Hello, Mrs Z here, Just a quick question, if I may :)

 

Mr Z is sending off his Defence for the Court, does he have to fill in the actual CCJ summons form or just send the "Embarrassed Defence letter"?

 

Or is it both? His AOS was filed online, sorry one more question!

 

Should the Defence to the Court and copy plus letter to Incasso BOTH go by Special Delivery or would Recorded Delivery suffice for Incasso?

 

Any help appreciated, thanks very much :)

Agghhh, I dont know the answer to your first question re the CCJ Summons form.

 

IMHO, Recorded delivery would do for INCASSO, with Special for the Court. :)

Yes, Mr Z wants to get it off in the post today. We've had post and nothing re CPR request from Incasso.

I have just looked at the documents you posted on the thread. On page 6 (Ithink) down the bottom there is a space for Mr Z's defence. So I guess the answer to your question is yes.. the form is to be filled in and at that point if there isnt room to write the defence in.. put see attached ?

As at this stage there is nothing for Mr Z to dispute having nothing from Incasso regarding CPR request, so in reality, the Embarrassed Defence should be sufficient?

Yes, sorry citizenB did see andyorch's reply but got waylaid by daughter turning up!!!

 

Thanks andyorch, Mr Z has just submiited his "Embarrassed Defence" online via MCOl. Just need to post off a copy/covering letter by RD to Incasso.

 

The only downside to filing Defence online is that the Court doesn't get to see a copy of the letter DH recieved from Incasso saying they doubt he would recieve CPR request info in time to prepare his Defence. Still, local court would - if it gets to that stage!

Hi Mrs Z

 

Dosent realy matter The Court does not get involved anyway till the Claimants respond to your defence and if no response is recieved then their claim will go to stay.Make sure you print your time reciept off after submission via MCOL. Send hard copy Solicitors letter to Incasso they will recieve a copy of your defence via MCOL. Job done;)

So, let me get this right, the letter to Incasso definitley does not need a copy of the Defence? Apologies if I come across as thick, just want to make doubly sure that we have done things correctly!!

Hi

I suppose you could also put a copy of said defence in the letter.The main thing that matters is that the Court have recieved your defence and on time.

Thanks citizenB, you're right of course - it's the waiting game now and I thought I'd feel better for having got it done! Since having financial problems, I've become a little paranoid (probably lots if I'm honest!!) and have this horrible feeling of dread in my stomach that they will suddenly comply with the CPR request before Friday!!

 

Still, Mr Z wanted to get it done as he is back to work today through til Saturday. Oh well, what will be will be! Thanks again :)

Hello, Mrs Z here,

 

Well, post has just been delivered, Mr Z has recieved an acknowledgement of his Defence from Northampton Court with what I presume is normal procedures. Nothing from Incasso re: CPR request. So, guess it will be a waiting game for now!!:D

OMG!!! 2 large envelopes stuffed with paperwork has arrived from the Co-op for Mr Z. I have yet to go through it all but after a quick shufty through, it looks like they have everything including copies of emails. It's going to take me all bl**dy day to read through it.:(

 

I will report back if I believe anything is amiss, but I can't scan ( I know! I need to learn!!) paperwork, will have to get Mr Z to do that when he's off on Sunday!
