct debit aggrement for me to sign so that got binned, the cheeky bstrds have searched my credit files as well without my permission how can they do this. I have now received a letter from COMPANY CALLED MERITFORCE DOORSTEP COLLECTIONS, saying that if the outstanding balance was not paid i would getting a visit. How do you get these off your back, i have not responded to any letters or phone calls.

Any advise Please.

Hello new to the forum, Got this letter yesterday

 

We have written to you but hanve not received a response from you.

 

Please call 01563556547 quoting Ref No M!!!!!!!!!!!!!! immediately to avoid action being taken against you. Should we fail to recieve a response to our communications, we shall have no other alternative but to pass this account to our field collectors who will call within the next 7 days.

First i have never had a letter before, second its on an envelope with the three tare off sides and no signiture, Finally i have just credit checked my self and there is nothing outstanding. Should i ring them?

Dont bother doing anything until you recieved a proper letter from the idiots.

 

This is just a fishing exercise for them to try and get money out of you. Do you have debts that are over 6 years old? If so that is more than likely what they are chasing you for.

they may do but they may give in. they have sent me 2 letters as you discribed since 2006 which l have put in the bin.

Under NO circumstances even think of phoning these people up. They have probably sent out hundreds of letters just like yours to people who have a similar sounding name in the hope that they can CON someone into paying. MH specialise in the purchase of Statute Barred and Unenforcable debt.
