    • It’s all with current lenders and no missed payment to date. so with any reduced payment to them it’s likely to be going to debt collectors at some stage. we jointly own a property together me and my partner
    • It’s all unsecured loans and credit cards. Mainly loans now though as most credit cards are paid off.   so 95% unsecured loans.   I just don’t know my situation job wise it’s almost impossible to say whether it’s likely or not just don’t want to be caught out by it. My mental health trying to pay this off has taken a huge hit also if I’m being honest. I feel like mentally I need some kind of respite and the credit file cost is something I can accept also.
    • Depends on whether part of the roof needs to be replaced and whether it is a standard roof type,  but the works should only take a day or two. Someone I know had a whole semi-detached roof replaced in about 12 hours. Suggest you put it in writing to the business about the issues you mention in your post.  Also as business premises, you could also apply pressure by contacting local Council if necessary.
    • Thank goodness it's not your roof and you get to foot the bill! How big are these bits of mortar? How often are they falling into your garden? Hourly, daily? Just go ahead with your plans, of course, they're not going to be worried by your time pressures and the urgency of the situation, so simply carry on as you would have done and I'm sure everything will go fine. Unless there is a danger to life and serious structural issues which mean you cannot venture into your garden, then IMHO there is little more you can do less for what you have done so already and made them aware of the issue.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hey, guess what...As from today Cabot will now have all their paperwork in order - and if they don't, then there's no excuse...

FSN: Debt purchasers improve customer service with enterprise content management solution from The Content Group

Come on guys, we're not working hard enough. The lovely BB says Cabot are only 'stretched to the limit' ... Another couple of hundred letters a week might tip them over the edge ;-) :D

Bernie Burdett, IT Director at Cabot Financial, comments, “We recognised the need for an automated document management system (about time and all) as staff resources were being stretched to the limit and customer documentation was not being dealt with efficiently enough (No sh*t). Since the majority of the correspondence we receive is in paper format, which takes more time to handle (good to know, we'll lay off the Emails then), it was vital to us that we found a better way of managing the information (let's see if it works shall we).

Talking of Berni,

Here's a forum she likes to visit every now and again Call Centre Discussion, Information, Articles and Development Tips - CallCentreVoice

And here's a bit of one of her previous posts..

Cabot pride themselves on being compliant, ethical and caring whether we are dealing with our customers or our staff. We don't use technology for technologies sake however if there is a different way of doing things we are not afraid to try them out....

...We have a young workforce here who are recorded every day when on the phone and don't see this as a big deal. These recording will of course be available to them via our online HR system as are any of the calls they currently make or take.

So there's no good reason why recordings or full transcripts of phone calls wouldn't be available in a Subject Access Request.

So there's no good reason why recordings or full transcripts of phone calls wouldn't be available in a Subject Access Request.

The general correspondence to DCA's has been to get them to supply a copy of the Original agreement which 99% of them do not have. This has enabled people to challenge the fact that the DCA had the right to chase them in the first place. It has not been traditional to ask for or send a Subject Access Request under the Data Protection Act and this has been saved for the Original Creditor, mainly because of their charges and calculating, getting copy statements and reclaiming their charges.

However, the more and more we uncover about the DCA's and their scurrilous ways I believe it to be even more important to get the Subject Access Request out to them so that the details, as you rightly point out, of these telephone conversations. I personally have been told by Wescot staff on a Saturday morning that a bailiff would be sent around on Monday if I didn't pay there and then over the telephone. Fortunately I knew that was illegal and impossible without a County court Judgement, but how many do? If I had recorded that conversation at the time I would have thrown the book at him. His Director had a few words with him after I'd finished complaining though.

I would second your advice, I would suggest getting the S.A.R - (Subject Access Request) off to both Original Creditor and the DCA along with one to the Credit Reference Bureau too. It may cost you £10 a time and deliver a few hundred sheets of paper, but believe me there will be all the ammunition you require to slam these dca's behind bars where many of them belong.

I recall one of Nick Faldo's girlfriends taking a golf club to his Ferrari (or whatever). Did a lot of damage. Nine iron I think. Have to say a three would give you a really good swing at your target.

Oh do have a happy birthday Maynard. God that choked me to write it.

Makes you roll doesn't it....?

West Malling-based Cabot Financial (Europe) triumphed in The Badenoch & Clark Business of the Year Award, also taking The City & Guilds Employer of the Year Award. Describing the judges’ reasons for choosing Cabot Financial, Charlotte Butterfield, senior manager, Badenoch & Clark said: “It has demonstrated excellent growth and success during the past year and has strong growth predictions for the year ahead. On top of this, a huge emphasis is placed on quality of service, treating customers as customers and not as debtors.”
