    • Thanks for your reply, I have another 3 weeks before the notice ends. I'm also concerned because the property has detoriated since I've been here due to mould, damp and rusting (which I've never seen in a property before) rusty hinges and other damage to the front door caused by damp and mould, I'm concerned they could try and charge me for damages? As long as you've documented and reported this previously you'll have a right to challenge any costs. There was no inventory when I moved in, I also didn't have to pay a deposit. Do an inventory when you move out as proof of the property's condition as you leave it. I've also been told that if I leave before a possession order is given I would be deemed intentionally homeless, is this true? If you leave, yes. However, Your local council has a legal obligation to ensure you won't be left homeless as soon as you get the notice. As stated before, you don't have to leave when the notice expires if you haven't got somewhere else to go. Just keep paying your rent as normal. Your tenancy doesn't legally end until a possession warrant is executed against you or you leave and hand the keys back. My daughter doesn't live with me, I'd likely have medical priority as I have health issues and I'm on pip etc. Contact the council and make them aware then.      
    • extension? you mean enforcement. after 6yrs its very rare for a judge to allow enforcement. it wont have been sold on, just passed around the various differing trading names the claimant uses.    
    • You believe you have cast iron evidence. However, all they’d have to do to oppose a request for summary judgment is to say “we will be putting forward our own evidence and the evidence from both parties needs to be heard and assessed by a judge” : the bar for summary judgment is set quite high! You believe they don't have evidence but that on its own doesn't mean they wouldn't try! so, its a high risk strategy that leaves you on the hook for their costs if it doesn't work. Let the usual process play out.
    • Ok, I don't necessarily want to re-open my old thread but I've seen a number of such threads with regards to CCJ's and want to ask a fairly general consensus on the subject. My original CCJ is 7 years old now and has had 2/3 owners for the debt over the years since with varying level of contact.  Up to last summer they had attempted a charging order on a shared mortgage I'm named on which I defended that action and tried to negotiate with them to the point they withdrew the charging order application pending negotiations which we never came to an agreement over.  However, after a number of communication I heard nothing back since last Autumn barring an annual generic statement early this year despite multiple messages to them since at the time.  at a loss as to why the sudden loss of response from them. Then something came through from this site at random yesterday whilst out that I can't find now with regards to CCJ's to read over again.  Now here is the thing, I get how CCJ's don't expire as such, but I've been reading through threads and Google since this morning and a little confused.  CCJ's don't expire but can be effectively statute barred after 6 years (when in my case was just before I last heard of the creditor) if they are neither enforced in that time or they apply to the court within the 6 years of issue to extend the CCJ and that after 6 years they can't really without great difficulty or explanation apply for a CCJ extension after of the original CCJ?.  Is this actually correct as I've read various sources on Google and threads that suggest there is something to this?.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have had a DMP with CCCS for the past year and i'm just wandering if reclaiming my charges from the Halifax would have any bearing on this ??

Could the Halifax get snotty and request that i pay off my c/card debt because of action i'm taking against them...like tit for tat ??

Altho it was my CCCs counsellor that suggested i made a claim just wanted to verify this.

I wouldnt want to be laughing one minute then have egg on my face the next :(

Have sent off my first letter to the Halifax,altho i did hesitate for a second before i posted it....only a second tho...!!

Usually any dealings with my banks isnt a good experience so this doesnt go the same way :( :(

But i'm still 100% positive :D

I certainly hope so...but knowing my luck it will go all the way to court !! But i'm prepared for anything.This is just the first letter tho,still have plenty more to send...mostly to credit card companies.They have really walloped me one in the past but will see how this one goes with Halifax first...:D

I guess i will be receiving my statements in the post soon as i noticed on my net banking that Halifax have indeed banked my £10 fee.

Quite surprised really as i only sent my first letter on the 10th of feb.

 

How nice of Halifax to be so efficient in their processing !! :)

 

Now lets see how quick they are to cough up :D

Well its been 28 days now since i sent my SAR but still have received no response from my good old friends at Halifax.

No letter saying "Oh you're trying to claim too...sorry blah blah blah".

Are Halifax usually this slow in replying with regards to reclaiming charges....?? Most people seem to receive a reply within days

Haliprats do tend to let it get as near to the 40 days, but sometimes a quick phone call help hurry things along, but im afraid you have to be patient at this.

My advice would be to ring them , i was in the same boat as you and when i rang and chased up s/ments they hadnot even been ordered even though they had cashed the £10.00 cheque, so when i rang she re-ordered them and they arrived about 5 days later (just to be on the safeside)

Help Needed

 

Just recieved a letter from the halifax regarding settling at £3032 so i rang the guy up named Kevin and explained there is another charge to come out on Friday 9/3/07 for £39.00 and could it be reversed. He said this settlement is up to yesterday 6/3/07, i no it is only 1 charge but it has really got my back up because they wont reverse it or refund it, not sure what to do weather to accept the seetlment or continue to court and get the 8% which i pointed out to him and he just said well you do not have to accept it is up to you, should i accept or what please help!!!!!

