    • We purchased our Mercedes in September 2023 from Doves in Horsham for £21000, paying half cash and half on finance. We also purchased warranty for life via Ramp as recommended by Doves. On 12th May 2024 the car failed to recognise the key and wouldn’t not open, the AA could not identify the problem so via our warranty the car was taken to Mercedes in Croydon. After 3 weeks the problem was finally identified as water ingress in the drivers side footwell which has corroded and blown various components. After further investigation it was discovered the windscreen was date stamped 2019 (all the windows are 2018 - therefore not the factory fitted windscreen) The leak has developed due to incorrect sealant being used assuming when this was replaced and also water leaking from the seam. The warranty company do not cover water ingress so we are now faced with a bill of £3635. As we are now at 8 months since purchase (problem started at just over 7 months) we are not covered by the consumer rights acts. Would we be covered Sale of Goods Act? We have all the reports for the works being completed but unsure if this should be taken to the finance company or Doves who we purchased the car from. Do we pay for the works and then try and claim it back or should they be paying? Any help would be much appreciated
    • im also wondering if back billing applies here too . from looking at like threads around this SSE to ovo compulsory switch, it must be evidenced by the claimant that bills were regularly issued for the period of the supply the debt they claim covers. there are no threads here that show they could ever produce them, so back billing rules (12mts) might also play a part.
    • Vodafone have reported that they are having issues with their Credit File APIs into the Credit Reference Agencies where aged accounts over 6 years are being readded to Credit Files. In some instances, people are having defaults rescinded and changed to late payment status making the account live again!    --- Have you been affected? Please keep an eye out on your credit file for any  new Vodafone Account appearing where there shouldnt be any reason. If you are a Vodafone Customer - Check that the information is correct. check for Late Payments and Defaults.    Don't forget to consider the financial impacts this could have on you.  ---   If you are struggling - Post below and we can guide you to get the result you need!    Its been reported that Experian and TransUnion seem to be where these appear.  They are able to remove the information relatively quickly and it will reflect on next Credit File Refresh.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just checked on companies house website. PROGRESSIVE FIANCIAL SERVICES CHANGE OF NAME FILED 01/012/2006 BECAME WELCOME FINANCIAL SERVICES.

 

They are even cheekier little swines, swapped names on 01/12/2006 check under changes of names for both companies!! Both still exist they just did a straight swap and registered now at each other previous address, or something of the like, well done b-o-2 for checking them out. I'm offski now, sleepy time, g'nite :)

Well Brassed-off I hope you find the info you need with the LR, I had already complained about the charge on property and if I am reading the minefield of instructions on how charges are placed, the gloucs was correct, a new charge should be issued every loan taken, or they can ask for the charge to include any security, but they have to amend this on the initial charge certificate as a note (don't quote me on that it is difficult to understand & I'm surmising this is what is meant)...they can't rely on the original only. LR in the wilds of bonny scotland are generally great, but they haven't yet confirmed that I get a copy of charge certificate, neither have they asked for payment so it can be sent, this should be straightforward, I'll be phoning them monday to find out why not, I just hope none of them were in Amsterdam watching us get hammered by the dutch :-|

The chap was really helpful, and talked me through all the form, what i needed to fill in where etc..it was form OC2, can be downloaded from LR website, and must post with chq for £10.00 fee.(not sure what would apply for Scotland though...)

I know it is going to be a minefield when it arrives, because i have another sub prime lender charge against my property and am persuing certain things with them too..

I have found wiki to be invaluable, when trying to dicipher the LR/property act jargon into laymans terms....

Sneeeeky! Why switch listings on credit agency's back to progressive?

 

Who knows. All I know is im waiting to get the nod on one or two things and im going for the kill.

 

I wont be doing this myself, I cant handle the wait time and the run around with Welcome.

 

Im going to do some reading then hit the sac. Night night all!

 

Going to be fun trying to convince my little she should go back to sleep for another hour in the morning!

It was but the most important question still has not been answered - when is Jenson Button gonna do something about his hair?? :D

 

Roll on Spain and the British GP - my daddy as a supplier to some of the F1 teams so he gets tickets - and that is one of the many reasons why I still go and see my daddy every day - keep in the good books :D

Yep they are all under the Cattles umbrella but progressive has been fairly dormant over the last few years whilst Welcome has been the main earner and doing all the dodgy stuff.

 

You will see accounts be transfering from Welcome to Progressive soon (it's already happening) but the accounts transferring will all have one thing in common!

 

Then my guess is Welcome in it's incarnation now will disappear like Cattles trying to lock the bad son under the stairs

cattles is trying to make its assetts WELCOME [ACCOUNTS] look attracive for people to buy,

 

they are in deep trouble and i would doubt survive much longer,

 

i can see not only welcome being history but cattles other partner in crime, SHOPACHECK being sold off,

 

if cattles does by a miricle survive, it will be out of the listings on the stock market,

 

corner shop operative comes to mind.

 

 

the aduit results are out tomorrow, TO BE CONFIRMED

but as its the start of another financial year, i doubt companies house would let them drag it out any more,

unless im missing something i cant see why the accounts are being transfered from welcome to progressive. Surely if the adminastrators and receivers are called in to cattles then it would not matter who they trade as because all the assetts will be liquidated and the loan book split between the creditors.......i did have a good night out and so im not feeling too sharp this morning.

I think with the right amount of money and some very smart accountants anything is possible.

 

Like I mentioned in the earlier post, they want to keep sweet with the bond holders, screw the share holders.

im sure that there was a post on the thread last week, cant remember who buy ,stating that according to some comments on the stock exchange forums the adminastrators were already in. I personally would like to see everyon get there monies back, put all the welcome employees on a remote island and then nuke the ba####rds

if they transfer company ownership and change company directors before this

happens,

 

get my point

 

to me it seems welcome are gone , history,

they are ring fencing its main assetts, welcome accounts [cattles] , by incorporating them in progresive financial services,

 

THEN PROGRESSIVE WITH THE WELCOME ACCOUNTS, AND MAYBE SHOPACHECK, BUNDLED TOGEATHER AND SOLD TO THE HIGHEST BIDDER,

 

AND CATTLES, IF IT SURVIVES, WALKS AWAY WITH A LARGE PAY DAY

 

STINKS I KNOW

 

BUT THIS IS WELCOME, SORRY CATTLES WE ARE TALKING ABOUT

Does anyone know the actual cooling off periods required for a secured loan and what these period are to/from? Someone said earlier it should be 15 but Welcome have been using 7 days.

 

Also the CCA 1974 covers loans up to £25,000, i take it thats before interest?

The Normal Cooling Off Period Is 14 Days

From what I can remember its 14 days, unless you break it! If they made contact within that time its a serious offence. Ill get the exact quote from the FOS website.

 

The 25k limit is charge for goods or the loan amount. Mine is 17k and with interest is closer to 40K, I would fall under the 25000 limit.

This is my understanding. Basically if you had to call up today and ask for a settlement how much would it be. Then gauge your line of enquiry around that amount.

My CCA says

 

'Under the CCA1974 you should have been given a copy of this agreement at least 7 days ago'

 

Is the 14 days set in concrete or can it vary?

 

If im not mistaken its 14+2 days for a CCA request. Im not 100% sure but if I am wrong im sure I will be corrected.
