    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

same thing happened to our computer last year and thats why the bank case dragged on so long i started back in november but all my files where wipred off computer so had to start again and clouldnt be bothered till after xmas xxkia

Apologies for the delay vampiress, my hard drive is screwed so had to borrow another laptop and work out the schedule again, i have now emailed it to you, thanks for stepping in to help

Right she has come up with the following, anyone see any problems with it?

 

Dear District Judge Osbourne,

 

Please find attached two schedules. The schedule lettered A is the schedule of charges showing the interest calculated that I submitted to Northampton County Court on xx/xx/xx. The schedule lettered B is the updated schedule including interest up to today's date.

 

Should these schedules not suffice could the Court please clarify what would constitute a proper computation.

yup twice posting again lol, letter has gone off to the judge today, i was really worried at first, but thanks to vampiress i have calmed down now, as she has said it may be a case that northampton simply havent sent the schedule of charges over to oldham courts

Fantastic news for me, thanks to Reka i now may not have lost all the file on my screwed hdd. Bit of a relief as the court bundle is stored on this hdd, once these files are recovered someone please make sure to remind me to back all my files up, i am a bit useless at remembering stuff like that lol

thankyou Icy. I have read your entire thread!! Am a bit worried about the GOGW thing. Abbey paid 103 pounds into my account a couple of months ago. I had no back up communication from them. It just said on my statement that they were misc. charge refunds. I recieved the letter accompanying this GOGW only the other day. It must have gone missing in the post or been delivered to the wrong address. Anyway I didn't contact them about that so should I now send an email to them rejecting this as an offer? Why is this so bloody complicated? they don't make things easy for us or themselves do they? Am getting worn down by it all now. I am claiming on two accounts but as one claim. they owe me 4543.79 which includes interest of 762.79. I think 4000 is a fair settlement bearing in mind I have had the cost of the small claims to pay and all the time I have put into composing letters and working out the claim.

 

 

Hey guys I can clear up the "Misc. Chg Refund", if you look back through your recent statements you'll probably find those amounts were debited from your account as charges. They offered me a GoGW of £170 and the same day £20 and£30 were put in my a/c as misc.chg refund. I never saw the £170 but I did tell them to shove it but I didn't mention the £50. I think they are just giving back recent charges when you start reclaiming procedures against them.

YES YES YES YES i am very very releived to say that all my files have now been restored and my older laptop is now working as normal, i'll make that backup tomorrow after a meeting i have in the morning, HUGE thanks go out to REKA without his hlp i would have been sat here with not a clue, the worst thing is all the pictures of my 2 girls are on that hard drive since they were born to now, and they are the only copy of the pics, i was devastated i had lost the first 5 years of their lives

Court have received the schedule and explanation on the 21st i called the court today but they cant tell me if it has gone back to the judge, or indeed how long before they give me a hearing date, they said they are very busy at the moment, could be in for the long haul then.

 

The woman who answered the phones was quite abrupt, guess they are getting sick to death of all these bank claims, although she may just have had a bad day.

 

First time i have not had a very freindly response from any of the courts

just cobbled this together

 

Dear Inga

 

I am writing in an attempt to make a final settlement on this claim, this claim is now just waiting for a hearing date, which Abbey are repeatedly failing to attend.

I think it would be better for Abbey, the courts and indeed myself if this claim was settled amicably in an out of court settlement.

I am willing to accept the figure of £2000 as a full and final settlement in respect of the bank charges, for which you have already received a schedule.

On receipt of this settlement having cleared i shall immediatly write to the Court withdrawing the claim.

I have reduced the amount from the amount which is submitted to the court, in that i am requesting settlement in the figure of £2000, the actual figure owed to date is £2,113.20, which includes court fees and statutory 8% interest, obviously this figure is rising on a daily basis, and will increase dramatically once i commence getting the legal bundle together, settling now for the sum of £2000 will save Abbey potentially in the region of £500.

If however You are not willing to settle, then i will let the matter run its course and wait for the court to order a larger payout
