  1. Hey All, Yes it's CC again, i've read a lot of the forums and am just after piece of mind that i'm doing the right thing. I left Oz (WA) in late 2015 with CC and Bank debt which is now defaulted and after 3 yrs CC are now chasing me for payment with their incredible interest fees. I know that it's not Statute Barred so that's not an option. I received a phone call a few days back at 2am from them asking me about the debt etc. In my sleep addled brain I finally managed to answer a couple of security questions but that was about it, I didn't give them my UK address and had woken up sufficiently to supply them with my secondary email account that I barely check. They do know i'm in the UK due to the time difference/phone number called. The only people in Oz that have my mobile number is the ATO and my Ex-Wife so i'm not sure how they'd have gotten that anyway. They don't have my UK address and i'm reaching out to her to advise to ignore them (let them know we're divorced and she doesn't care where I am) and if they harass her to let me know and to make a complaint to the relevant people. I'm just worried for her as she was just recently released from a hospital after having a mania episode and don't want her harassed and potentially set off again. Should I just ignore them?? I've already setup my mobile to not allow incoming international calls and it's easy enough to set Gmail up to ban from certain domains. I'm currently un-employed, bills here and back living with my parents (yep living the dream....), so have very little in the way of assets but i'm reluctant to engage with them unless I have to.   2. Good Evening Guys, I've posted here previously and received some fantastic help so I am hoping the same can be done again. My partner has got herself into an interesting situation. She is an NZ citizen who lived in Australia for three years (where we met), before moving to Scotland with me when my Australian VISA expired - 12/14. When she left Australia, she left behind approx. $1500 worth of debt split between a credit card and a mobile contract. At the time we didn't have the finances to worry about it as the move to Scotland was priority. Since 12/14 she has had no communication from the credit card company, and only one email from the mobile provider asking/seeking payment which was early last year. However today we received a message from a family friend of ours in Australia advising that they had been contacted by a company looking to speak with my partner, they claimed they needed to speak with her or her family about a personal matter and wouldn't give any other details (apart from her fathers first name - which was weird). From checking the forums and contact number I now understand this to be Credit Corp. My questions to you brilliant people is - they clearly have limited info on her whereabouts, should we make contact with them and try and rectify the debt, or let it go away? Her main concern is that she is on a 5 year VISA here in the UK, after which she will apply for residency and we're not sure if that would affect it. Can they pursue it in the UK? I've read some of the previous threads on here however her case is a bit specific and I'm looking for a clear answer. Any help would be greatly appreciated. I 'm off to bed now (23:20, 3/5/16) however will be available to answer any questions tomorrow morning.
  3. Hi My company ceased to trade in September 2014. In February 2015 all accounts were closed. Due to the nature of the business there are no assets and the registered address is my home address. In June 2015 an application was made to strike off the company and in September 2015 this action was objected to by HMRC due to outstanding corporation tax. Since then I have had numerous letters from HMRC (I replied stating all the information above in October 2015 but no reply) and then from a debt collection agency. I called the agency and explained the situation and they told me that because the status on the Companies House website was 'Active- Proposal to strike off' and there were no assets the case would be returned to HMRC. I didn't hear anything for another month and then today I recived another letter from the debt collection agency, again I called and this time I was told that HMRC had informed the agency that the company was still 'Active' and the debt should be persued. I really don't know what to do next, I haven't heard from HMRC following my letter of October 2015 or since Companies House since September 2015. The debt outstanding is £8700. The agency said I should write to them with proof of what I have been saying, but I don't even know what to send them. Please help. Thank you.
