Sent a preliminary letter 14 days ago, requesting £2338. got a letter today from Langdale offering £745. very quick response and immediate offer, which needless to say, i am rejecting. could they be learning their lesson?

Very quick but way off the mark of what you are claiming for tamdolan. Are you going all the way and persuing the rest?

 

S.A.R - (Subject Access Request) - Did you have any offers before your full offer? I have heard nothing at all which I guess is not unusual.

 

Does anyone know if I can add a charge on which is due to come out of my account on 7th August but I shall be filing mcol on 3rd August. Am I pushing my luck?

This was the first offer that I had from them. To be honest I was surprised that they offered the full amount on such a large amount as a first offer.

Am starting to think 'should I have just accepted it' but too late, letter in the post requesting cheque only.

Go for it, add your other charge, I added about £700 between the time of my prelim and filing my MCOL.

Sent my mcol off today, the 8% added £600 to my total, can't afford the court costs (put them on the credit card :-| )so I am really hoping they pay up soon!

There is one day between us, so hopefully we should get paid around the same time!

01st July 2006 - Preliminary request for £2868.24.

12th July 2006 - HSBC offered me £1995, I declined.

17th July 2006 - LBA sent, now £2970

01st August 2006 - MCOL for £3778 (inc 8% + fees)

08th August 2006 - HSBC defending ....

31st August 2006 - SETTLED IN FULL - Wooooooohoooooo.

Hello Weezy... I filed my Mcol yesterday so I'm at the same stage as you. I got no offers in the build up so I'm worried that I'm being treated differently than everyone else. What if I'm the one they have decided to "Go all the way with?"

Hi Wardy, hijack away...

 

The only reply I got from HSBC was my statements which I requested at the beginning, so I was a bit worried too. I dont think we are on our own though, reading other threads it doesn't seem unusual not to hear anything back, pot luck I think. Good luck though and keep me posted.

 

P.s - I am the unluckiest person ever so it will probably be me they make an example of too! Ah well, at least we might me famous as the first people HSBC defend against!!! See you on Trevor MacDonald!

Hi Folks

 

Don't worry guys I am in exactly the same boat as both of you (slightly less amount though just over £2000) - just standard replies to date, filed my MCOL yesterday and waiting.

 

I think that if the 3 of us do end up in court then we should get everyone who has been paid to fund our legal battle - LOL - dont think we will get many takers do you?

 

Anyway WHEN I get my cash back I shall be celebrating in ALL of Birminghams finest ale houses and anyone is welcome to join me for a beer.

 

I might even show you a trick or two (disappearing money anyone!!!!!!)

Just received an offer this morning from Colin Langdale for £2000. Needless to say I declined and accepted only as partial payment. Chasing the other £1808! Bit strange turing down £2000 from HSBC but its my money and I want it back!! Will just have to wait and see now!

 

Also noticed on a recent credit card statement that they are reducing their charges.

 

"With immediate effect default charges are reducing to £12 if you pay late, exceed your credit limit or if we return a credit card cheque. We are also reducing the charge for stopping cheques to £12."

 

Are they learning and what were the charges before now??

I got an offer the day after filing my mccol. Thought it would be stupid to accept nothing but the full amount now they have been served! Mine is deemed served on Monday (7th Aug) so i imagne it should all kick off for us the end of this week?

i have just had an offer of £1800 i wanted £2074 i am going to accept as i need the money, going to start a claim on my managed loan as i would not have needed it if it wasnot for these charges...good luck everyone and thanks for all your help !!

I am still at the issued status at the moment wardyboy2, and I filed on 2nd deemed served on the 7th. Just imagine how many they must be having to deal with (ours are probably at the bottom of the postbag).

 

Will keep you all posted on mine - they have till 21st.

Are you sure its 14 days they have as when I've checked on mcol its says that The Defendant is allowed a total of 28 days from the date from when they are served with the claim to reply.

 

Don't quite understand. mine was deemed served on 7th August and acknowledged on 8th??
