This is something that really hacked me off. After explaining how I had been sent three SD's by Connaught and 1st Credit that 1st Credit never followed through on, and explained that this is surely an abuse of the SD system. I was told this by the judge "If I kept threatening you with a punch on the nose if you didn't leave me alone and I never carried out that threat, what law would i have broken?" It also doesn't matter that 1st Credit are under close scruttiny by the OFT either. I mentioned that too but it didn't seem to matter. Didn't seem to matter either that as far as I was concerned the debt was still in dispute.:mad:

Don't you pay a premium for unsecured loans...Seems to be no difference between secured and unsecured loans. You can still lose your home. :confused::mad:

 

I now have no faith in the Court system. I had valid points that were blatantly ignored....A two hour case that was dismissed in 15 minutes.

What happens next??? I was advised by 1st Credit's solicitor today, that if they won, which they did they would be petitioning for BR with immediate effect.

 

Now there is no default or CCJ showing on my credit report for this debt. Can they push for BR without any of these?

OK hopefully you will fight this at the bankruptcy stage....have a read of these....AND i'd still use the statute barred too, you need that proof from the payment management company....

I'd also write to Gareth Thomas - Undersecretary Of State For Trade And Consumer Affairs and speak to your local MP, and the OFT too....

 

A full SAR to 1st Credit and the original creditor too....with CCA requests....
