    • I do disagree with you regarding one thing - we are not very good with letters or these situations and are slow on the uptake. So far you have stood up to Excel and their threats, immediately given us the information in the sticky, done loads of reading up to educate yourselves, learnt from the mistake of outing the driver so you'll know not to do so in the future, got on to the organ grinder to try to get them to call off their dogs, etc., etc.  Good grief - we wish everyone who came here would do this!!! We are more than ready to raise the issues with a fair minded judge, who will most likely laugh your clients out in less time than it takes to capture more useless ANPR photos. We will of course be requesting “an unreasonable costs order” under CPR 27.14.2.g and put it toward future taxis to Harlyn Bay instead.  We all look forward to your clients' deafening silence.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I see that Johnson the corrupt liar has been availing himself of Blyths (what a suitable name) luxury 'hospitality' in the Dominican Republic again ...

and when it ended,  Johnson allegedly starts kicking off like a prima donna when his flight is slightly delayed

I'm trying to find an image of the letter than I can post as a pdf.

NEW: it seems that *taxpayers* covered the cost of Michelle Donelan's false accusations. Her department says a "nominal" sum was paid, "subject to all the usual cross-govet processes, & aims to reduce overall costs to the taxpayer that could result from protracted legal action."

This seems wrong to me. As someone else tweeted, is it in her job description to libel academics?

Whatever he does its extremely unlikely there WON'T be loads of loopholes for nondoms to exploit - its just headlines

- and as you say HB - think the public has seen these corrupt chronyistic liars for who they are no matter how much they try to rearrange deckchairs as a screen.

He's starting an independent channel online without regulation by what he calls the Ofcommunists. Odd because a lot of people think they've been rather lenient with GBeebies.

Budget summary

The Office for Budget Responsibility (OBR) issued its warning over today’s statement as it also revealed that the average worker on a £35,000 salary will still be £383 worse off over this year and the next due to stealth tax rises. (eg ongoing frozen tax limits)

Lowest income bracket calculated (those around 15k a year) roughly the same amount worse off - but of course its actually around 3x more impact

 

These figures DON'T seem to take account of council tax and water tax increases - especially that some being lobbied for are much larger than 'normal'

It's no wonder Labour haven't talked about all of their policies because it's highly likely the Tories will just steal them and then claim the credit.If your party's main policy seems to be culture wars and division, I suppose you don't have a lot of time for the practical stuff.

Personally I thought Hunt should have been told off for calling the deputy leader of the Labour party Angela, against parliamentary etiquette.

As for second home owners, Rayner underpaid by around £1500 according to one estimate. Someone else was referred to the parliamentary standards committee.

Interesting that you are happy that the extremist right wing have further ruined our Countries economy and rather than support our countries services and people - have just thrown away around another £48B of taxpayer money.

the guv say it was paid as she was acting as a minister - so she should be challenged for bringing the office into disrepute - I know they always try to have it both ways .. but it should be challenged.

Then they'll probably make her pay - and she'll perhaps try to charge it to Ministerial expenses  ...
