    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am in the process of requesting CCA's and would like to get my credit report to compare the report to the replies i am gonna get from my creditors. however, the creditors dont always use the same agency to get their information from and supply default information to. (please correct me if this statement is wrong) Which credit reference agency should i get my report from and is the £13 report that these companies do over the net the best report to get? thank you in advance for any help you can provide.

i would get both to be honest.

 

you can obtain report via post for a statutory fee of £2

 

i know experian has a service called credit expert which gives a month's free trial (you have to register a card, be sure to cancel it within the month if you wish not to pay)

There's honestly no point paying more than the £2 statutory fee - you still get an explanatory leaflet and we're more than happy to answer any queries here.

 

Don't fall for the CRAs marketing tricks.

  • Barclays: WON!!! It took four months but was totally worth it!
  • Cabot: I'm still waiting for an enforcable agreement, more than a year after requesting it. Go on, Uncle Ken, take me to court if you dare. You know you want to!
  • Elephant.co.uk: VICTORY - they admitted there was no debt!
  • Ashbourne Management (gym membership): Finally got my default removed and out-of-court settlement; I'm not finished with them yet!

thank you. in process of requesting them now. have also sent CCA requests for original documents. i'm bouncing off walls and wanting to be able to do more NOW but i have realised i have to be patient and wait for all the information to be sent back to me or the 14 days period to have elapsed. if however there is anything i can do in the meantime then please advise me.

My son has tried to get his credit report from both Equifax and Experian.

 

Experian - filled in the form and got as far as trying to confirm address when told that couldn't go any further, please call a number. Called the number and told them that he didn't want to continue the service beyond the 30 days so please cancel his card. Haven't had the free report from them yet (6 days so far).

 

Equifax - started filling in form but couldn't progress as site kept insisting that his surname wasn't "valid". We have a two word surname without a hyphen which seems perfectly OK on birth certificate, electoral roll, passport, building society account, etc.

 

A bit of a Catch 22 as he can't register to request a report and both phone help and email require you to register - looks like snail mail is the only route!!

i would suggest using checkmyfile - Credit reference, Credit file, Credit score, Rating

they allow you to view and monitor your credit report from all 3 CRA's Experian, Equifax and Callcredit. price isn't bad, £5 a month.

I use them too. It gets updated once a month. You can compare all three reports and see which companies use which reference agencies.

actually, i have had to put in a complaint in about the three report thing, been paying the 5 quid a month, yet only get reports from experian and call credit, equifax are wanting my signature (?) dont know why,(do they own any dca's), this is the only reason a can think of for them wanting my signature. emails to and fro, to check my file, basically saing i want what i am paying for, them saying it is their right to ask, me saying, i dont think so.......been going on since july.

thats strange! When i applied for my account i got access to all my reports within a few mins!

 

With regards to some cra's holding some info and others not, thats precisely the reason i chose to use checkmyfile as they allow you access to all three reports, means you see absolutely everything on your reports, no nasty surprises to come!

Credit File Says I Must Supply Signature And Verification Of Last Address(cannot Coz Lived Homeless At Friends House,for 2 Months, Prior To This Was In Womans' Refuge) For Equifax . Then I'll Be Able To Access My File.......so I'm Thinking Of SAR To Equifax , Credit File Know Who I Am, As They Are Getting Paid Monthly From My Own Bank, Therefore I Cannot See A Problem.

But Like I Said, Some Credit Ref Agencies Do Own Dcas...........

Can anyone give any information on checkmyfile.com? I mean, if i buy reports from them, will i see all the 3 agencies report seperately or do they just combine them all and give me the results?

 

I already have obtained my equifax and experian credit reports on 30 day trials. However, i am looking to repair my credit scores and will need to check my reports frequently during the next 3 months or so and dont want to pay £66 for that to equifax which they will charge after the 30 days. And experian only charges £6.95 something.

 

Can anyone please tell me whether chekmyfile report is good or not and most important thing is that, do they show the reports individualy? Like lets say; Report 1: Experian, Report 2: Equifac, Report 3: Callcredit

Or is it like: Report Combined from 3 agencies: Checkmyfile

If you're unsure which credit report to get, then look at this link:

It shows a table which details the credit reference agencies (CRA's) that credit card companies, banks, lenders etc. are using..... best to pick the CRA's where your credit data has been filed...... or, if you're applying for credit, then get a credit report from the CRA('s) where the lender gets their data from.

 

Also, Rather than paying the £2, you could get your Experian & Equifax credit reports for free. You simply need to register for their credit monitoring service (£60 for Experian Credit Expert or £69.99 for Equifax Credit Watch Gold), and then cancel the service within 30 days (it won't cost you a penny then). Both services are available here:

I know that for the Equifax service they simply verify your card for payment at the point of ordering and wouldn't charge it till the 30 days is up (if you haven't cancelled by then)..... it means you'd get the added benefit of their credit monitoring for a period then + of course your credit report is available online (Statutory credit reports can often take weeks to come through).

 

I know the Checkmyfile report seems good, but it doesn't seem to have full information from Experian included....... not entirely sure what's missing (it says only public credit report data is provided).... Maybe some checkmyfile users could shed some light on this for us? Also, it's not in 3 seperately identifiable reports (Experian, Equifax, Callcredit) it's all in their own format.

 

I guess it all depends on what it is you're looking for from a credit report really as to whether or not that's the best option over the seperate Experian, Equifax & Callcredit ones?
