    • Hi Sorry for uploading them wrong. Im not technical at all and self taught so bear with me as im trying my best. Thank you for all the info regarding the signs, this was my thoughts as well. Yes they have changed teh signs since this happened Ill ahve to have a look back through and see if when I took the pictures they were already the new ones or I have the old ones. I cant remember off hand. With regards to Europarks running the site now, Just to make you aware there is another small retail park just across the road and Im sure they are Europarks. The shops within that park are just Aldi and B & M. The site that we received the NTK has a few more shops, Home bargains, The food Warehouse, M & S food and a few others. I put these for identififcation purposes just in case it is the other site that you were looking at. The main entrance sign is on the bend on the left as you drive in the entrance so when you drive in from the right and turn in you can see it in front of you but if you drive in from the other way as we do then you dont see it unless you know its there and as you say you would have to stop to read it al anywayl. The main thing that always jumped out at us was FREE PARKING FOR CUSTOMERS ONLY in large letters.     • You need a back up plan. If you believe that redundancy is very likely, start looking at other employment options.  Don't leave it until you have been made redundant before looking for new employment. I regularly speak to people who have been made redundant and about mental health. Those who have a positive plan, get into employment quickly following redundancy and manage to maintain their finances. Those who don't have a plan, decide to accept redundancy and a period of unemployment. They end up in a downward spiral, with redundancy money spent, debts accumulated, mental health decline and difficulty finding new employment.  
    • Interested observer here as I'm in a similar situation. People become conditioned into seeking and maintaining a perfect credit score/file, but if your situation is that you're unlikely to obtain further credit for the foreseeable future anyway due to your other outstanding debts, then tanking your credit file now won't make a difference other than you've took back control of your finances.
    • Firstly, I would like to thank everyone for their help in this matter. Since my last post I have received a reply from Plymouth Council Insurance Team concerning my wife’s accident (please see enclosed letter and photo of the offending Badminton post) which they deny any responsibility for the said accident. I feel that the Council is in breach of their statutory duties under the following acts: The Leisure Centre was negligent in its duty of care and therefore, in breach of the statutory duty owed under section 2 of the Occupiers’ Liability Act 1957. Health and Safety at Work Act 1974 (the Act) to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all their employees, and others who might be affected by its undertaking, e.g. members of the public visiting the Leisure Centre to use the facilities. The Management of Health and Safety at Work Regulations 1999 that requires employers to assess risks (including slip and trip risks) and, where necessary, take action to address them. The Provision and Use of Work Equipment Regulations (PUWER) require the risk to people’s health and safety from equipment that is used at a Leisure Centre be prevented or controlled. I would like some advice to see if my assumptions are correct and my approach to obtaining satisfactory outcome to this matter are accurate.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sooooo fed up. Last week was charged for 2 DDS that I hadnt got the cash in account to cover. My own fault I know. The Halifax took 2 x £39 out of my account and now my next DD has failed. I cant catch up, we are paying of credit cards and loans and can just about manage but its a vicious circle. Every time they take charges out Im short for the next payment. We dont have enough cash to play catch up. Have tried talking to them but they wont help. I have now cancelled all the DDs which come out of one account so that I wont incur another charge but this has now left us with the electric people wanting over £100 in a lump from us and also the car insurance wanting over £200. I just feel like running away, I now need to put £135 in the bank plus the mortgage money before the first of the month and I know we cant raise it. They have taken £147 in charges in the last month, Im at my wits end with it.

Same old story Im affraid we have all been there so we know what you are going through, you are in good company here.

 

 

Do your wages get paid into this account ? if not could someone else pay your priority bills by debit card if you give them the cash ? then let the halifax wait and in the mean time send the prem letter.

This is what has been happening to my daughter, who would not let me help her sort out her finances, a single parent (now) with two youngsters and a mortgage, working full-time, she has just received the first statement from her bank for bank charges in the last 13 months following first letter to them requesting these details - and even she is staggered by the amount they have taken from her - the food from my grandchildren's mouths, £1815 in charges and £92 in interest - £150 a month - I am on the war path. Why I am writing 1stlifeline - can you confide in your family- you, I am sure would feel a lot better

Thanks for the replies. I know its not just us that are in this position but it helps just to be able to post on here and know you are not just being judged. I do confide in my partner but I dont really want the rest of the family involved. My partner and I are in this together so Im not really without help its just that Im finding it so hard to deal with. I dont have a wage, Im self employed (only for the last 6 months) and hoped to be making money faster than I am. It just seems that each day I am struggling to take enough to be able to bank enough to cover the next days direct denits. I have sent off for my statements and we are in the process of selling the house and also agreeing payments with our creditors. I know that if we can get over the next 6 months or so we will be in a much better position. Its just the small things that get you, the car is due for MOT this Friday and also needs an exhaust. It also needs taxing on March 1st. Without the car i cant get to work, without the MOT I cant tax it but I cant afford to MOT it. Talk about a vicious circle.:-|

I have spent many hours today reading these threads, they are an inspiration, I have not incurred bank charges myself, but hope - with the help of this site - to get every last penny from the bank that has been taken from my daughter's bank account, who has been playing catch up every month for years. Do you claim all that you are entitled to 1stlifeline ? Family credit and child tax credits, working tax credits, council tax benefits - have you had a benefits health check? I know you are working, but maybe there are some things that you are entitled to.

hi i sent halifax a list of all charges for the last 4 years, along with the LBA[didnt bother with the prelin], on the 14th day they rang me and offered me half, i told her no, and i would be filing my claim the next day

she immediately offered the full amount, and i had a cheque within a week

go for it, dont accept an offer
