    • Hello All, I was hoping for some help with a  Claim Form received yesterday 15h May 2024.  I have read lots of threads but I just want to check what I am doing. I have acknowledged service noting my intention to defend all of the claim and I have left the contest jurisdiction un-checked. I will today/tomorrow issue a CCA request with a £1 postal order to the claimant and a CPR 31:14 to the solicitor.  For the CCA which section should I use? I am not sure which section Paypal Credit would come under. If the claim was issued on the 9th May am I correct with my defence filing date of the 11th June? Is there anything else I need to do? Thanks in advance   Which Court have you received the claim from ? Civil National Business Centre, Northampton Name of the Claimant ? Lowell Portfolio I Ltd How many defendant's  joint or self ? Self (just 1) Date of issue –  9th May 2024 Defence filing date: Tuesday 11th June?? The debt was legally assigned to the claimant on 15-09-21, notice of which has been given to the defendant. The claim includes statutory interest under S.69 of the County Courts Act 1984 at a rate of 8% per annum from the date of assignment to the date of issue of these proceedings in the sum of £0.00.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I personally found this clip difficult to watch, although I did view it until the end.

Did I feel the slightest degree of sympathy for the 'victim', no.

 

He'll have an extremely sore and painful arse for a few weeks, so what. Not very much of a price to pay for all the lives he's destroyed through drug dealing.

 

What a shame Britain doesn't have stiffer punishments, but with so many do-gooders spouting 'Human Rights', we never will have. Coupled with a Judiciary that panders to the accused and not the victims.

I would have to say that people would not sell drugs if there was not a market for them.

 

Most people are not forced in to using drugs (in fact I do not know anyone who was), they just do.

And if they didn't they would probably drink a lot more!

 

Not saying I agree with drug dealing, but I do have a lot of knowledge about the subject of drugs.

supply and demand! smoking kills over 100k people a year and booze thousands more, some boozers go out and get drunk then want to beat the granny out of some-one,smac and crack heads will stab you for a tenner,exctacy(spelling?)users love every-one and dance all night,puff heads fall asleep and coke heads get paranoid, moderation is the key in all cases ,but mabey smac and crack dealers should be shot on site jezzy

Most drug dealers end up that way to support their own habbit.

 

I do know most dont set out for this path in life they fall into it, they start smoking pot and when thats not enough they look for the next high. Its a never ending tale each time looking for a better fix. More often than not their partners then end up using as well.

 

This is true life, yes my ex was a dealer.....i got out i was to strong minded for him...

As do I, but in a legitimate way. I'm a qualified Pharmacy technician and as such have frequently seen the damage caused by 'illegal' use of drugs, legal and illegal.

 

What exactly is your experience of the use of drugs then?

A large number of the crimes committed in this country are to fuel drug habits.

Alcohol use is not justification for allowing drug dealing.

Drugs destroy not only the users but their families as well.

Anything that interrupts the supply of drugs is OK in my books.

The WORST drug has got to be TEA.

 

I have YET to know of ANY crime/accident/murder/rape/major crisis etc where a Cup of TEA has NOT been involved.

 

All too often the victim is made to bare the brunt + doesn't realise TEA's involvement until AFTER the incident has taken place.

...+ by then it's too late to do anything about it!!!...;)

I was also in active addiction of heroin for over 12 years - now clean for 12 years.

 

My addiction did not cause me to go out mugging etc.

I strongly belive that a lot of behaviour is not so much caused by addiction, but to upbringing. Addiction may make things more acceptable, but your morals are taught to you at a young age, whether from parents or friends.

 

There is far more harm done by people drinking, to themselves and others.

Give me an addict rather than an alcoholic any day! ....... :grin:

Sorry... I can't even remember any of the above...! Stoping smoking, stopping the Coffee drug too..... Doing Cold Turkey..... Not the best idea! LOL!!

I TOTALLY agree!!

 

Not only is it difficult to get a decent drag from, when U light a slice up,

it also tends NOT to dissolve when U add hot water + makes a VERY lumpy alternative to coffee!!!...lol...:-D

What went wrong with the British Military involvement in Afghanistan then??

 

Wasn't one of the original reasons given for sending them, is that they would be able to help prevent the cultivation of the Heroine Poppy fields + end the scourge of Western Civilisation??

 

Is it NOT true to say that the latest harvest estimates, have put the yield at comparable figures to when there were NO NATO troops stationed there??

 

Is it also NOT true to say, that part of the political 'solution' in Afghanistan, which has been agreed by the British government on your behalf, is to condone the continued cultivation??

 

Have U written to your local MP + voiced your protestations on this issue??

Not all illegal drugs should be illegal, same as not all legal drugs should be legal. A lot of drug-related crime IMHO is down to upbringing, as someone mentioned before, and I'm sorry, but if anyone goes onto harder drugs from smoking weed then they're an idiot, plain and simple. It's only a 'gateway' if you're a moron and let it be.

I hope you don't mean weed, having seen first hand what it does to people!

It is not the same stuff I smoked in the 70's and 80's.

 

I used "harder" drugs for quite a few years and do not consider myself a moron.

Addiction is a disease, same as alcoholism, gambling, etc.

 

Please don't say it's about will power.

Do you know how much will power you need to have to raise money when you are ill.

 

Addiction af any kind is difficult for anyone to understand unless you've been through it.

If anyone is or has a family member who is I am happy to talk to you about how there are people who can help, in PM's or email.

You will not be judged,
