    • The property was our family home.  A fixed low rate btl/ development loan was given (last century!). It was derelict. Did it up/ was rented out for a while.  Then moved in/out over the years (mostly around school)  It was a mix of rental and family home. The ad-hoc rents covered the loan amply.  Nowadays  banks don't allow such a mix.  (I have written this before.) Problems started when the lease was extended and needed to re-mortgage to cover the expense.  Wanted another btl.  Got a tenant in situ. Was located elsewhere (work). A broker found a btl lender, they reneged.  Broker didn't find another btl loan.  The tenant was paying enough to cover the proposed annual btl mortgage in 4 months. The broker gave up trying to find another.  I ended up on a bridge and this disastrous path.  (I have raised previous issues about the broker) Not sure what you mean by 'split'.  The property was always leasehold with a separate freeholder  The freeholder eventually sold the fh to another entity by private agreement (the trust) but it's always been separate.  That's quite normal.  One can't merge titles - unless lease runs out/ is forfeited and new one is not created/ granted. The bridge lender had a special condition in loan offer - their own lawyer had to check title first.  Check that lease wasn't onerous and there was nothing that would affect good saleability.  The lawyer (that got sacked for dishonesty) signed off the loan on the basis the lease and title was good and clean.  The same law firm then tried to complain the lease clauses were onerous and the lease too short, even though the loan was to cover a 90y lease extension!! 
    • Northmonk forget what I said about your Notice to Hirer being the best I have seen . Though it  still may be  it is not good enough to comply with PoFA. Before looking at the NTH, we can look at the original Notice to Keeper. That is not compliant. First the period of parking as sated on their PCN is not actually the period of parking but a misstatement  since it is only the arrival and departure times of your vehicle. The parking period  is exactly that -ie the time youwere actually parked in a parking spot.  If you have to drive around to find a place to park the act of driving means that you couldn't have been parked at the same time. Likewise when you left the parking place and drove to the exit that could not be describes as parking either. So the first fail is  failing to specify the parking period. Section9 [2][a] In S9[2][f] the Act states  (ii)the creditor does not know both the name of the driver and a current address for service for the driver, the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid; Your PCN fails to mention the words in parentheses despite Section 9 [2]starting by saying "The notice must—..." As the Notice to Keeper fails to comply with the Act,  it follows that the Notice to Hirer cannot be pursued as they couldn't get the NTH compliant. Even if the the NTH was adjudged  as not  being affected by the non compliance of the NTK, the Notice to Hirer is itself not compliant with the Act. Once again the PCN fails to get the parking period correct. That alone is enough to have the claim dismissed as the PCN fails to comply with PoFA. Second S14 [5] states " (5)The notice to Hirer must— (a)inform the hirer that by virtue of this paragraph any unpaid parking charges (being parking charges specified in the notice to keeper) may be recovered from the hirer; ON their NTH , NPE claim "The driver of the above vehicle is liable ........" when the driver is not liable at all, only the hirer is liable. The driver and the hirer may be different people, but with a NTH, only the hirer is liable so to demand the driver pay the charge  fails to comply with PoFA and so the NPE claim must fail. I seem to remember that you have confirmed you received a copy of the original PCN sent to  the Hire company plus copies of the contract you have with the Hire company and the agreement that you are responsible for breaches of the Law etc. If not then you can add those fails too.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Many thanks to DX for producing the  Excel case. Cardiff Devil I would print out the whole case so that your judge sees the original Judge's thought processes and how he arrived at dismissing the  whole case even though the defendant was guilty.

It is worth reading and understanding it yourself. However your Judge may still ignore the case and come to his own decision.

I have just realised its not the original appeal email its another email reply i sent them.

I remember now i had to fill a form in on their website to appeal and remember they never gave me the sar i requested.

Dear Sir/Madam

Thanks for your correspondence. I was sadly homeless during the time that you were sending mail to me ie to the  South Wales address, it was impossible to get my mail in a timely manner because i was homeless.

I am sorry to hear about your decision in appealing the charge however i did appeal at the earliest date i could.

My mail was getting redirected from the address in South Wales to my daughters address in Glasgow, she was not aware of the parking charge urgency as she is still very young, she was sending me pictures of my mail to me once a week.

Given the delay with royal mail strikes, the xmas period, my redirection to my daughter in Glasgow, receiving my mail updates once a week, you can see why i missed the deadline through no fault of my own. 

I am also unemployed right now and have no money to pay any charges.

Please appeal this charge and i will be forever grateful. 

The 'Excel vs Wilkinson' case i cannot read it not copy it nor print it out. Any ideas on that one guys?

If not, you can afford to be slightly late, they can hardly moan if they are late too.

ftmdave thanks for your reply, i have not received anything from them yet and some of my mail is arriving 3 weeks late. ;)

That's a good start, but the WS still needs a lot of work.

The problem is the lack of time.  Your deadline is tomorrow.

At my end a Bank Holiday means doing the work of five days in four, so the earliest I could help would be Friday.

Up to you if you want to send it off tomorrow or risk sending a better version but slightly late.

The court is actually in Cheltenham  its no problem to drive there and deliver it once its ready.  ;)

I can do some work on it on Friday afternoon.

