Have the poops actually got any civil servants to agree to go yet - probably end up as more massive payments to VIPal contractors to go and sit there doing nowt shortly eh?    
    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Actually I have just found this on my terms and conditions:

 

2. Acceptance Fee

In order to ensure as far as possible that you will be able to meet yor obligations under the loan, we will review your income and expenses, including any current indebtedness and other outgoings. The acceptance fee will be charged to you, by being included in the total advance to cover this credit counselling.

 

so I guess here they are saying they have included it in the total amount of credit and therefore can charge the interest on it ??? :confused:

No they cannot it would have to go into the total charge for credit as it would be a compulsarry chaharge.

 

BIg differns one is lawful one is not.

 

If they have done this the correct way the TAP would rise by the amount of the fee but the total credit would stay the same so the total charge for credit would have to go up because tcc+tc=tap

my statment of price was what threw me! £43 per month just for PPI over 180 months..Bit if a shocker! Considering I was only covered for 60 months and the term of the agreement is 180? Hmmmm

Peter, you have no idea how happy and relieved you have made me!! I thought I was going to be stuck paying this for another 4 years! What should I do now? Can i ask them to clear the debt? or just stop paying citing the reason you gave me? Can I still claim back PPI I believe was missold? Thanks for your help

What gets to me, is in my statement it shows only £3.72 acceptance fee. Should be £275 upfront but multiply over 180 months.

 

Break down is £669.60 over the term of my loan? Surely this is incorrect?

 

And the broker fee (DONT GET ME STARTED!!) £2138.40 over the term of the loan!!!

 

The PPI is over £7K

 

It all adds up over time!

 

Peter does the statement of price have any bearing on the actual contract?

Hi Peter, I have arrears of £1,200 from late fees , telephone calls and letters (I was only told about these 4 weeks ago when I asked if I had any) over the past 6 years. I wrote a letter of complaint to them 2-3 weeks ago regarding the late fees, acceptance fee added on, and PPI I believe was missold. I told them I wouldn't be paying last month (£231) until I got this sorted. It wasn't sorted but when I contacted my local office to tell them, they said I had to make payments as contracted, so next week I owe them 2 months. They also have until Tuesday to comply with my SAR. If you could help me out with advice/letter I would really appreciate it because I am a bit unsure of how to continue.

I want to get a letter drawn up to reclaim the charges imposed to!

 

Like the banks they are in court for cost of charges. Why shouldnt Welcome be in the dock? £25 for a letter -Give me a break. And £10 for a call. Doesnt add up. So I am hoping to have a nice letter and Ill be the first inline to take them to task on this.

 

I have seen someone with a £1000 loan from Welcome with £1500 worth of penalty charges!! Shocking!

Hi Peter - they have put it the correct way on the agreement. The TAP does rise by the fee amount. but what I am concerned about is the fact they have added the fee to the total amount of credit and then calculated the interest charge:

If I put £13740 in loan calculator at 30.45% I get £26239.07 not the £26689.47 that is on agreement for interest charge.

 

If I put £13975 (total amount of credit + acceptance fee) in I get £26687.85 for interest charge which is close to interest charge on agreement and within a penny of monthly payment.

 

However onto this £26687.85 it would appear they add the £235 again to get total charge for credit = £26924.47????:confused:

 

Now I am not sure if they are allowed to work it out like this ???? the agreement on the surface looks ok but when you work out figures it does not make sense - I am so sure I have just confused everyone myself included :D

On The Computer Screen Shot Notes, The Name Of The Operator With Call Details Should Be Listed,

 

On My Old Notes Only The Charge Was Listed,

 

They Can Just Dream Up Any Charge, Apply It To Your Account With No Proof Of The Call

Post - I really do appreciate the experts taking the time to look at this for me - I have tried to work it out myself (Maths was my strongest subject at school) but can't get my head round it. Welcome think they have stupid customers (this couldn't be further from the truth) and as you say rely on their confusing agreements so it helps to have the experts take a look and offer their advice :)

Peter i would appreciate if you could cast your eye over my oh agreement and mine, the 2nd one is mine but was rewritten in 2008 without ppi, first one was signed at home by post with ppi boxes ticked ready, thank you
