I dont know about conspiracy, lol but Ive heard nothing off the Court.

 

I thought that they would have sent it first class under the circumstances but not in the post, if it doesnt come tomorrow Im going to ring the Court and ask what the heck theyre playing at.

Ive had post just not the one I wanted.

 

Just been goin over the N1 I submitted and the part that says value Ive put the amount there.

Now as Ive said I was under the impression that if I submitted 3 spreadies that it would be up to the Judge to award whichever one he deemed fit.

Where it says amount claimed ive just put under £5000.00.

Now I thought this was the correct way to do it? I hope there is a letter in the form I eventually get from the Court explaining where I have gone wrong, cause to my mind Ive filled it in right:???: .

 

Also been readin P Pearl book again about Specified Claims, and now Im wonderin if the nice lady I was talking to on the phone yesterday was tryin to tell me somethin in a roundabout way as she kept on STRESSING about this Specified amount and more or less telling me that that is what I wanted to claim.

Passage in book states;

 

The key features of a claim which is specified is that

1. "if the defendant does not file a defence in time the claimant enters judgement in default for the amount claimed and the judgement can be enforced straight away"

Does any body think she might have been trying to steer me in the right direction or am I just being naive and letting my imagination run riot again

 

Just have to wait till tomorrow till the postie comes I suppose and see what Ive got to do.

No point speculating I suppose, One thing she did tell me when I asked her was that there are quite a few being stayed but then she said something about "but there should be a different Judge for yours" ?????

hi overflow hope all is ok ,, take a deep breath and breath , lol ,, it will turn out ok ,, plenty ppl here behind you , as kenny says SSL is good at these things she helped me with my N1 i emailed a copy and had her check it over for me before i sent it court lol ,, i was that unsure lol but all was ok , and when you take it back to court get staff there to check is what i did ,, good luck

Hi overflow seems like your having a very crappy time to say the least! as if you haven't waited long enough, when you get the forms back copy them on pc and get ssl to check them over as it seems you cant trust the folks at the court to do it right, i was hoping cos it had been a while you might be having a WON title, nevermind i am sure after all this you will be sorted soon, i know exactly how your feeling all this waiting and stress.... but goodluck to you and i hope its sorted soon for you :)xxxx

Thanks for the support, it means so much to me knowing that there is people on here who care.

 

I recieved a letter off the court today with a new Notice of Issue form, with Specified Amount in brackets .

 

All I had to do was fill in the amount I had put on my POC inclusive of the interest and the court fee , tick a box stating I wanted it paid immediatley and sign and date it.

 

Ive sent it back next day delivery, cost £4.50 but its worth it if they get it tomorrow as the lady I was speaking to on the phone said she has been sitting on it for a week, and she will try and get it through for me.

 

I hope it just goes through ok , might not need to go before a Judge eh.

 

Ive still got a gut feelin that she was throwin hints out to me , call me daft if youlike but thats just me:rolleyes:

 

If I go off again its just this silly lappy playin tricks, couldnt turn it off before no matter how many times I tried to shut it down. I left it till the battery started screamin then tried again and it went off. Very strange, spooky.

hi overflow ,glad it was nothing serious hope all goes well for from now on as i know you have been messed around a bit ,, halifax got til sunday to aknowlege if nothing im filing judgement on monday , so hopefully it will go through ,, rang court up yesterday and they 3 weeks behind , so will have to wait and see as yet no stays been had which gives me a glimmer of hope ,, take it easy , and maybe just maybe we will all be celebrating together , you me and Stone

Dont forget if youve put a specified amount6 on your POC to make sure your filling in the correct form.

 

Dont be like me and just fill in the front bit on the Notice of Issue.

 

Im sure you dont want to have to wait another 2 wks to find out its wrong ,like I did.

 

Im expecting something back off them next wk, I hope anyway.

 

Unless that nice lady decides to sit on it again,(thought it felt warm) .

I cant get to Court until Monday and I have heard nothing new from either Howard or court and phone is getting me nowhere as each clerk gives a different story. seems like nobody knows WTF is going on. scuse language but it is real frustrating.
