Hi everyone,

I need a little advice, on how to fix this issue. The (edit claimant) that issued it was LC Asset 2 S.A.R.L.  I have the letter sent to me by the court. But I did act upon it to rebuff their claim. So in away it is my fault.

Any Advice would be greatly appreciated.

Thanks Charly67

So, did you:

a) acknowledge service / submit a defence?

b) get given a hearing date / attend court?

Pointless trying to offer specific advice without knowing the details to decide if you need to

i) go go a set-aside, or

ii) consider an appeal, or

iii) pay it before it goes on the register of CCJ’s.

When (even down to just the month) did you get the first letter?

it would be unusual for it to be very close to the one after the 14th November for an initial notification of claim.

When did you receive it? And what did it say?

If it

a) notified you of the claim and

b) gave you the timescale to respond, and if

c) you didn’t response, and

d) the claimant them sought a default judgment……

you then can’t seek a set aside on the basis of not having been given an opportunity to defend the claim …..

  • dx100uk changed the title to Assett/Link/Kearns ignored everything - now have CCJ - old MBNA card Debt

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
