It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

can someone please help me?

Can you tell me why i'm getting two different totals,when using your interest template and the On Line Calulator.

Yours kicks out on a figure of £227.70 the interest of £21.01... pay me back £248.71 please.

And the On Line Cal it's £227.68 the interest of £23.10... pay me back £250.79 please,i know which one i would use,but we do not wish to look fools when submitting the claim.

Hi - I am new to this site and just about to start action against MBNA and First Direct. I have been reading the posts and the FAQs and am now starting to get the paperwork together to make claims.

 

However, I cannot open/download the spreadsheets in any format - when i try to open them from the link in the library, i get "the page cannot be displayed", when I try to save them prior to opening , I get " The site was not found, check the address and try again.

Is there a problem at your end or mine?

Please note this email address is now CLOSED for spreadsheet requests

and you WILL NOT receive a response unless Vamp has specifically

requested that you contact her.

 

All spreadsheets are now available for immediate download in the 'Bank

Templates Library' on the Consumer Action Group Forum.

 

Unfortunately the links still don't work

Quick question before I send off my prelim letter. On the spreadsheet, below name and account number etc. there is a yellow box which says "date" and "rate 8%". Do I delete the "rate 8%" bit or leave it on ?

Bit confused as we are told not to mention the 8% interest bit at this stage. If anyone can put me straight on this, I would be most grateful,

Don't worry. The auto message was set up because the links were put on the site. Now the site's links are broken we're reverting to old methods. All this is driving me mental.

 

I'm at work, but when I get home I'll log into the Vamp gmail and sort it all out, including amending the auto response. Luckily my daughter's away from home on holiday so I've a little more free time. Unfortunately I keep trying to fill it up with a social life. Lol. ;) Please bear with me.

Make a copy of your spreadsheet and delete anything that involves the 8%, including the calculations. This should just leave you with a list of charges totalling your total claim.

 

When it comes to raising your court claim, use your original spreadsheet that has the 8%.

Ron, I'm still looking into this. I need time to play with some figures and see what's going on. I didn't create the online calculator so am not completely positive about the calculations in it, and don't yet know how to check it. I've asked another mod to help yesterday, but everyone seems pretty busy at the moment.

 

My gut feeling is a rounding problem as it's not a large difference, but it still seems too large a difference to me to be simply that.

 

I don't think you need to worry and can press on in the meantime. Thanks for pointing it out and I'll try to get it sorted as soon as I get chance.

I am ok for now have managed to create one minus interest as I dont need to claim that yet, the download link wouldnt work for me earlier.

I've totalled my interest charged & it comes to £114.55, I am aware that not all of this interest was due to the overdraft fees so I need to use the spread sheet to work out how much to claim.

 

This is where I need a little help please.

 

In columns G,H & I, I'm not sure what dates to put?

Hi,

 

This is all in the notes on the front sheet of the spreadsheet. The date is a very grey area, and often it's just best to use your own judgement here.

I was sent the simpel version of the Open Ofice spraedsheet, but it does'nt calcluate the proper intrest. Can you send me the advancd version fo Open Ofice please?

Can you please tell us why you think it doesn't work? If it is a few pence different to another spreadsheet then it could just be the calculation. There is no advanced Open Office version yet that I'm aware of.

Patience is my strong point:D

 

I needed another simple excel one downloaded as you will notice on the sheet I've sent you there are some gaps.

 

Could download them the other day, but now it won't let me sad-smiley-034.gif.

 

Can you send me one of each please (Simple and Advanced English version) to my email address which you should be able to reply to with the email with the spreadsheet I've just sent you.

Sorry, I wans't very clear. It is'nt calcluating the intrest on the overdrught. It calcluates the 8% intrest okay. Is there a spraedsheet that calcluates overdraught intrest for Open Ofice? Thanks.