  4. Hi, Looking for a little advice on how to proceed,I I have received a CC claim form from Amex\Brachers regarding an outstanding balance on my former Amex Corp Card. I got made redundant in January 2014, before leaving the company I submitted my remaining expenses to the company for payment (The company paid Amex dues directly). I calculated my personal expenditure approx £2500 and paid this directly to Amex in February 2014 and I received my redundancy payment at the end of February.2014. In March I received a letter for late payment charges on an outstanding balance of £4415.41, I responded to them that I had submitted expenses to cover this amount with my former employer and did not hear anything else until April where I was contacted by Amex claiming to be the debt recovery department and asking when I would be settling my outstanding balance. I explained as before that i submitted expenses to cover this amount, and that they should take the matter up with my former employer, after a lot more call repeating the same information, I attempted to contact my former manager, the personnel department and the expenses department via the contact method for ex-employees. After a lot more emails (the only method on communication they accept) It was confirmed that my expenses although submitted were not paid as my former manager who is from Belgium had declined to approve them . My manager has refused to comment on this despite email phone calls & Txt's. The personnel department will not get involved as I am now not an employee. I repeated this information back to Amex who said they would contact my former employer for clarification, I was then sent a list of statements by Amex detailing the outstanding balance and a demand for payment and a hefty interest/latepayment charges. This conversation has continued and continued, Brachers then got involved and even suggested that I should sue my former employee for the money ! I am not in a position to pay the outstanding amount, my former employer is refusing to get involved, I have also learnt that former manager has now left. I am getting nowhere. I am still out of work with many other debts starting to pile up and this driving me insane. Any ideas on how would i file this as a defence for the CC, would this be accepted as a defence or am i wasting my time get the ccj and offer a £1 a month until restart work (hopefully soon).   5. I lived in Australia till 2010. I was using a Credit Card and making all payments on time. Then in 2010 i moved back to India, and i do not intend on going back to Australia. I was making regular minimum payments till about 2013. Then my financial circumstances changed a bit and I was not able to make any further payments. I wrote to the bank asking for assistance in financial hardship, which is a facility that they provide. However my request was rudely rejected. I stopped making the payments, and I got reminders and legal action threats and so forth. I would get call early in the morning, however I did not answer any of them. This went on for a while and then they sold my debt to a collections company and on behalf of the bank they started contacting me in a rather aggressive way. Again, this went on for sometime and I got notices from the bank and the collections company about threats about legal action and so forth. The disturbing development is that, they got my work email id from somewhere, they may have tracked things down from social networking sites or pulled out details from the IP Address or something. I got an email this morning about some offers in settling the amount. I am still not in a situation to pay them back, I want to enquire the following details 1. Since the debt has been sold to a collections company, what can they do to pursue the debt here in India? 2. If they decide to sue me for this and get a judgment against me, what implications does this have on me residing here in India? I am not a resident of Australia. Do civil court judgments have any sort of jurisdiction here? 3. Would they call up my company and harass me? What can I do in such situations? 4. Is it a crime? Would I be punished for it? 5. Should I change my number and address where I live? However I cannot change my work location, now that they have the official email address. 6. If i get a legal notice from the court then what should i do? Could you please elabote on the answers?
  6. Hi there I am looking for some help/advice please I returned to the UK approx 18 months after living in Australia for 4 years in NSW. I had a couple of credit cards still owing when I left. I received a phone call from Credit Corp this morning chasing $7500 on one of the cards (ANZ credit card). They were really horrific to me on the phone demanding payment in full by Friday this week. I told them that I couldn't pay this and they eventually offered to set up a payment plan of £400 per month again which again I said I couldn't afford. The guy got very angry saying that he needed to secure a payment plan with me today otherwise they would consider handing the debt over to a UK agency. He finished by saying he would email me my options and needed an answer in 24hrs after I had looked into my financial situation. Realistically I cannot afford to pay more than £100 per month after reading some threads on here I wonder what the best course of action can be. Would they hand this over to a UK firm? Is this legal if it is an Australian debt? He also said that if I offered less then £300/month on the payment plan they would need to see my UK bank statements, pay cheques and outgoing etc. ...Are they allowed to ask for this? Thanks guys for any help you can give me.
  7. In 2004 I left Australia & returned to the UK. I had an Australian Virgin Credit Card & provided them with my address & contact telephone numbers in the UK. I continued to make payments from my Australian bank account until it was closed in September 2004. I contacted Virgin by telephone & post to ask how to make payments from the UK, no response was received. Correspondence & statements from Virgin also stopped. In October 2009 I received correspondence from Stevensdrake solicitors saying my debt had been sold to Credit Corp and they were demanding full & immediate payment of the debt which had risen to $7208.62. I managed to agree with them that I pay £100 a month but they then wanted it increased to £500 which I couldn't afford. The statements they sent me were irregular and incorrect and they became very threatening. I stopped making payments in 2010 and eventually in 2012 after involving the Australian FOS etc Credit Corp agreed that I could pay the original debt of $3882 minus what I had paid in 2009/2010 in £100 monthly instalments and I gave them my card details to make the payments. They never actioned the payments and are now again asking me to pay the debt in full which is now over $8000 again. As the debt is from Australia and from 2004 do I still owe this debt?
