payday overdraft are loans sharks ;extremely rude people . I defaulted a while ago and 2 months after, they were asking me for £1600 for a loan of £200 . I chose not to give in to their bully tactics and go to court and it is looking good . They have been ordered by the judge to send their witness statement wich explain how they came up with £1400 interest in 2 months) to the OFT. The judge also stayed their claim which will be struck out unless they provide good grounds for reconsidering the validity of their default notice ( which was deemed invalid by the judge ). Also, it is ordered that : OCOI order to comply with CPR 3.3(5)/(6)and FPR 4.3 and 18.9 (FPRPD 18A.13.1) ....... Could anyone explain that last bit ?

Stand up to the bully and go to court ...... It's a guaranteed winner

I actually never went to court as the judge just made the orders by the reading the facts .... The person which sent a witness statement was Ali Sethi, curiously I have never dealt with him before or even heard the name; I guess one of Hart associates or shall I say goon ?

Ali Sethi? Hope that’s not a joke by him... Do you have a copy of the WS? Where does Mr Sethi say he’s from?

That’s a bit like you having Salman Rushdie as your brief.

(Edit: Just checked Law Society – he’s not a solicitor.)

They are just doggy peoples trying to get rich at the expenses of honest people. They are no different from burglars or muggers . Anyway they've got till mid march to give a good reason or their claim will be strucked out . I really doubt they will be able to give a decent explanation to the judge.

If their claim is strucked out , can they take me to court again ?

Not sure how ‘real’ the name is though. May be a pseudonym. Bit like me calling myself James Bond (which, of course, I only do on Friday nights in high class establishments).

Kept that quiet, didnt you DB..

I have also spoken to Ali - he is real. Whether or not his name is Ali i don't know.

I received 11 separate emails yesterday from Ali saying he no longer works for Payday Overdraft.

This just goes from bad to worse really. The only Ali of that name I've been able to find is the rather famous author - I do hope the name isn't some sort of joke or wind up.

It's all too odd for words really.
