(Take it that means cannot enforce judgement) A defence has been filed with the court This has all happened on the 34 day, so a day late the defendant's submission.??? Options???   Please note that the defendant can still reply to your claim until the court has processed your request. If the defendant’s reply is late but arrives before or even on the same day as your request, it will have priority.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This video is amusing, but not really funny, as it must be a pretty awful situation for anyone to take on a leadership role and then realise they don't have required personality, experience or skills. To be a PM now requires someone to be pretty exceptional, with experience of running a large complex organisation, as well as the personality to communicate effectively what they want to achieve.

Truss isn't being very silent, an article appeared in the Sun late-ish yesterday. It's not clear to me if she's going in the same direction as Hunt. She's still talking in cult-speak - anti-growth coalition is still there.

Thats the issue - that the once tory party is in multiple faction uncivil war

Makes truss and Hunt seem a better option .. which in itself is a damning condemnation of the situation

 

Hunt has nothing to lose (Truss' fault) and everything to gain - going from a has-been to a grandee.

 

The entire set of populists need to be gone - they are hanging in trying to put time and voter forgetfulness between tory choices and policies and the voters

Probably work if they can get away with it.

 

The actual situation is so dire though - they have pretty much got to cut services (inc NHS and care) and raise taxes to pay for all the duff PPE and contracts - and ensure the fossil fuel energy company profits - if they can

I think this vlog from Peter Oborne sums up what I think may be true about Truss.  i.e., Truss/Kwarteng took deliberate actions for the benefit of Hedge fund managers and very wealthy people.

After being found guilty of a barrage of breaches, offenses and failures which caused pollution in Cambridgeshire, Buckinghamshire and Northamptonshire between May and September 2019.

Heard quite a few comments from many Tories including George Osbourne saying that what we are starting to see, are the negative impacts of Brexit as predicted by the remain campaign. UK is now in a different position, as the financial markets now see a country that is without the support of the EU. 

 

When UK was part of the EU, although not part of the Eurozone, there was a strength in numbers protection, as the UK enjoyed a level of trade with EU countries. Now outside of the EU, the UK has struggled to achieve the trade deals outside of Europe, that will replace any lost trade.

 

UK has managed to get to a position, where they will struggle to keep the world financial markets happy and the consequences could be much worse than we are experiencing now.

The name calling "remoaners" is now being used by a smaller number of fanatics and more people are now thinking their leave votes were a mistake.

 

Both Tories and Labour have a policy of making Brexit work, when the electorate may have changed their minds on what they believe is the best way forward for the UK.

While a few Tories seem to be recognising that Brexit hasn't done what we were promised, there's a section of the party or people just leaving it that still thinks every that's going wrong is the EU's fault. Even though we've left.

 

The thinking is that EU/Remainers are still in charge. So the story goes that Hunt was in Belgium when Truss contacted him, not on holiday as stated, but seeing the EU. And he's their puppet.

With so many Tory MP's likely to be upset with what is going on, there must be a good chance of a general election within the next 6 months.   If a Tory PM (Truss or replacement) no longer has support of a majority of MP's and starts to lose important votes in Parliament, then a general election is likely to be called.
