yes i would hope that Jamesrap does not feel compelled to apply for JSA as if its his only option, or that it is forced upon him, i would hope that the DDA would be invoked by JC+ and they decide to support Jamesrap with whatever he chooses.

Trouble is, DLA do not always notify DWP of things. People can be claiming DLA for ages without DWP making sure they get the appropriate IS premiums.

 

This is what worries me about Jamesrap... if he hasn't notified them that he gets DLA, then they will force him out to work.

I'm currently on secondment from JCP - and donot miss them also. I think that maybe Jamesrap want to consider IS / IB to go with his DLA. He has a DEA who should give appropriate advice (although they all don't do as good a job as some), this will give him some respite and freedom to ensure he can eventually finish his course;-) , and get the job he wants!

The JCP will know what benefits he gets - it will be on their JSAPS system, and link in with the premiums - it's best to declare a health problem if something gets missed though.

Halifax no 2 account - paid out without a fight - (by mistake, £1650 - should have been £1200 - had to pay some back)

JSA means you are actively seeking employment, means the unemployment figures are lower as JSA are not counted.:(

 

DLA is stated as giving you the choice there fore you are still not classed as unemployed.

 

Its so the government can lie on their figures.

 

All people out of work and attending college once a week under job training and still claiming benefits are not classed as unemployed.

 

By changing the name and a status of how it is applied helps the government deceive the country

Yes.... lone parents on Income Support are not included in those figures either, which meant that when all the papers, etc. were reporting on 3 million being unemployed all those years ago.. it was actually nearer to 8 million.... if you included lone parents and the sick/disabled. These are still not included in unemployment figures today. Also, numbers claiming Incapacity Benefit have risen over they years and these are still not included.

 

The Gov. doesn't want people to know the truth.... job insecurity, contractual/seasonal work, low wages are the current way of life for many people. We are always being told that there is plenty of work out there... The reality is that there is actually very little that provides job security, along with a living wage these days.

Hi folks just found this thread again. (note change of username from jamesrap)

 

I now have my own place and my circumstances have changed. (massively)

 

I fell down a few weeks ago and i now have back pain to add to my memory problems.

 

I am claiming incapacity and income support as a result.

 

I wish I found this thread earlier as there are a lot of very helpful posts which I am more than great full for.

 

I am sueing the council with the help of a lawyer. Who seems to be good and knows his sprouts from his onions.

 

How can I notify DWP about my DLA should my Sick notes run out?

 

And what exactly should I say?

Certainly no-one is currently working there as the titles have changed. Income Support is now Income-based Job-seekers Allowance or Contribution-based Job-seekers Allowance.

 

There are people who receive Income-based Job-seekers Allowance who are not actually expected to work, eg single parents living with children under 16.

 

Income-based gives an automatic entitlement to housing benefit and council tax benefit etc but contribution based may or may not.

The benefit adviser on the phone said I was entitled to claim Income support

It actually said Income support on the papers when i received the claim form to sign.

There should be a section/question on the IS form (or Income-based JSA :rolleyes: ) that asks you about DLA. Depending on what rate it is will determine whether you're eligible for additional premiums in your Inc. based JSA.

 

What rate of DLA do you receive ? You shouldn't need to keep on submitting sick notes if you're on DLA anyway.... unless things have changed there as well, which wouldn't surprise me :rolleyes: .

That's a pity... it's the middle and higher rates that quallify for extra premiums :( . If you want to claim the mobility component, then it means your whole claim will be re-assessed. Ring up the DLA helpline and they will advise on the procedure... but remember that a re-assessment can also go against you, so it's a gamble. If your situation has become worse however, then evidence from your GP/specialist should support this.

 

If/when a new form arrives, be very careful how you fill it it in.... it's assessed according to your level of NEED, i.e.... how much help you need from ANOTHER PERSON and not how ill you are or how serious your illness is.

 

As for claiming IS/JSA, once again.... 'phone up your local DWP office and they may send a form out for you to complete, or send someone round to help you. A friend of mine had to do something similar after her husband had a heart attack and she became effectively "housebound" with twins.

To sort the DLA problem out you need to contact them informing them you have had a change is circumstances and speak to one of there advisers about the change. They should then send you the relivant forms to be filled out and then re assess you.

 

Also Income support has not changed its name it is still income support.

 

IS and JSA are to different benefits which is how hey will stay. I know this as i spoke to the JCP office near me on Friday and they have said the same as me.

There is a difference between "actively seeking" and being forced to take a job that is not suitable.

 

For example, I was told that I had to take a job working in a factory even though they were aware that I could not stand for long periods in one place due to back problems. Because I said that I could not take it, I then had my benefit suspended.

 

I have since been told by a civil service manager that EVERY civil service rule book, including the one used by the DWP, has the same thing printed on the front cover.

"These rules are for guideline only"

In other words, they are not hard and fast rules as the Jobcentre would have you believe, but merely guidelines by which a judgement can be made. Every case has to be judged on it's own merit using the DWP regulations as a guideline, just as every case in court must be treated as an individual case using the law as a guideline.
