  2. I am currently with Sky and I have just been advised that my monthly payment will be increasing by £5.50 from 1st June I have Sky+HD Pack with Variety, Sports and multiroom. Considering switching to Virgin, in which I have broadband and phone with. Can any Virgin uses advise what the best package that is on offer at moment ? Thanks
  3. Well the transaction list that I received actually stated total insurance amount paid from 1991 to date. It also included other payment / interest totals to date so I trust that is what you received otherwise I would be asking Next for further details. It was headed 'Account Enquiry' sheet under my Next Account number. I also sent an SAR to First Assist who were the policy administrators in which I also received policy wording details.
  4. Hi rosequeen, Mine was from 1991 but I was lucky enough to have old statements proving insurance payments. Did you not receive a statement of account with your SAR ? I requested and received what looked like a computer orientated screen print with ppi total, claim totals etc for the whole account. Maybe go back and ask for further details Keep forum posted. G/L

  6. Thanks again Martin. Yes I have an ongoing separate PPI complaint with the Ombudsman. I was just looking at the legality of my Secured Personal Loan Agreement and only states variable against the APR and Rate of Interest figures. When I looked up other examples of Welcome agreements, I also see that they have applied the same on fixed-sum loans, so I am confused. Sorry for silly questions but should my agreement not be headed-up so to speak that it is variable ? Does fixed-sum apply to the actual amount repayable including interest ? Cheers
  7. Ok cheers martin so that confirms that then. Silly me forgot that it was variable and not fixed In respect of statements Welcome admitted that it was a glitch in their system / IT error and failed to send me any statements between 2008 - 2011. Just checked T & C's so no mention of fee amounts anywhere. I am paying interest for the term of the loan for an acceptance and MIF fee.
  8. Well the statements are advising different credit amounts and assumed this was a breach of prescribed terms. The agreement does not advise total charge for credit figure (Acceptance fee + MIF fee + interest) , no mention of any default charge etc amounts, fees are a charge for credit and should not be included. They have been included in the total loan amount stated. There is also no mention if early repayment figures. Correct me if I am wrong but I have read older posts where the above were not correctly stated in which agreements / legal charges unenforceable. Thanks
  9. Sorry don't know why agreement did not attach. No agreement number or WFS dated entry ? In addition to the above, we only actually received funds for £12,000. Therefore I am sure the prescribed terms of the amount of credit is incorrect and misstated. Further comments to all above would be very much appreciated. img516.pdf

  11. Can someone kindly confirm what figure should be advised in the Amount of Credit Provided at the top of CCA 1974 regulated annual statements ? They also state AIR% and not APR% - Is that correct ? I have reviewed some recent statements and I have come across 3 different figures, one the Creditor advised was due to a IT hitch ? My figures are :- Amount of Loan / cash advanced £12,000 Total Cash Price / PPI £2,142.43 Amount of Credit £14,142.43 Acceptance Fee £235.00 MIF £1,320.00 Total Amount of Loan £15,697.43 And would also the above be a breach of prescribed terms ? Thanks
  12. Well I was going to start a new thread but as it is in relation to my SAR / Account complaint, I will continue this thread. Today I received the attached response from yet another FOS adjudicator My original complaint was for witholding information in which was eventually received after numerous requests. Lack of statements, NSOA letters and when statements sent incorrect amounts showing due to IT hitch in Welcomes systems. Therefore figures including added interest incorrect. I know that I was not part of the scheme as my loan was pre 2005 (Nov 2003) but was GISC regulated as had this confirmed by FOS / Welcome, so I find the latest comments irrelevant and feel that my complaint has not been investigated properly. It has taken FOS nearly three years to come to this decision and they have stated that I have until 26 March 2016 to respond regarding referral to the Ombudsman. If I am missing something or mis-understanding comments please can someone kindly advise. Just really want to know if I have misunderstood anything regarding our November 2003 loan in which was regulated by GISC. I know that WFS are not lending but did they not set aside a trust fund for policies / complaints pre 2005 ? Thanks for looking img529.pdf
  13. So what else can be done to obtain the information martin ? If a person can provide the agreement for the ppi complaint yet the bank cannot, is therefore their responsibility to prove otherwise ? Maybe something to discuss with either the ICO or the Financial Ombudsman perhaps.

I have today received a letter from Welcome (Nottingham address) advising that as from 21st March 2016 my secured loan will become a mortgage with the implementation of the Mortgage Credit Directive (MCD). Does this apply to 3rd charges on the mortgage ? As my previous agreement was CCA Regulated, will a new agreement be submitted with relevant T & C's ? I also have various ongoing account disputes (lack of statements / Notice Sums of Arrears etc under the CCA 1974 agreement in which Welcome have still not responded to and others with the Ombudsman. Will these still have to be honoured under the previous agreement ? Are Welcome Financial Services Ltd still trading as Welcome Finance (Reg No.133540) ? Thanks for any input. Cheers
  15. So frustrating, so I would be interested to know what to do next especially obtaining archived information. Did you send a CCA request ThedaBara ? Had any response from the CEO ?
  16. Hi ThedaBara, Sounds very similar to my experience with them. I sent two SAR's to Canary Wharf and Coventry address's, both cashed my cheques but could not find anything. I even sent bank statements, account numbers and agreements yet they still requested further proof of who I was. Paid for my details to be verified and then they just sent a further response to say that they had nothing ! I complained to the ICO but they eventually responded that HSBC had done all they needed to do ???? Hence why I was interested when I read of the success post.

  19. Hi tedney, Solicitor balance was that for judgement and in which I have an agreed monthly payment plan and has been decreasing appropriately with no interest. Submitted SAR to bank a while back as never received any statements for current / OD account for many years. Not only did they not tell me about account being downgraded but on checking copies of statements once received they were still adding quarterly interest and therefore balance had increased. The bank were very quick in turning an unsecured loan / OD into a secured loan, even though I was making what monthly payments I could afford at the time. I even requested that interest to be frozen but they declined, even though they were aware of my financial hardship. Eventually a monthly payment plan with bank was agreed but after about 6 months they demanded a ridiculous amount per month in which was more than my original monthly payments, hence application of eventual CCJ.
  20. Thanks citizenB Could you kindly advise where you found this information ? Tried to click on Attachment but will not allow me to look at. Ok so original lender is Bank of Scotland (1st charge). 1st Secured Loan / 2nd Mortgage is BH (2nd charge). 2nd Secured Loan / Personal Loan is WFS (3rd charge) with restriction on LR. Am I correct in saying that BOS entered the restriction and therefore no consent was required for WFS to enter their charge ? Just trying to get my head round all this thanks.
  21. I hope you are right sleepingdog but let me know when you get statements from bank. Also did you get a statement from Solicitors ? Maybe an idea to request one if you didn't. I done the same and Solicitors was as I thought but bank balance outstanding amount was much more as still added interest. Good Luck
  22. We have a joint mortgage and the secured loans are in both names. The first secured loan is a is a second mortgage, the second secured loan is a small personal loan on the agreement and in both names. Cheers Baz
  23. ok thanks again citizen That's why I was asking and that was my understanding as it seems that WFS have put a restriction on the property on outset of loan ? Do I need to contact the Land Registry do you think for confirmation ? A little confused as to why they have done this ? Perhaps someone else may be able to add some advice. Cheers
  24. And I bet the statements will have interest added when received and balance will be different to judgement amount. I will be subbing with interest as I have a similar issue with same bank / solicitors.
