Hello,

My ex-husband works self-employed and pays into the Spanish System. We are seperated and I live with my 2 children in a jointly owned (mortgaged) home. Ex-Husband lives elsewhere. I do not pay any of the bills towards the house. And am not able to work.

I receive LTIB from UK and my prescriptions are paid by the UK. I am also in receipt of the EHIC card. My 2 children obtain medical care through my ex-husbands contributions, but I do not and have a red medical card.

I am 43 but am classed as a Pensioner here in Spain. Whilst my Spanish Health card is Green, most others are Red. Is other peoples cards red because they pay into the system, and mine is green because I don´t.

Or would the fact that I live in a property that has my name on the deeds have triggered. I would assume not as people have "Holiday-Homes in Spain and elsewhere but the UK are still their competant State"

Is the UK still my compentant State, as I have personally not triggered the legislation of another relevant State by some economic activity, e.g working in another EEA State, i.e Spain.

I'm sorry GS, I have no idea about this. I have found this though. Is that of any use to you?

My advice is based on my opinion, my experience and my education. I do not profess to be an expert in any given field. If requested, I will provide a link where possible to relevant legislation or guidance, so that advice provided can be confirmed and I do encourage others to follow those links for their own peace of mind. Sometimes my advice is not what people necesserily want to hear, but I will advise on facts as I know them - although it may not be what a person wants to hear it helps to know where you stand. Advice on the internet should never be a substitute for advice from your own legal professional with full knowledge of your individual case.

Please do not seek, offer or produce advice on a consumer issue via private message; it is against

forum rules to advise via private message, therefore pm's requesting private advice will not receive a response.