I also have been waiting 28 days for my statements to arrive. I was getting worried as some people seemed to get letters saying thier request was being dealt with before the statements were actually sent out. I have had no response at all. I did ring a number that I got from one of the threads saying that the lady was very helpful. However when I called her to ask how my SAR was coming along she was not happy that I had dialled her direct line and asked where I had got her number from. She then told me that she couldnt help and gavce me anlther number to call. I rang that and got a guy who then put me through the security questions. I have 2 accounts witht he Halifax and one of the last questions was 'What was the last transaction on this account' By mistake I gave him a direct debit tranasction from the wrong account number. Even though I told him that I had quoted from the wrong account and gave him the correct transaction detail he told me that I had failed security and would not help me. He told me to go to my local branch who would reset my security. I went along to the branch and was told that the person who could do it was in a meeting and I would need to come back as no-one else could help. I was also told that they did not need to fail me on the security for the reason given and that the guy on the phone was being a jobsworth. So today I have been back to the branch to get my security reset, only to be told (by the same person I spoke to a few days ago) 'Sorry, we cant reset security here, you have to go to a main branch' When I told him that I had been in previously and had been told to come back he asked who I had been talking to as I had abviously been given incorrect information. When i told him that it was in fact him he remembered the conversation but wasnt even embarrassed. He just said 'Whoops, i was wrong. sorry' Oh well, thats alright then!

OH JOY !! :)

 

At last i received my letter today from Halifax saying your statements are in the post...albeit another 21 days til i get them.Hopefully sooner.

 

And finally my friends this week who have had the same charges are going to follow my lead to chasing Halifax.

That's a few more new arrivals for CAG !! :D

give it 10 calendar days, then email [email protected] it usually gets them jumping to clear a complaint and the statements arrive after a couple of days.

Halifax - paid out without getting to court - £250 WON - no intention of going, stated too costly!!

Halifax no 2 account - paid out without a fight - (by mistake, £1650 - should have been £1200 - had to pay some back)

Hi all,

there are a couple of things that are appearing on this thread so here's my opinion, for what it's worth.

 

Obviously you can't proceed without knowing how much you're going to claim. They have 40 days. That's not a nice round number that one of us thunk up. It's the law. If you have a recorded delivery receipt showing delivery sod them. I can't post the real word.

If it comes to day 33. One week left. Ring every bugger you can find and complain your butt off. At the end of the day you are the customer and you are right. If they want to know where you got their number tell them it was me. PM me and I'll give you my name and phone number to quote. And they can ring me. They don't scare me anymore.

 

This lady has proved to be very efficient, be nice she has helped loads of us.

Failing that look through my first thread and there are loads of e-mail addresses that might help.

 

BUT, apart from chasing your SAR which is necessary, I wouldn't contact them at all.

 

This whole procedure is done on OUR timetable and to hell with them. If they have a backlog of requests. Tough! If I made £4billion a year I think I could take on more staff! If you say in your letter thay have two weeks then they have two weeks from receipt. If they don't get in touch. Tough again! Send your next letter and eventually file in court. Let them grovel to you about settling.

Stick to your guns and you'll win. Honest!

Finally received my statements today and i was quite surprised as to how much Halifax has actually taken off me.

It's not quite as much as most people seem to be claiming but at £986 its a fair whack.

So first thing tomorrow will send my prelim letter asking politely for it all back..

here's keeping my fingers crossed ;)

Hi all...

 

Been away for a while as i've had no internet for over a month...damn u SKy !!

 

Anyway , sent letter off some weeks ago with schedule of charges for repayment.Received a reply for that on 28th of march saying " Sorry you're not happy will investigate etc...".

 

But have received another letter in the last few days saying again " Sorry you havent had a response to your concerns....but we will need up til around 23rd of May before we can give you a reply ".

 

What do i do ? just wait another month or is this just delaying tactics !!

Hi all,

I am new to the site but I had already sent letters to Halifax regarding the 2 bank accounts I hold with them, Surprisingly I received a response regarding one of the accounts within 10 days and was told that they did not charge for duplicate statements, the statements arrived 4 days later and a further letter confirming receipt of my complaint a week later. I have made a claim for approx £1500. However there has been no response regarding the other account and I suspect that they are going to make me wait the full 40 days :mad: as this claim is likely to run into thousands. Being the stubborn person I am they have a fight on their hands and I have just sent them a letter pointing out their inconsistent approach as an organisation to customer service. So I wait to see if I get a response

Give it a bit of time.It took halifax a while to reply to my prelim letter.Their customer service seems to vary.Some people get a quick reply some others have a waiting game.

The halifax office is no doubt a hive of activity with customer letters flooding in.

In my case i posted my LBA today.They have had more than a month to sort out my grievance but still no response except for "wait another month".

They have passed the timeline i set which was 14 days from my last letter so i've been overly generous.

Now i guess its a matter of waiting for that moment of truth.....!!

Oh well...

 

Got my reply from Halifax today after sending my LBA on the 30th of April.I guess its a standard letter saying " I'm sorry but..." and " When you took out an account you agreed ...blah blah.."

So basically they aren't going to relent that easily.Not that i thought they would.Just need some words of advice about the next step.I know its a bit of a gamble filing for a court case as it can go one of 2 ways...either in my favour or not,if its get that far of course.But i'm gonna see it thru no matter what.

Any help would be appreciated.

The letter you got today was sent to so many other people today, so just ignore it.

 

So as soon as your 14 days are up, then file. Have you decided wether to do mcol or N1 yet.
