That's good . .they will probably say they will defend before paying up.

Well, you are right uk, I have had a letter from the court this morning saying that they have acknowledged the claim and intend to defend the full amount of the claim. What do I do now? Do I start preparing the court bundle? Will the court now send me an AQ? Now I am getting second thoughts about the whole thing, help!

Just phoned Cap One to make my minimum payment, only to find that they have put another £24 of charges on my account. Can they do this when we are going through the court stages?

Hi Karhaus

Just the wait now. They should pay up within the next few days, so hold fire on the court bundle for now. About the other charge, maybe a phone call to them asking for it back when they have settled the existing claim. They know your serious now.

Still heard nothing in the post but have checked my Cap One account online and balance reads 0.00 and Paid out £778.74 which is the difference of my claim. Yippee!!!!!!!!! I am hoping that this means it is in form of a cheque in the post (which I think is on strike Thursday and Friday) so will hopefully arrive tomorrow or Saturday. I think I have won! Many many thanks to everyone on the site who has helped me, especially Mistermind who I couldn't have done it without him.

Received a letter from Cap One this morning, "although we do not accept liability and to avoid wasting court time we are settling your claim in full. We have credited your account and wil be sending you a cheque in 14 days for the difference". I can't believe that I won with full CCI although I won't tell the courts until the cheque is in my hands.

Hooray!!!!!!!!!!!!

  • 2 weeks later...

A quick call to them may be required. The Litigation team should have authorised the payment straight away. Let them know the court clock is ticking. You should'nt have to wait 2 weeks, what nonsense these banks come out with.
