    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. Anyway I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?
    • The neighbour's house is built right on the boundary so the side of their house is effectively the 'wall' in our garden separating the two properties. It's a three storey house and so the mortar poses a potential danger to us. Because of the danger, we have put up an interior fence in our garden to ensure we don't risk mortar dropping on us. That reduces the garden by 25% which is not only an inconvenience, but it's the part of the garden where we had lined up contractors to install a patio and gazebo which we will use for our wedding reception in less than 2 months. We have spoken to the neighbour's caretaker who is on the case, has spoken with a roofer and possibly a scaffolding company, but there are several issues. They don't seem to understand the urgency. As long as there is a risk of falling mortar, we can't carry out any work in the garden, and unless they hurry up, we're looking at cancelling our wedding as it's not viable to book a venue because we can't use our own garden! Also, they want to put the scaffolding up in our garden which would be ok with us if it was a matter of a few days and they hurried up, but there is a tree (most likely protected by the conservation area), so most likely they can only reach part of the roof with the scaffolding if they put it up in our garden. We suggested a roofer with a cherry picker but they seem to want to use a company they've used before. Any and all comments, suggestions, advice is more than welcome.  PS. does it make any difference that the neighbour is a business (ltd) and not a private dwelling?

    • Apologies all for the late reply and info, i have been away with the Army. They have paid I accepted the offer on the 5th of May, and they paid on the 17th of May.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Had a letter today from kensington-saying second request for payment was not honoured by your bank.

Direct debit was cancelled months ago-pay by card-strange

A further 25 pound added to mortgage-you are having a laugh.

Debt counsellor may be instructed to visit you-bit late for that-oh but of course there would then be their fees added.94-if seen-58.75 if not.They dont seem to make appointments-so 58.75 gone.

If it is your intention to forward payment-contact us immediately.Told them on phone to go for repossession week ago-whats stopping them.

comes.As tawny at certain age-will not require any more credit etc-secure new place found-business doesnt need any major finance so am in position to do this.Just will be interesting to see how things pan out.Especially kensington-maybe our experiences will help someone-who knows-but we are both pushing them hard-thats for sure.:-)

Things are massively improving on business side-isnt easy running the smallest ltd comp in existence.Same as you eddie-not giving to much away.

Yes, if we can push the boundaries a little further; maybe we are abusing our position (but what a shame for the poor bullies!!!) we can possibly get some information/advice that can help the many others who are being atrociously treated.

Was talking a few posts ago about paying Kensington by card.

Arranged this when was not making payments in time-they knew about this.

This has carried on for many months and they agreed to this.

Have just got bank statement from bank-and guess what -Kensington have tried to get money from wife's account-of course it wasnt in-but another 35.00 charge from SHABBY ABBEY.

Now if anyone's in same position at moment and paying Kensington by card-cancel the original direct debit-even if agreed with Kensington if you dont pay-the crafty devils will try to ressurect the DD.

SURE THING I WILL BE CANCELLING THE ORIGINAL -tonight-sheesh thought i had.Owls memory not like it used to be.

Kensington-sounds like they are suffering-they will soon.

Now feeling they have been on site-if so -hope you like herring and maybe rotweiler.8-):roll:

Err. has anyone told Kensington that the OFT do not like companies who charge for a 'debt advisor visit' - they are basically going to send somebody round who will lie on the income and expenditure form and see whether you are 'living beyond your means' to get their commission as high as possible. I had one from GMAC who told them I had a car and spent £400 a month on it - I complained when I found out but they said 'Sorry its his word against yours' but eventually gave in when I could prove due to two medical conditions I am unfit to drive.

 

Pass their letter onto the OFT and let them get investigated for it.... cost them £400 in return.....:p

Just a short post-strange when tawnyowl accepted that house was either now or in future going to be repossessed,head cleared and brain kicked in after years of worry.

Now tawnyowl in the past has borrowed money to pay mortgage-if any any of you have or are going to think very carefully-it for me anyway became even more of a problem.It built up even more of a problem paying the people back who i had borrowed from.

Looking back i now realize remortgaging was possibly looking at things short term-but think the advertising and pressure-tv advertising etc turned my head .

All those hours spent worrying -by myself in a room-terrible-till i finally found this site.And well the help Ive had here helped sort me out.Tawnyowl is no longer feeling like a fledgling-growing i feel into a wise old bird-who looks back and cant believe the sleepless lonely nights spent in the hole of hell.

I feel as you do debt advisers need to be investigated-from finding out how and who employ them-their qualifications to offer this advice-because some of the ones i have seen-are absolutely useless and as you say-if you press them hard enough they always seem to come up with a figure beneficial to the company.They i suppose will do this or may face repossession themselves because they wouldn't last long if they didn't.I feel it is a racket-the price they charge says it all.Sick of it the more you think about them the more you realise its another [problem].There are many people talking to them now-hundreds more being made for the greedy sub prime lenders.Tell them by letter no thanks -i do not require your school of economickey taking adviser round here.They probably wont even give you a time when they are calling.

May i say this is my view only and i must admit i am biassed.Allways will be till the financial markets are sorted out.One day maybe-but doubt it.

Lottery share-mmm-giving me thoughts about kensington-now if i break their tel no down make numbers up-add their charge 94 that would be 13-:eek:

add their 58 if not there charge that would be 13:eek::eek: some banks charge 38 for missed DD that would be 13:eek::eek::eek:Stopping now am getting jitters-i:eek:ts now 23.08 thats 13 :eek::eek::eek:think im going to deep here so better go-and throw some dice instead -cant come up with 13 then-feel safer.

Good nights sleep-Bona i hadn't spotted that-good job was getting the jitters-everything seemed to be adding to 13-got over it now-maybe i will try the lottery today.Maybe include that number-maybe not.

On the Kensington thing-i believe that action is not far away-as there are only 100 staff left-perhaps the litigation dept-being busy i presume,are slightly behind the other departments-maybe we will keep them busy for a while-certainly going to try-just want it over with now.

Full repossession can not be far away.:-)

Failure to conform to the terms of the suspended possession order will enable the lender to apply for an “Eviction Warrant” without further Court action

MMM-better boost the packing i think.

Surely Kensington are moving behind the scenes.

Had not realised this fact.

Will be glad when this is finalised.

Now thinking about -when i go the insurance of house etc-because round here nothing is empty for long-soon gets visitors if empty.

So many thoughts going through head.

Unlike bank charges, it is possible to claim back mortgage penalties going as far back as 12 years. (as opposed to 6years on bank charges). Even if you no longer have a mortgage or have changed lenders they can still be claimed back. Consumers have had a rough ride for years and had enough punishment inflicted on them. So why are you waiting? It is your money and it is definitely worth fighting for.

Still no word from Kensington- Possession can not be far away-maybe next week will hear-but must be coming-maybe tommorrow.House is nearly packed will never look back from this house of pain- never again-all the hours spent in the room from hell trying to sort problems-thanks for help and friendship shown to me when tawny was on one knee-not knowing what to do-couldnt see my way through the dark clouds-but help came and eased the pain-thankyou.Tawny owl thanks all of you.