Normally that would mean you could get it to the court by the 4pm deadline.

The problem is that Friday is a Bank Holiday and the earliest you will be able to get it to the court is Tuesday.

Hi

dave thanks for letting me know.

I have seen online that the courts are closed fri and mon however some might be open on sat or mon, i tried to call the court but its closed now.

I forgot also regarding the bank holiday.

All i can suggest is you do you magic when you have free time and ill get it to the court at the earliest convenience.

I might phone on sat to see if they are open or not. ;)

you'll never find a court open on a w/end MB.

all courts are closed Good Friday and Bank Holiday Monday.

However as Andy points out, that does NOT mean you get 2 extra days to file, you get one, same as xmas/new Year.

UKPC have not filed their, so no rush on yours as dave says.

I haven't forgotten about this.  I've just done a bit of work on the WS, and will do more late this evening when I knock off work.  But two questions spring to mind.

Would your "jump leads" friend be prepared to write a short Witness Statement?  We could even write it at this end and just ask him/her for a signature.  Your inability to move the car is called Frustration of Contract and could be your ace.

Secondly, did you tell UKPC about the flat battery when you appealed?

Actually there wasn't a massive amount of work to do on the WS.  The "meat" was there because of the great work you'd already done.

Here is a version which I think is nigh-on finished.

However, with Easter there are a few days for the other regulars to suggest tweaks.

You could add that you wonder why parking company's solicitors add the unlawful extra charge and then swear that they have told the truth.

Must be getting on for tantamount to perjury and it is time it was stopped regardless of it being in the Code of conduct of both ATAs. Which just confirms my opinion of them both.

Better version attached with the late appeal explained more clearly for the judge.

This will sound silly, but I think it would be a good idea to e-mail it to the court and UKPC on Sunday.  It's probably me being daft, but Sunday is still March, and as it's late, sending it in March rather than April will make it sound like it was less late than it really is.  if you get my drift.

You can still pop in a paper version on Tuesday if you want.

Lookinforinfo - many thanks for your very helpful posts and advice. You must have missed it but i already found the excel vs wilkinson document on another site so its printed off too. As dave has suggested i will email it to the court on Sunday afternoon ;) 

FTmdave - i cant thank you enough for what you have done, im very impressed with how professional it has been done and very factual. This is amazing indeed. i Will do as you suggest and send an email to the court on Sunday afternoon. I will pop over with a paper version for peace of mind.

Is there anything i need to include for - 23.8 (exhibit 3)?

When it comes to sending the WS to UKPC, is it only the WS i send or is it everything? ;)

You need to title your exhibits - EXHIBIT 1, EXHIBIT 2, etc. - and add them to the end of the WS.

You can use the attached as EXHIBIT 3, you just need the one page, not the whole CoP.

The WS and the five exhibits need to be e-mailed to both the court and UKPC.  You might as well hang on till Sunday just in case the other regulars have ideas.

I'm sorry Mystic I did miss it.

My wife went into hospital around that time so while I read your WS I missed the Excel case and never had the time to respond to your WS.

Fortunately Dave has done pretty much what I would have done though I would have added the point I made on post 117 . It's partly to embarrass UKPC in the hope that they withdraw the case and if they don't perhaps the Judge might query their truthful declaration.

And I would still use the fact that being broken down is not parking as well as creating a frustration of contract. The Judge in Jopson v Homeguard spells out quite clearly what parking is and is not. He didn't use car breakdown as one of his examples but had he done so it would have been appropriate. It's just another argument to disincline UKPC from continuing.

I know it's a bit of a hassle to alter your WS again but if it changes UKPC from pursuing you , it would be worthwhile.

Ill also write neatly the exhibit numbers at the top of each page. With regards to emailing the exhibits shall i just name the files exhibit 1 to 5? ;);) 

could you be so kind as add lookinforinfo's 2 good points, i might muck it up with dodgy grammar and formating ;) 

 

lookinforinfo - no problem at all and many thanks for your wonderful reply. Your addition points are excellent too. I would add them myself but i might muck it up, i need someones professional touch to get the format and grammar correct ;)

Yes!

I think the WS is fine as it is.  The matters of Frustration of Contract and the made-up £60 have already been made clearly.

So e-mail it today to the three addresses above (two are for UKPC).

Obviously click on Return Receipt.

In the subject title put the claim number, the names of the two parties, the hearing date and "Witness Statement".

I see you have to sign and date the WS.

lookinforinfo  - many thanks for your kind words. It takes me ages to type anything, i have been using pcs at home for over 20 years and i still use 2 fingers. I do know how to spell most things but its amazing the amount i have to tweak with the spell checker. Then i have to read over it 3 or 4 times, putting words in and out and changing any punctuation. I'm not certain the rules around full stops and commas but i give it a good go ;) 

 

FTMDave - many thanks again for your wonderful reply. Points noted regarding the WS. I have done a digital signature and dated the bottom of the WS. I have just spent ages trying to figure out how to get a read receipt, i have yahoo and gmail email accounts but neither of them have read receipts. I think gmail used to have them but it seems its only the paid version that has them. You can seemingly get addons but i'm not sure how reliable they are. Any suggestions?  :) 

Just about to add my details to the top of the WS. ;)
