  1. Thanks for everyone’s help with this pcn. I finally had an opportunity go to the pub with the letters and told them I was drinking in their pub that night they immediately cancelled the ticket. They said they put it in place because lots of people were leaving their cars in the car park all day and hopping on the tube. Once I told them I was legit it was all cancelled. i have not yet tackled my lease company but will do so in the next week. thanks again everyone - where do I go to acknowledge a success? Laoise

Thanks Nicky Boy I have just checked and this is the relevant clause: an administration fee of up to £25.00 (including VAT) each time we receive and process a fixed penalty, fine, congestion or other charge in connection with the Vehicle or its use. In addition if we pay such charges on your behalf you shall reimburse us in respect of the such payment (see paragraph 2.2 of the Terms and Conditions) Is this contrary to legislation? BTW they did not automatically pay the Parking Charge Notices from Alliance Parking or Euro Parks, but they did pay a Penalty Charge Notice from TFL Red Routes (which I also contested at the time as the sign implied we could park there at specific times to load - but my appeal was rejected). £25 does seem a lot though for just forwarding an email!   4. Thank you Lookinforinfo, FTMDAve, DX100uk and Homer67 for helping me. I feel pretty stupid for not following the protocols for posting attachments. Thank you for helping with this too! So, from what I have understood, I can just go to the pub (or social media) and ask them to stop Euro Parks from hounding me. But apart from that I can do nothing as its unlikely they would be able to win in court anyway so they wont pursue me. Have I got that right? Thank you Laoise
  5. Hi Thank you for your very clear list of items I should have received... I am just dealing with the Alliance Parking ticket here... 1. The PCN was sent to the lease company which is the Notice to Keeper. They did not send anything to me directly until after I sent an appeal letter on 20th July. Alliance Parking had been given my details by LeasePlan on 12/07/2023 with a third party authorisation letter I posted here earlier. 2. I did not receive the PCN directly from Alliance Parking - the only copy I have was emailed to me by the lease company 3. Alliance Parking did not send me a copy of the lease agreement proving I was the driver when the alleged breach occured. 4. Alliance Parking did not send me a signed copy of the lease agreement which states I would be liable for parking (Question - how would Alliance Parking get the lease agreement? Would they have had to ask the lease company? Is the Third Party Authorisation letter not sufficient?) I have attached all the documents I HAVE received from Alliance Parking. 07/07/2023 - the copy of the PCN sent by Alliance Parking to the lease company 09/08/2023 - the letter I received from Alliance Parking following an initial appeal I made (with some help from a friend who is a lawyer) 22/09/2023 - Adjudicator's Appeal Dismissal from IAS following an appeal I made online with support from ParkingMateUK who I found before I found your website... 04/12/2023 - Final Demand from Alliance Parking to pay £100 28/12/2023 - Letter of Claim from Alliance Parking requesting £170 within 30 days to avoid County Court Proceedings.   6. I am feeling pretty stressed about this after 3 really challenging months personally. I found a letter on the successful appeals page - but i dont think its snotty enough. If someone could take a look and see if I am on the right lines or if you know a better letter than I can adjust I would be really grateful. POPLA If you have received any other correspondence, please mention it here Notice to Hirer dated 14/12/2023 Final Notification Letter dated 20/01/2024 I also received 2 letters from Leaseplan: 1. to let me know that ":We have given your details to the relevant authority transferring liability of this offence to you." 2. THIRD PARTY AUTHORISATION LETTER Hi - I didnt receive a copy of my hire contract or copy of the agreement. Would Leaseplan need to have sent this or the parking company? I received a letter from Leaseplan telling me that they had received the pcn and then a third party authorisation letter - see redacted items attached docs1 .pdf
  9. Hi again Embarrassingly, this is the second PCN I have received from a Private Company in 2023! I have not had a parking ticket for years before this and now 2 in the space of 6 months! I met a friend at a pub which I have visited many times in the past and often parked in their car park when there was space. As it was a quiet evening i thought nothing of it that there were spaces available, had a drink, chatted to my friend and went home. I saw no signs at all, either on my way in or on my way out! I was shocked a few days later when I received an email from the company I lease my car from that I had been given a PCN - see attached. Following advice on here i did nothing. I then received a notice to hirer around mid December and then a Final Notification Letter on 20 Jan 2024. I have not responded at all. What is the best move now? Thanks everyone!   11. Hi again I have received a Letter of Claim for the parking ticket from Alliance Parking regarding the PCN I received from inadvertently parking at Daymer Bay car park last summer. I received this letter at the start of the year and it was dated 28th December. But I had so much other stuff going on over the last month I just got too stressed to deal with this as well. Is there anything I can do about it? In the meantime I have received another parking ticket in November, this time from a pub car park I have been to many times in the past but just not for a while. I did not realise that they had now introduced parking charges with Euro Car Parks and I didnt notice any signs when I entered the car park or when I left. So I was completely shocked when I received another PCN. I did nothing and then received a Final Notification Letter on 20th January. I would really appreciate some help with sorting these out as they have really caused me so much stress! Thank you in advance Laoise

