I received a letter from BT stating I owe them 264.71

 

I previously took my broadband from them and went across to EE on 24/11/2016

 

I am not disputing that I owe them money the issues I have are that they are charging me for a few extra months after termination and they have now sent my debt to Fredrickson international LTD to collect.

 

BT have said they have added a charge of 25% to cover the cost of handing over the debt,

 

Should I contact BT or wait until I hear from the debt collector?

you can ignore the DCA

they are not bailiffs

and have no such legal powers.

 

 

theres no legal remit that allows BT or indeed anyone you owe money too

to arbitrarily add anything to a debt just because 'xyz' had to happen..its a penalty

 

 

and under FCA CONC rules such penalties are unlawful.

 

 

as for the termination date and months upto end of contract and after..

there should be a fixed remit, i'e you or they cancel, you only get charged 1 month more.

 

 

there have been numerous cases that various DCA have taken to court

none have been won buy them concerning monies owed to end of contract or additional months or fees because they rolled it over..

 

 

Subject to the above, should the alleged amount claimed include an early termination charge(s) amounting to the total balance of the remaining contract, OFCOM guidance clearly states that any Early Termination Charge, that is made up of the entire balance of the remaining contract, is unlikely to be fair, as it fails to take into account the fact that the provider no longer has to provide and pay for their service.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Ignore the dca. They have no Legal rights and can't do anything. Contact bt and arrange a repayment with them.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

And tell BT the 25% surcharge is an unlawful penalty that you will be asking the FCA about.
