    • Where a person who owns or partially owns a property enters into an IVA, it's usual practice that in the fifth year, the person has to attempt to remortgage the property to release equity. It's extremely rare that a homeowner will be successful in remortgaging due to having a poor credit rating. Where the owner is unable to remortgage, the IVA is extended for a further year. This is absolutely normal practice in an IVA, and if your sister cancels payments to the IVA, the IVA is at risk of failing and she could be made bankrupt, therefore losing any equity she has in the property. 
    • Right. So I think it would be  good idea to give a brief description of the property, for example detached house, or flat or terraced. And some sort of identifier so we can distinguish from other properties you handle. An incomplete street address eg "No.14" would do so while preserving your privacy. Is the freehold title discrete for the property, or does it cover other leasehold properties? And a bit about your history, how current ownership came about. At one stage you said it used to be your family home, elsewhere you wrote that you'd bought the leasehold. Did those comments refer to this property? Did you acquire it on the open market, or from your family? Is this the house with the garages, where you own the freehold? Trying to understand whether there are underlying reasons that might account for problems with valuation, eligibility for finance, and the fact that neither you nor Lender found it possible to sell. Finally (for the moment) you refer to existing litigation. Does that relate to this property? If so it would be good to give a brief overview. Civil or criminal? What role do play .. claimant, defendant, appellant, respondent?  Charge, or cause of action. You don't want to go off on separate path that would better joined to the current proceedings.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

 

I hope that someone may be able to help on this. I am posting on behalf of a close family member who I'm trying my best to help.

 

About 18 months ago she had numerous un-secured debts and Picture the Loan told her the best option was to take out a secured loan with them. They also told her she must take out payment protection on the loan.

 

She borrowed 61.5K over 25 years (eek - a lot a know, and as she knows now a huge mistake). Anyway whilst going through he finances with her something didnt add up on the picture repayments. I managed to get a breakdown of the loan, and the they have added 15.5K onto the balance of the loan for the PPI !!!:eek: She is now paying that back over the 25 year period at the same interest rate of the loan. By my rough reckoning that means she will pay a staggering 45K for PPI. Sureley this cannot be allowed :x.

 

Please, If anyone on here can help I'd be really grateful. She is dreadfully worried about her financial situation and this could really help her out if she can cancel and claim anything back.

wow what a recommendation for a company!!! however you could do it yourself and not have to pay them anything from your refund ie no win no fee but if you win hey hey thats when they hit you!! theres lots of info on this great site which will enable you to proceed yourself from start to finish. :D

I'd also heard that Picture were no more, yet she's had nothing to say this or any info regarding another company taking over the loan. Also, all correspondence still has Picture on it :confused:

She should have had a letter from Target, or been told that Picture Financial is now Picture Loans or something, Picture has not been declared in Default yet so over 600 claims are waiting to be looked at so you may want to get in the queue!

Picture are now in default, see the FSCS for details. I received a call from the FSCS asking me for some further details anr they say they expect to settle all claims within 6 months with some (inc mine hopefully) settled within 1 month :)

Just had letter this morning we have won our claim against Picture PPI. we have been awarded just short of £15,000. This is a massive boost to us as taking the decsion we did to go with Picture was the biggest mistake of our lifes!!! its nearly cost us our house and our marriage. although still stuck with loan its fantastic news to get the PPI back. So for all those out there keep at it dont give up!!!!!!:grin::wink:

Congrats on the win, I wish they would hurry up with my claim, moreso as I got a default notice from picture today. If you dont mind me asking when did you apply? I have wrote to the FSCS asking them to loook at mine as a priority due to my circumstances.

 

I do also agree taking the picture loan was the worst mistake of my life.

Hi All,

 

I was just wondering what reason(s) everyone was giving for be mis-sold the PPI, as i have just phoned FSCS and requested a claim application form for this. My reason reason for claiming is that i wasnt fully aware that the cost of the PPI (over 8k in my case) was being added to the loan and interest was payable on that for the full 15 years of the loan and also the fact that the PPI only covers me for the first 5 years. Is this a good enough reason for claiming?

Cheque recieved from FSCS yesterday for full amount + plus interest, to say im happy is an understatement, over the moon. Thanks to everyone for there help. And i would urge anyone else to get there claim in ASAP, i cant beleive how easy it actually was. Good luck to you all.

I also have like many posting on this thread, been mis-sold PPI by Picture on my loan & would like to make a claim on the FSCS but I'm a bit unsure what reasons I should give...can any successful applicants give me any clues please?.

 

Obviously I wasn't told that I would only be covered for the first five years nor was I made aware of the total cost I would be paying for PPI...is this a good enough reason?.

I would just like to say thank you to the previous replies to this thread, I am having a nightmare over my picture loan at the moment I wish I had never taken it out, but everything that everyone has written has made me put in a claim over my ppi and the 5 years scenario so hopefully will hear something back too and I will let you all know.

Its just nice to know that there are others in the same situation and that it wasnt just me

hello fellow picture loan victims. i have had my picture loan for 3 1/2 years now. i first complained 3 years ago about only getting 5 years of cover for my £9975 but having to pay it over 25 years. the fos declined my complaint as they said i knew i was paying for that long (picture wasnt in default at the time). in aug 2010 i lodged yet another complaint but this time to the fscs. if this one fails im taking them to court. does anyone know if i have a chance of winning with the fscs if the fos has already ruled against me? my claim is exactly the same as all the other claims. i didnt know i was paying 25 years for 5 years of cover!

Hi, I've just come across this site and amazed.

 

 

I too have a Picture Loan and was wondering if it is to late to apply for PPI refund?

 

 

I previously had a picture loan in my sole name.

 

 

My partner and I decided to consolidate our debts and take out a joint loan.

 

 

Picture added what was outstanding from my single loan to the joint loan.

 

 

The agreement said the PPI was optional and we said we did not want it.

 

 

The PPI was still added to the loan.

 

 

We paid off what we thought was the loan and Picture insisted we still owed just short of £20,000.

 

 

which happened to be the exact amount of the PPI.

 

 

Technically we are now paying PPI for a loan we do not even have.

 

 

Can we claim back the money we have been paying.

 

 

We have had this loan since 2006.