IAS If you have received any other correspondence, please mention it here Firstly, please note that I am not the Registered Keeper as I lease the car from a Car Leasing company. They forwarded the Parking Charge Notice to me and also sent me a letter confirming that I was in charge of the vehicle at the time and allowed me to communicate with Alliance Parking. After receiving the response from IAS I felt like they were not properly reading our reasons for not paying – ie that we had no idea we needed to pay as we were not staying and we did not see signage on entry to the car park explaining what the rules are as the sign had been obscured by the attendant who was ushering us into the car park. I have never parked in a car park that demands payment if you don’t stay without issuing you a ticket first. And if a ticket had been issued on entry explaining the rules then we would have left straight away as we were not planning on staying due to the poor weather conditions. This is an unfair and unreasonable request to ask for such an extortionate charge when the parking costs were only £1 per hour! This has been explained in the various letters I have written to Alliance Parking and the IAS and it has been completely ignored!

Is there another way I can get this to you? The demand notice says I must pay by 18th December so I would like to understand what to do before then. Thank you
  14. In July this year, we parked briefly in Daymer Bay carpark in Cornwall, but as it was very windy we decided to go elsewhere. We looked at.alternate options and left. We thought we were there no more than 10 minutes. We did not see the sign (on the passengers side of the entrance) as we entered the carpark as it was obscured by the attendant who had ushered us inside. And we did not look at any carpark signs because we did not believe that we needed to pay as we were only there a short while. A week later, I received a charge for £100 (£70 if I pay straight away) from Alliance Parking. The letter included photos taken at entry and exit 18 minutes apart which surprised us. We were totally unaware of the camera or the rules on the day and would not have expected a carpark to require payment from the moment of entry without issuing a ticket from a barrier gate. I replied we did not see the sign on entry as it had been obscured and offered to pay £1 as that was the amount I would’ve paid had I been aware of the rules. They declined my offer. I write again using a letter written with the help of another action group. Again it was rejected. I then wrote to the independent appeals service as instructed. The letter I received back from them said that the IAS had been shown photos of plenty of clear signs in the carpark and they upheld the charge. I wrote back asking them to send these photos to me so I can see but they did not respond. We don’t remember seeing any signs I spoke to a taxi driver in a nearby town and asked him to visit the car park on my behalf and take photos of all the signs. There were only two signs there, not the many that the IAS said there were. Since then I have been extremely busy and have not had a chance to write again. But I have now have received a final demand for payment from Alliance Parking for £100 with the threat of going to court, paying more money and possibly getting a ccj. Part of me feels like I should just pay £100 rather than face a court case about this . But I feel that I have proof that the IAS is not an independent body at all. What would you recommend I do? Are there any cases where drivers can win?
