My partner has sent her mcol for £500 and had until Friday to win by default. She's just checked on the mcol website and hsbc have entered a defence...what happens now?

 

I sent my mcol which has just been acknowledged for £2440...waiting to hear from them...

 

bit worried now for my partner...

you will now probably get a letter from dg asking for a list of charges from you then a week after that you will get an offer, maybe for half, refuse that then you will get another offer for the full amount.

oh the games we play!

Hows this for scary then chaps. DG is just a few doors away from my branch of HSBC :eek:

Wonder how much of my correspondence will get lost in the post!!?? Thank the lawd for recorded delivery - well the post office anyways lol

from what I have read, everyones gets defended - they are trying to scare you into either giving up, or excepting there first offer.

they have just offered me half, and I would have excepted it but its gone too far now and I hae added interest :-D ..

 

All I got to do now s sit back and wait!

if your friend claimed 3000 and got it straight away - he was either very, very lucky, not dealing with hsbc, months ago before they had refined the process or some other explanation. i'd say at least 2 months from beginning to end is a more realistic target.

If you watched the money programme the other day, no banks have yet gone to court, instead they play the game, find out how serious you are, if you know what you are talking about, and at the last minute settle. I think it was HSBC who admitted that they settle on all claims, try the bbc website in the money section i think that quote is there. Keep going with your action, HSBC wont want to go to court and try explain their charges.

I can vouch for that as well - simply put, the banks reap approx £3 BILLION a year in charges - if you were them - would you RISK a landslide court case that meant a change in law that made it actually illegal for them to collect charges ) - ( I know it actually is) but it is down to customers to ASK for a refund at the moment with no definitive legislation applying !!!

Dec 2006 - Sucessfully recovered over £3k from HSBC with much help from CAG :-D

so, you filed your mcol on the 13th, i think you will have your notice of issue by now or in the next day or day - that give the service date.

next a few days later you will receive a notice of acknowledgment, on page 2 they will have ticked their intention to defend in full the charges, that is where you will find dg's address and possibly a name. send them a copy of your breakdown of charges, including the 8% interest and court fee with a little cover note referencing your claim number. you should also send the court 3 copies of your breakdown referencing your claim number.

the sending of the breakdown to dg has in some cases reduced the waiting time by about 2 weeks - not always but it is worth a try rather than waiting for them to ask for them.

(they often settle much smaller claims at an early stage, like your partners')

update....

 

hi guys....nice to see partner's money in the bank for xmas...i've just had the letter from mcol saying that hsbc have defended and that I've got to fill in the questionnaire and send £100 by the 16th...I was going to leave it till as late as possible as don't have the £100 till then...or shall I borrow it?

Hi

Just had notice that HSBC has filed a defence against my claim for £750 I have till 15th Jan to complete an allocation questionnaire sent by the court, do I fill in or wait?

I went through Small Claims court rather than MCOL don't know if this makes a difference?

Hi I have just been on MCOL and HSBC have decided to defend my claim. I must admit I was a bit worried until I read of the threads from others that have had the same reply. Can someone tell me how I get on the page to add my case to the court case list. Jim
