  1. abbey took 165.00 in charges within a 2 day period. Spoke to a man on the phone from abbey, and he offered me 60.00 back on the condition that I don't complain about the rest. Is that right?

  5. ok I;ve got the full & final offer letter which they emailed me, and I'm ready to sign - just wondering about the bit which says "By accepting this offer you also agree that the existance and terms of this offer are confidential between us". Does that mean that I'm not allowed to tell anyone about it? and if I don't agree to basically keep my mouth shut that they won't pay me?
  6. I have settled with Barclays for the sum of £1,957.82. They are sending me a form to sign, and when I return it to them they will issue my cheque. So my next step would be to wait until I have the cheque, and then tell Kendal County Court that I have settled with Barclays, am I right? Please let me know.   7. Thankyou for your help Argyle but I'm sorry to say that I am still confused.The lady wants to know why I have claimed for 2 lots of interest. The interests in question are listed on my schedule of claim for charges sheet as: 1. 8% on penalties, and 2. Interest on penalties. Am I right in thinking that the '8% on penalties' is the interest I am entitled to claim under sec. 69 of the county courts act 1984, and that the 'interest on penalties' is the overdraft interest that barclays have charged me on the penalties they took? The lady is talking about starting settlement, so I need to get this bit right. I know I must sound thick, but please help , Thankyou.

  10. Hi everyone, I REALLY need some advice immediatiately. A lady from Barclays has just been on the phone asking me why I have put down 2 lots of interest. One is '8% interest on penalties' and the other is 'interest on penalties'. I couldn't answer as I had just come in, so I explained and said I would ring her back this afternoon after I had looked at my documents. Could someone please remind me what the interest bits are e.g. 1. 8% on penalties interest on penalties 8% interest on penalties.
  11. I sent my bundles on 3rd jan 07: 1 recorded delivery to barclays, and 1 to the court that I handed in personally. Since then I've heard nothing, my court date is 7th feb 07. Should I contact Barclays and see if they're willing to settle, or leave things as they are? Thoughts would be appreciated as always!
  12. Right, I'm ready to send my court bundle but do I have to highlight the bits I shall be using for my case or not? Is it enough to just get the bundle ready?
  13. I phoned the court and they gave me a date in March. They told me to phone Adrian Ruffhead(Barclays), to ask if he would mind me adjourning till then, and then let the court know if it was ok. So I thought no I'm not ringing Barclays to ask for any favours, I'll stick to my original date 7th Feb. Don't really want to give them any more time to prepare. Do you think I should be contacting Barclays to ask them to make me an offer or should I leave it because I've not heard anything from them, and I have only communicated with them through the letters on this site? If I should be phoning them etc what should I say? any ideas?

  15. I have a slight concern. My court date is set for 7th feb 07, but i'm a student teacher and am expected to be on a school placement on that date. Should I let the school know that I can't make it, or should I leave it on the presumption that Barclays won't show or will contact me before that date? Any thoughts or advice would be great thanks Sarah.

  17. Today I received a court date: 7th February 2007 at 10 am in Kendal County Court. It will be heard by District Judge Forrester. I have to give copies of my documents to the other parties no later than 14 days before the hearing. I have heard absolutely nothing from Barclays for ages, so I don't know what they're playing at. Is everything going according to plan do you think? Do I need to panic yet? Any advice would be good, Thanks Sarah.
  18. Today I posted my AQ and fee exemption form through the front door of the court. I will ring them on monday to make sure they've got it. It's getting exciting now !
  19. I have filled in a fee exemption form from the court, as I can't afford the £100. I am taking it to the court personally tomorrow. So I guess the next step is wait to hear from the court as to what they want me to send to them eg court bundle etc. and maybe a date for the hearing. We shall see.....

  23. Hi, just a few queries regarding the above bundle list: 1. The OFT report April 2006 (OFT842)-35. Does this only apply if you are claiming for credit card accounts? 2. The Data Protection Act (1998)-53. Is this for if the bank haven't sent your statements? 3. House of Commons Select Committee on treasury second report "Transparency in charging"-10. Is this only necessary for claiming on a credit card account? Sorry if I sound thick, but I just didn'y want to add things to my bundle that I don't need. Please let me know Thanks Sarah.
