    • Hello, welcome to CAG. It would be a good idea for you to read other shoplifting threads here to get an idea of how this works. The police won't get involved now, so no chance of arrest. You need to avoid that branch of John Lewis for a while though. Basically, John Lewis's security people will give your details to either a firm like Retail Loss prevention or DWF solicitors who will then write to you with scary-sounding letters to frighten you into paying them some kind of penalty. They have no legal power and can't take you to court, only John Lewis can. Last time we saw a retailer in court against shoplifters, it went very badly for them and we haven't seen a case like that since - over 10 years ago. But you need to figure out why you did this. If you need support, talk to your GP and aske them. They will have heard it all before and won't judge you. Best, HB  
    • In addition to the information you've been given above, I suggest that you spend some time reading up on the stories on this sub- forum. There is a lot of information about suing as an entitled third-party. Take a couple of days – and by Monday you will be much more confident. More in control and you will have fewer questions to ask but the questions that you do think up will probably be more relevant and more interesting to your case. Do the reading. This is always an essential first step   Additionally please can you give us more details. What was the item, was it correctly declared, was the value correctly declared, what was the value that was declared? Very importantly what date did you send it?
    • I got caught today shoplifting some shampoo & conditioner at John Lewis. I felt absolutely awful. The people were quite nice as I returned the items without any hesitation, gave them my name, address & DOB. They did not ask for official ID, and let me go after taking my picture and then handing me a paper saying I am banned for life. I just now read on the paper that they may share my details with third parties (police) and am extremely stressed. I've previously shoplifted, not at this John Lewis but others of their stores (an absolutely horrible habit made worse by cost of living crisis).... How likely is it that they will actually start an investigation for this offense? May I get arrested for this? While I was in the backroom, the security was quite nice and told me that no police would be involved unless I broke my ban.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I had a Pangalaticgargleblaster the week after I had my brains smashed out with a gold brick.

 

My only criticism about Douglas Adams is that he never had a gingerbread man in any of the hitchiker stories. So for me he's only a 99% genius.

I've got this recorded from a HFO telephone call:

 

Vinni: says all sorts of threatening things about me having to pay hundreds of pounds more than i already owe.

me: I only owe 120quid and the final payment is being made next month and ive not missed a payment so you cant do that.

Vinnie: Oh don't worry *name* i can assure you you will pay hundreds of pounds more.

me: I do not authorise you to take any money other than the agreed amount oh £57.93 on the 24th of july and 24th of august so no you cant do that.

Vinnie: No you'll pay more i can assure you.

Me: Well i'm recording this call so if you do you i will report you.

Vinie: you cant record a proffessional call its illegal.

Me: No its not.

Vinnie: You have to have a licence.

Me: No i don't.

Vinnie: What is your licence number?

Me: I don't have one, YOUR the one calling me and i'm recording you.

vinnie: Unfortunately you are breaking the law and i am not authorised to speak to you anymore.

Me: Of course your not.

 

Vinnie slams down the phone :D

 

I would also like to note, that this is my BOYFRIENDS debt, boyfriend-no legal connection. Yet because i rang up ONCE on his behalf they are harassing me! And did not even ASK a security question, just said is this *name*

 

bwahahahaha. And i've got it recorded so if they try to automatically take payment then i will go straight to the police.

I recorded HFO threatening to add £100 interest on the spot to a £120 owed debt :cool:

 

I recorded HFO breaking the data protection act and admittidly breaking the telecomms act :cool:

 

Oh how funny? HFO called me with a £20 settlement fee for the "inconvenience" and sent me a fabulous letter to confirm the debt is now settled :p

You should report that call to Trading Standards, the Information Commisioners Office and the OFT straight away as the caller has committed various offences including breaching the data protection act, OFT guidlines and the new Unfair Commercial Practices Directive. They'll have field day with the agent and the company :lol:

I'm planning to. Only recieved that call last night. And i am new too :)

I have been told what i can legally do with the debt (CCA and harrassment letter to HFO etc)

I have asked people if they know of any templates or could help me with a complaints letter...i'm only 19! My bfs only 22....pretty young and unknowledgable about debt/law.

 

I do have a thread...but if you have any ideas or info about how i would go about writing this letter i would appreciate it. I've already been given the addresses.

Still...pleased with myself for recording it. They called my mobile so it was easy to do :)

I will do. going to get the S.A.R sent off today and the harrassment letter. Hate ringing people up grrr...oh well. I will record calls to everyone i speak to...least i have some info to refer to and a bit of evidence.

 

If HFO continue to act this way...i'm thinking watchdog too. I'll make a new thread when i do that incase anyone else wants to join in.
