I was waiting for this ticket, because I was aware I had overstayed at the car park on the day by a couple of hours, having bumped into an old school friend after parking,

when I returned having been in the supermarket I found I was unable to pay for the extra time using the Horizon parking App, they only allow parking going forward in time - How Mean!

At the moment it is only £40 but I am very reluctant to pay these fleecers that much, since they make no provision for people returning a little later to their cars than anticipated.

CAG Mandatory Questionnaire filled out below.

Any advice on what to do will be gratefully received.

I had thought to phone them up and give them half the amount of £20 only and let them decide if its worth fighting me in court.

Is there any law which covers Parking apps giving people chance to pay for late parking?

2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 25/09/23 (Note: Does not say "Notice To Keeper" JUST SAYS PARKING CHARGE NOTICE

4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] No

6 Have you appealed? [Y/N?] post up your appeal] No

Have you had a response? [Y/N?] post it up N/A

7 Who is the parking company? Horizon Parking Ltd

8. Where exactly [carpark name and town] Tesco , Brewery lane, Bridgend, S Wales.

For either option, does it say which appeals body they operate under.

A few days ago we had a new Horizon thread, which pushed me into looking at similar past threads, of which there were 43.  Horizon had only done court once, and that was when the person had moved and didn't reply to a Letter of Claim so Horizon knew they would get a backdoor CCJ.  There are no guarantees of course but they are not a very litigious bunch.

It's worth e-mailing the Tesco CEO  https://www.ceoemail.com/s.php?id=ceo-9138  laying it on thick about being a genuine customer, attaching any proof of payment, underlining that you tried to pay for the overstay time but Horizon wouldn't let you.  And ask them to get the ticket cancelled.  Nothing ventured ...

There are so many things wrong with that PCN that it is not compliant with the Protection of Freedoms Act 2012. So the keeper is not responsible for the charge. Only the driver  is liable.

Usually there is a set time that motorists can remain in these kind o car parks. Once hat time is reached there are no extensions. That enables them to make money.

In future if you find that you have overstayed, seek out the manager of the store and explain that you have overstayed and they usually then "whitelist" your car for that visit and so you don't get a PCN.

Hi Sporting, from your other threads, I see that you're a "serial offender".😝

Anyway, you know the drill by now... Ignore everything except a letter of claim and, as Dave said, contact Tesco in the meantime.

UPDATE : SUCCESS!

You were right about Horizon parking! Having written to them to explain the situation and attaching my receipts from instore over a couple of weeks to prove I shop there regularly, they let me off!

(Redacted letter attached)  Hope this helps other people.

Regards

Incredible!

I've been on the forum for eight years and I think that's only the third time I've seen a PPC cancel a ticket.

Thread title changed to show the positive outcome.

Well done!

Well done!

You're officially a veteran PPC killer!

Totally bemused that an "appeal" actually worked!

I think they have a good relationship there with the store and don't want to be fleecing the customers that use the store.

Maybe Horizon have a lot of complaints and don't want to kill the fabled lucrative goose, by upsetting Tesco.

After all, there will be plenty of less confrontational customers victims who just cough up, because they think it's legit.
