hi can any body help please 

 

have now got ccj from parking company 

they have done this without my knowledge 

only found out today when the above company sent letter

 

it was  issued on 13 dec 2022

 

i now have to apply for set aside  and it will cost me 275 to do so i could not defend this as i had no warning off this event

Is there a reason why you didn't receive correspondence or court papers about this, did you move house after you got the ticket?

civil enforcement  based in liverpool exchange building's 

 

phoned the court Northampton told them i had no knowledge of this till today which was yesterday

they said could have been postal strike

If so, have you updated DVLA with new details on BOTH your driving licence AND your V5C vehicle registration?

Thank you. So they knew the right address to write to after it went to court? One of the reasons dx wants you to speak to Northants is to find out which address they sent the court forms to.

we need you to get a copy of the judgement CCJ and the particulars of claim from the claimform, and the address it was served too.

might be an idea to record you call.

 

there was no point in complaining to them you knew nothing about the CCJ, there is sadly stuff all you can do about that now, it happened dec 2021, we are now more than 18ths down the line.

 

please get the info we need!!

Yes,I have phoned them this morning  and their systems are down  they will phone me back  when this happens  thank you really stressed by this never had any debt ccjs beforex

they might say that as the judgement is from so long ago they dont have a copy.

so you might have to ask for them to read the particulars of claim out if they cant send it by email pdf.

best to record the call, because the exact wording is very important.

also whilst you have them, get them to read out the address the claimform was sent too.

 

for want of clarity, when was the last time you moved?

 

dont worry about that letter you have, nothing they can do really . 

its just a threat-o-gram.

Hi 

The signs at Herons food stores allow free parking for two hours. You should have received at least one PCN and a couple of reminders. After that four or more letters from their useless debt collectors followed by letters from their legal team one of which should have been a letter of claim advising you that they were taking you to Court.

 

Have you received none of them? For even if initially they got your address wrong, before going to Court they are supposed to check that they have the right address so the letter before court should definitely have been sent to you.

 

If you check in our Library you will find the Subject Access Request form. Please fill it in and send it to CEL. They have 30 days to reply and when they do you will see where all their paperwork has gone.

Hi yes i have parked there before. But the toilets at surgery was closed covid 

 

I suffer from incontinence  being treated by consultant  ongoing then had to go find loo 20vmin walk till found one after I got ticket sent letter back to say this is why i was late ps they do not have email address 

 

they then asked me what meds I was on told them  they sent an other letter saying  what do want to pay

I said I will pay original charge plus letter from debt help

ignored this I then said I would come to their office

 

that was that last I had from them till letter received telling me what they had done ccj

no letter from court they said posted strike xx

They should include your correspondence in their SAR response anyway.

 

It sounds from what you've said that you maybe received the original PCN/ticket (NOT a fine!) and you also received their replies to your "appeal" letters ok, yet none of their usual dozen or so threatening  letters ever arrived?
