Tried that two days ago and they insisted that they couldn't becuase it was in the "process". I told them that regardless of whether they told the courts that they had settled in full, I was still seeing the claim through until I had received the cheque and it had cleared in my account. Did you have your settlement letter before or after me. I think myself and Sowerby were a day apart?

Just got back from holiday. Cheque was here when I returned. Hooraaaaayyyy!!! Now to deal with Barclaycard, they have until 21st August to put in a defence with the court.

Need some help here. Sent Cap 1 the letter requiring payment before court action they have offered me £88 instead of £236 saying they are confident their fees are both fair and legal. They say the OFT have said they are not obliged to refund and fees. They say they will not be refunding all the fees i have asked. In other words sign the settlement form and not to waste the courts time? Any ideas

You really need to start your own thread where you'll get as much advice as you need and others can follow your progress.

However, as it seems you have sent the Letter Before Action and received this response then you need to follow up with the 'action' bit, ie, proceed to court with an N1.

Good luck and don't forget to start that thread

Yes Bailey. . N1 form now. That is pretty much a standard reply, except for the OFT test case addition, which is different from Credit Card charges. You will need to file with the court before they will pay up in full.
