Hi Johnsworld , I am due at court on 23rd , and just wondering what you argued to try and get a stay removed , but more importantly you mentioned "you had some conditions on the stay". Can you help and let me know what the "conditions" were please?

It would be very useful if you could post what your local court has told you regarding stay on claims due to the OFT report. We dont need to know what the banks said, we all know they will just tell us that they have a stay and that is that.

I am Hoping that this list will help in our argument to have stays set aside, by demonstrating to judges that (at the moment) the majority of courts are continuing with claims on a case by case basis, which is a fair and just way to continue.

I also hope to raise the awareness a bit, it may give us all a bit of hope if anyone was fearing the banks letters were right saying all cases were stayed when in fact they werent.

Just dropped some papers into Plymouth Combined Court, the nice lady behind the desk informed me that they are automatically staying all cases pending the OFT result.

Lo' all,

 

Thought i'd try and help too.

 

Have managed to email 44 (Bcc) different county courts inquiring about the status of play on a court by court, claim-by-claim basis.

 

I'll post here the responses i receive.

At the moment all cases are progressing on a case by case basis, the matter sin this Court are only being stayed if both parties require a stay until the outcome of the high Court case, obviously this could change in the future.

The claims are being issued and if defences are filed then the cases are referred to the District Judge who will then give directions, which could include a stay

Rang the Warrington County Court regarding case in Runcorn County Court Cheshire today and as far as I can gather no cases being stayed here.

Have till 09-07-2007 to file Defence.

Have 28 days from date of Service to File Defence.

"Bournemouth County, Enquiries" to me

 

 

we are referring all bank charges cases - both those originating at Bournemouth & those transferred to us - up to a District Judge upon receipt of the defence. they are being looked at on a case by case basis to see if the particulars of the case fit the criteria of the test case and if so a stay order is being issued. when the rest of the test case is known these cases will then be referred back to the Judge for the appropriate order.

In reply to your question re bank claims, this Court operates a policy of referring cases to the District Judge once a defence has been filed by the bank. At this stage more than likely, the claim will be stayed unless the District Judge believes that the issue is more than a simple bank charge case

I phoned MCOL as one of the my claims is due to be defended this week and they informed me that as of today all claims that have not yet been defended will automatically be stayed and held by MCOL until the conclusion of the OFT case.

I have asked how/if we can appeal this decision, but at present there is no appeal route known. They are expecting further information next week.

The order came from the District Judge and i guess this will now filter down to the local courts in all our areas.

Typical, Banks power over joe public, no support from the judicial system, no support from the financial watchdogs, where are they????:mad: Only support is from ourselves collectivly, AND COLLECTIVLY WE WILL WIN!!!:cool:

Hi Guys,

 

Just to let you know that the Torquay and Newton Abbot County Court have made a General Order stating all bank charge claims are to be stayed pending the ressolution of the OFT test case. They are saying you have the right to apply for the stay to be lifted, and can do this only on a case by case basis. Has anybody challenged the stay yet and had it removed?

 

I suppose this is the bit where I now say 'Stay Posiive', so stay positive.

Update from Gateshead, they now say all cases are being stayed however ours (which is scheduled for thursday) may not be affected due to the satge it's at. Will know more tomorrow.

Was ta Morpeth today. Four cases all heard individually. Three were stayed but I managed to successfully argue against it using the objections posted elsewheree on CAG. Judge particularly liked the impact on my Human Rights under the EC Human Rights Act to a free and speedy trial.
