    • Just an update for all. I received about a letter every other week, increasing in threat levels. Then I hadn't had one for a about two weeks, then Saturday received a carbon copy of the very first letter they sent me in February. 
    • So, your response was not received by the SCP as you did not send it with a valid stamp. Therefore, from my two option in post #14, the first option is the only one available to you, but you do not have the option of asking to be sentenced at the fixed penalty level as the reason the SCP did not receive your response was down to you. Here's a reminder of what to do: Respond to the SJPN by pleading “Not Guilty” to both charges. In the “Reasons for pleading Not Guilty” box state that you are willing to plead guilty to the speeding charge providing, and only providing, the “Fail to Provide Driver's Details" (FtP) charge is dropped. This is a tried and tested method to deal with your problem and is almost always successful. Before the pandemic it was necessary to attend court to do this "deal" because it needs the agreement of the police prosecutor.. During the pandemic courts made every effort to have as few  people as possible attend and they began doing this deal under the "Single Justice" procedure without the defendant's attendance. Some courts have carried this procedure on whilst others have reverted to a personal attendance being necessary. If you are required to attend, your case will be taken out of the SJ procedure and you will be given a date for a hearing in the normal Magistrates' Court. If that is the way they do it in the area involved you will have to attend, see the prosecutor and offer your "deal" in person.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I had/have a bank account with HSBC (SORT CODE/ACCOUNT NUMBER) conducted on their standard terms and conditions. I am claiming return of money taken by the defendant in way of charges between (MONTH/YEAR OF FIRST CHARGE) and (MONTH/YEAR OF LAST CHARGE), total £(TOTAL). These charges are a disproportionate penalty and therefore unenforcable as they are contrary to common law. Me too.. if the postman would deliver before 11am then I could get the MCOL done now and issued today, but hey ho. Maybe I should sue Royal Mail for crap service? :razz:

No worries. It's a radio button thingy where you can select either you're the claimant or the claimants solicitor. Just click on 'I'm the claimant' circle button thingy and then in the box where it asks you to sign put your initials and surname. Simple as :)

mwah. thank you. youve helped make it so clear... maybe you could past your transcript thing on a moneyclaim thread??? it will really help others.

 

another questions... im about to fill out the spreadsheet for 8% interest and for some reason it says you need to know your actually balance at the point of each charge. i dont get this as the spreadsheet doesnt look like you need to know this info. just the date of the charge in order to calculate the days since charge. anyone done the spreadsheet for money claim and got their head around it. figures is not my favourite subject :-)

Depends what spreadsheet you're using. The one I've got just asks for item, date, amount - then it calculates the interest and days since charge automagically.

hi there, another fiddly bit in spreadsheet you have to put what the charge is. but although most are written clearly referal etc there are some at the end of month or when ever that just have a date next to it. how do i input these into the spreadsheet. they are obviously saying its a charge for going overdrawn or something on the date they have specified. any ideas.

 

Also ive noticed that the court costs are £80.00 is there anyway on moneyclaim site where you can get these reduced? Im only working part time and paying one of these £80.00 will wipe me out let alone two( at same point with natwest as well)

Elaboration on last post. ..... alot of my charges are at the end of the month and state " total charges to 16 jun 02" and there are alot of these. so they probably represent going overdrawn/overlimit but they dont state defintely what they are for so should i just put total charge etc in the " in respect of" column??

just wanted to check a couple of things before i file my moneyclaim.

you apparently have to list charges. mine are all down as total charges for going over overdraft. so when you are to explain the charge is that explanation enough as its very non descript.??

also can you get a reduced court charges on moneyclaim as £80.00 is alot of money to pay out. can someone whose been there give me an answer please so i can proceed.

Hi Jade,

 

When you wrote your preliminary letter and letter before action, did you attach a spreadsheet? If so, what did it contain? Your charge descriptions are very non-descript as you said, within your statements you should see inidividual figures that make up that 'charges to xxx date'. You'll need to use those, as opposed to the total charges each month.

hi there thunderpuss. thats the thing the "total Charges 16 jun £72.00"type thing is additional to say the charges for unpaid DD/SO. so thats why im unsure. I did send them breakdown of charges with prelim but at that time hadnt seen the spreadsheet and so just put the charge and the date. this is why i am unsure of what to put in regards to the charges when it comes to moneyclaim

Just type in total charges, date and amount. That's what I did and they've paid me. They are charges for going overdrawn with no OD or over your overdraft, they will range from £25 -£125 and definately are claimable. I know that you can get help with court costs if you are in receipt of certain benefits, don't think you can do this online though, you may need to go to county court and fill in form N1.

hi there everyone, my question is now is it still ok to put a claim in.?

The LBA deadline for both this bank AND natwest was 25th July. I will now have money on Tuesday 8th August in order to pay £80.00 court costs fee online. Is this still ok? I know i was meant to do it straight away but financially i couldnt.

 

just hope that it still counts.

another question. ive just applied for a parachute account with coop bank.

why is it they treated me like a full account type customer wanted all financial details etc and work details and said they would do a credit check?? Which because of my difficulties and charges with credit cards i will have a bad credit rating. meaning i wont even be entitled to a basic account. why is this.

anyone else had any problems.

 

i applied for one with barclays originally and for their basic account it was just a simple form with hardly any financial details at all. though if they run their account like they do when you try to open one...well.

 

i applied for it. a month and a half later after sending all relevant details and filling in all forms. i still hadnt had a card or no or anything i phoned them and they said they had no recollection of me applyng for the account. wasnt until i sent photocopies of every correspondence they had sent me to them that they then apologised and sent me account details... now im waiting for the card two weeks after that.

its terrible. if natwest (my main account now who im chasing for charges also) had closed my account already i would have been in deep trouble.

 

 

sigh... rant over.... any suggestions of banks to apply for that dont want your whole entire history etc. and can just give you an account.?????

QUESTION: The spreadsheet you use to work out interest. do you attach / cut and past into that little box on moneyclaim. is that correct. also when i try to calculate interest with the 0.00022 figure it comes up with a long number do i enter the whole long number it produces??

also the spreadsheet has a long example of figures etc if i delete these will it still calculate correctly?? I hate spreadsheets. or excel to be precise :-)