  8. Hi guys, I have been reading over these threads with much interest over the past week. My situation as follows and any tips, help greatly appreciated. I have 2 alleged debts in Oz,16 000 au, last contact with original creditor "which bank"was feb 2007. Alleged total of debts by Credit Corp in 2013 is 25000au. They only contacted me about one debt then, they tried to bring the other into the conversation many weeks later.I have not heard from credit corp for 4 years, until now, I have been in the UK since March 2006. Credit corp has entered a county court claim through Stevens drake. I have replied contesting jurisdiction, I have also just made a misconduct complaint against credit corp with asic. I am yet to enter my defence for the jurisdiction, I have a week left to send it in, any pointers or experience in these matters would be greatly received. I have not entered into any dialogue at all with stevens drake. In 2008 I had brief conversations and an email exchange with credit corp. I admitted to nothing on all occasions and I never signed an agreement or paid them any money. look forward to your replys.
  9. I am in a dmp and struggling to keep up with the payments. At my work, my job has changed a bit and i now have to travel quite a lot. They are not keen on giving me advances and have advised me that I need to apply for a corp card (amex i think) to pay for my expenses, I am worried that due to my previous credit history that I may not be given one and also that amex could transfer my personal debt on to the corp account to get their money back. Please could anyone advise if this can happen and also any other pitfalls that may lay ahead. Thanks in advance!
  10. In 2005 I had an Australian credit card in Australia and then moved to the UK that same year. In 2010 the credit card company passed the account to Credit Corp and as I have been living in the UK since 2005, they used all their tricks to intimidate and harass me over the phone, calling at all hours, demanding I pay in full, asking me to access my superannuation etc and when I didn’t settle the account they then transferred it on to Stevensdrake - I was advised of this by an email from Credit Corp. Stevensdrake then sent me a letter advising me that they act for Credit Corp and requesting a good faith payment. Since then, almost all communication with Stevensdrake has been email. Uninformed and scared of legal proceedings I immediately made a good faith payment as they requested – and have continued to make monthly payments. I haven’t ever received or signed a contract but I fear that the emails and my payments constitute a contract. In addition to the payments I have written in emails things such as ‘I am trying to secure funds to make an offer of payment’ and ‘I will make payment each month’. Acknowledgement by me of the alleged debt was under duress and was uninformed. Reading other threads, I also havent received notices or any letters from Credit Corp - just the bullying phone calls and then an email. In my emailing with Stevensdrake have i put myself in the position of a contract? Any advice very much appreciated.
  11. I would be grateful if someone could advise me what my next step is as I am being chased by Credit Corps for an outstanding St George Credit Card. I left Australia in December 2007 and my husband (now estranged) was supposed to continue payment in this credit card and two other loans. He has since done a disappearing act and has not paid off loans. I was first contacted in Oct 2011 by letter at my work (I was still using my married name which is very unusual and easy to trace.) I ignored the letter but they then sent me an email which I responded to say that acknowledged the loan (A stupid thing to do now I have read the forum posts!) but was trying to find my husband who I felt was jointly liable for the loans (although they are in my name). I agreed to call them but then never did. In the email they sent a Notice of Assignment of the debt. I have since been sticking my head in the sand, until I recieved an email from them saying that I needed to pay in full or arrange a payment plan or they will pass my case on to a UK debt collection agency. Again I stupidly acknowledge to debt in an email but asked for time to resolve the matter. They have insisted that I respond to them by Friday or they will pass the matter on and therefore substantially increase the amount I owe. I am about to change jobs and therefore email address and as far as I know they don't have my address or telephone number. I don't have any assets and live with my parents, so paying the debt in full is out of the questions. I worry that if I pay the debt in monthly payments and then the other creditors chase my I will be overwhelmed. Should I ignore the emails, declare myself bankrupt in the UK stating all loans outstanding, ask Credit Corps for further documentation or start to pay of the money. Any advice would be very much welcome as I don't want to make anymore mistakes in dealing with this.
